It boggles my mind it really does but I need to keep fighting for him and he will get what he deserves eventually

Absolutely. Your son deserves it. I wish him the best with his upcoming surgery. The more I see on here, the more I wonder if it’s just down to opinion rather than meeting set criteria

PositivityRipples · 18/12/2024 21:45

You're welcome it's all very overwhelming, CAB would be good for some advice. Obviously i don't know alot about your child's diagnosis or what that means for your child or the struggles that presents to the child or yourself, but like i said concentrate on explaining the needs and care you have to give the child, what you have to help the child with and why, what mobility issues the child has and any evidence to back what you're saying.

Thank you! He’s going to be down and out for a few months which is going to be so hard for him but his resilience amazes me

You would think the DMs would be able to make a assumption that if a child's MRI shows tumours they need help and care but they aren't allowed to make assumptions and because they have no medical training it's better to have a written consultant letter that clearly states, " seen child in clinic today, xrays are showing more tumours, MRI booked. Mother states child is experiencing pain so prescription given for calpol ect ect... This would tell the DM there is a mobility issue there and a pain issue. The x-ray and MRI tells DM nothing, the DM needs things wrote to them like they are 5 Years old... They add up the time it takes you to do things, what things you have to do, what is above the need of a child the same age and why you have to do the things for the child, so an MRI result doesn't tell them you've spent 3 hours that day helping the child get around because they are in pain, but a prescription for pain meds tells them that. They haven't declined this lady because they don't believe her that the child has a disease / disability because I'm assuming she's sent diagnosis paperwork. They've declined because they can't see how the child has care needs more than a child the same age or mobility needs more than a child the same age, so my advice would be concentrate on evidence of the care she provides and what she does for the child, how long it takes, concentrate on the child's pain, on how the child needs help getting around and not to concentrate on proving the child needs another operation or has had a xray ect. I'd advise her to seek advise from CAB and don't take what I'm saying as gospel because maybe the xray and MRI scans would help the claim, maybe others on the thread may know.

No it’s all good sound advice. It’s hard to know sometimes what to send in or if you’ve sent in enough and is that really relevant. I understand that by law they have to read everything even if they don’t think it’s particularly relevant to the claim?

Oh goodness I can imagine it’s not going to be easy. I agree with that, they bounce back better than us adults I think! I really hope when you’ve done your MR it goes in your favour

Thank you everyone! Honestly the lady was so nice she nearly cried with me.
at first she was like I can’t see anything on the system, I was like oh I’ve waited so long. Then she’s waited and said is your son getting HRM or just care, I was like just care I’ve done the reconsideration for mobility, then she was like I’m pleased to tell you that he now receives hrc and HRM. The way I cried😭😭😭

Amazing!! 😍 And right before Christmas too!

PositivityRipples · 18/12/2024 22:55

Yeah it is really hard to know what to send in isn't it, I mean I'm not saying don't send medical evidence but in this lady's case a decline with a solid diagnosis getting declined tells me she needs to lean into explaining in more detail what that diagnosis means for her child the symptoms the child has and the amount of care needs that puts onto the parents and how that also affects the child's mobility needs so when putting in the MR I would ask the decision maker to relook at that in more detail andd explain it in more detail I feel that would be more relevant than asking them to look at xray results and MRI scan results although they could help along side it so send anyway maybe? But don't be the only things she sends if you know what i mean.
I've got to learn to write shorter posts 🤣 I always feel like i write a 9 page essay 🫠

Woke up to back pay this morning, about 2617, 19 +3 weeks. Unsure of rates, feeling recognized and overwhelmed.
I was massively doubtful we'd be accepted due to my first time claiming (child is now 12 but was told to claim yrs ago) and I was worried about my wording. I focused on our daily challenges instead of all the extra things we have to do.
Thank you so much to all on this thread, I've been following for a few weeks and you've kept me going, I've learnt so much and don't feel so alone in my battle.
Keep fighting guys and fingers crossed for you all x

@Tasham25 I got medium rate care, but no mobility. I included lots of written examples for mobility and feel as though in awarding MRC, they've surely acknowledged that she would struggle on her own in an unfamiliar environment so that decision is disappointing. I'm facing redundancy after Christmas and work prospects are pretty slim considering shortly I'll be driving for 2+ hours of the day to get her to the school best for her. She wouldn't be able to get there alone as others her own age will, so that decision stings a bit! I've asked for a statement of reasons. So not the best, but certainly not the worst.

I think it’s definitely worth a call, the decision maker may not call back and you may not get a text either. I didn’t get either and the decision maker made the decision once speaking to the school. Therefore if the decision maker is aware that your evidence from school is in, they should be looking at it and deciding very soon🤞🏽🤞🏽 hopefully they already have👀👀
