Please feel free to add your scan date and whether it's a new claim/mandatory reconsideration/change of circumstances or renewal.
New claims (NC) - people are being told the wait time has increased to 25 weeks! I would say most are done before this though around the 20 week mark?
Mandatory reconsideration (MC) and Change of circumstances (COC) is around 20-25 weeks.
Renewals tend to be between 15-20 weeks.
If you disagree with the outcome of an MR you can appeal and go to court (tribunal)
Scan date is the date DLA scan your application forms on to their system, if you downloaded your application forms then this will be from when your award will be backdated from. If you called up for forms then the date on those is the date yours will be backdated from.
If successful and claiming universal credit (UC) please update them as this will entitle you to disabled child element adding extra to your award.

Hi, Sorry its not recorded delivery. I just had the 'Horizen Certificate of Posting' (which is a printed receipt saying I posted a letter to DLA address, on that day). Its not giving you any tracking no. merely a proof of posting.

I think they should compensate families that get declined, on top of back pay, as a fine for making us go through this unfairly. And fined for not reading and deciding properly like their job role tells them to.

I'll scream it for those at the back - dla/dwp GET OFF on piss themselves laughing declining families who are clearly eligible because they enjoy saying no.

I'd rather wait longer if it meant they read everything properly and highlight the need of the child and award on those needs because if we're applying for a certain rate it's because the evidence tells them how and why we feel we are entitled. Do they honestly think this is fun? No!

Your circumstances are very much the same as mine and so I'll expect a decline.
I also think smi has become very well known since parents are telling each other about it and so they are declining more and more x

I hope you get a good outcome. Keep up the fight if not. Dla is just a drop in the ocean when it comes to what we have to fight for on a daily basis, for our children. They can’t even get a f*ing education without a fight. Something every child is entitled to. I’m currently fighting for SALT to be provided, as written in his EHCP, as-well, as he’s had a total of 1 session when he should have had 5 by now. My local authority don’t like me lol. Keeping you in my thoughts, and I’ll update when I have a timescale x

Yes was all cross referenced in MR with supporting evidence, honestly I feel the reasons for decline are so unjust. They’ve zoned in on severe impairment of intelligence for their reason to decline, the reasons being he likes to be outside, he can manage transitions and routines (he can’t and there was evidence of this) he responds to objects of reference and is developing verbal and non verbal communication (he’s in 0-6 months for communication, he’s nearly 6, completely non verbal, there’s no evidence to suggest this is developing either so I don’t know where this has come from) and that he’s a gentle child. The first time they declined they done so based on that he could respond to simple cues, which he can’t, so he therefore did not have complete and utter arrested development. I used caselaw against this as an ASD/GDD diagnosis satisfies this, I’m just hoping that the tribunal see through this, I’d actually take him along if it was allowed. X

@LB1988x yeah take him along, but remember if his needs are very high you may not be able to express what you need to because he may distract you. I'll be taking video footage and asking them to view it. Seeing is believing and although it's cruel that I do have a video of my son and my husband dealing with him inside and out, it's to give an insight into our life x

There are some good ones, the EHCP process/system is just overstretched beyond belief, lack of EPS, lack of specialist schools, staff shortages at the local authorities, more and more children need support and without the resources, unfortunately the children suffer, but I digress!

it gets up my back when adults are awarded pip so freely to be honest but I won’t get into that 😏

Honestly the fact that a doctor will be there is my saving grace in this, if they say no I’ll take it, but until then, a long wait and on with this appeal! X

@LB1988x The diagnosis for autism only satisfies one point of the six point criteria.. Autism or Gdd - arrested development of the brain only.
You need other evidence for impairment of intelligence, impairment of social functioning, and severe disruptive behaviour and severe behaviour problems, restraint in all settings and can not be left unsupervised in any setting for longer than 10 minutes.

It's really hard to prove and write down and say things in exactly the way they need it to be said 😩
And yeah they will use things like gentle child as that sentence alone contradicts the criteria for extremely disruptive and extreme behaviour problems but the thing is the two things can coexist with each other and that's what the dla DM guide fails to recognise.
Hopefully you will have more specific reasons if you call them and request the evidence they've used to decline aswell as the dbd385 🤞🏼

Video would probably be a good idea. Thanks for that idea, as you said it’s not nice is it but seeing is believing x

Thank-you, yes I cross referenced all the criteria and sent evidence to satisfy all of the 6 points but it clearly isn’t enough 😞 honestly there was alot that evidenced everything. I don’t even know where the gentle thing has come from to be honest? Thank you for your help I really appreciate it, can only try can’t I x

Hi all, hopefully this will be my last thread but I highly doubt it, can anyone advise or give there thoughts even, if this is good enough supporting evidence for my son, also sent in all his medical history and supporting statement , I'm anxiously waiting, like everyone.

Congrats ! Awards seem to have picked up since half terms finished now. The end is in sight for a lot of us 🙌

@Lifeiswhatyoumakeit9124 it's hard to say really, the school haven't mentioned directly what support your son receives by them to support anything you may have wrote in your forms.

I don't know if being fidgity is enough care needs, but could get low care but then again I'm no decision maker and you may have more evidence elsewhere in the claim pack x

There's evidence from gp and a Peadetrician visit and he's on the pathway now and having Elsa which is all in the claim pack and literally all of his medical history supporting evidence. Who knows what way it'll go I guess, just trying to stop worrying about it, thank you xx
