Hello everybody, I have made a new thread please put in your scan date, hopefully we hear some good news this month. please be kind and feel free to share scan date, entitlement award and what child is diagnosed with as others in similar position can feel uplifted in these stressful times. 💐
New claims (NC) are taking ‘around’ 20 weeks.
Mandatory Reconsideration (MR) & Change Of Circumstances (COC) between 20-25 weeks approx.
Renewals between 15-20 weeks approx
tribunals: when you disagree with MR and are considered by a court
scan date (SD) date form was scanned on the system and counting weeks for decision
original claim date: date you called up for the forms and you will be backdated
UC : universal credit
DWP: department of work and pensions
DM: decision maker; the person who assesses each claim and awards/decline a case
number for an update 121-4600 0800 121-4600
currently we are in July/August for decisions! xx

Hey, scan date 7/8 New claim, got told today it's not even with a DM, and they have up to 25 weeks, also had lots of paper work/ evidence.

Yes I’d expect that you’ll be fine then.

We got rejected as DM basically implied son was unwilling not unable like wtf. Severely autistic non verbal suffering from anxiety all of which the school/ medical professionals backed up!

The only docs aside from the standard stuff that the DLA sent to the court was basically an fyi saying that if you do award please ensure thst it is only for x period as care award has changed! Shocking

I’ve got the charts. Meets all the criteria I’ve sent the evidence. I’ve sent my own statement against their reasons for decline alongside a statement of how he fits the criteria. I’m willing to take it to tribunal this time around.

I didn’t use any charts wasn’t aware of them. I’ll leave them to decide then see what tribunal if we need to

That’s like my son but he’s verbal although can become non verbal during times of heightened arousal. I expect they’ll say the same about him.

Thanks, that’s very helpful. I’m not sure he meets the severely mentally impaired, dla case law does accept children with Autism meet the state or arrested development though

They are told to award lower I would bet why else do they overturn before appeal is heard that’s what I’m hoping for, if not we will see them in court

I hold my hands up in regards to the renewal downgrade, I assumed that because nothing has changed it was just a tick box exercise.

I later found out that they treat renewals as a brand new claim..

fingers crossed they change the decision as it will mean that mobility will also increase however I’m not very confident much like us all.

If not I’ll be back in front of the judge in a year or so!

Any idea if they’ve moved beyond 17-18th July for MRs? I’m not calling today really don’t want to hear the same old

My daughter’s renewal is due next year. I’ve started collecting evidence and had a telephone appointment with her nurse today

Yes autism covers the arrested development. Severe mental impairment is covered by an iq of 55 or lower or something like that. However if your child can’t sit for an iq test there’s other ways to demonstrate it.

Correct

I covered it off with general behaviours with evidence from school/docs etc.

It is also important to spell out SMI/ caselaw to dla and how each test is satisfied as they often reject without a proper understanding

He won’t even sit any baseline tests which his teacher spoke to me about recently. 20 minutes test done online he wouldn’t do. He’s had no formal baseline test since year 3. Primary didn’t require him to sit his SATs he wasn’t able to cope with those either

Still following guys just to see you awarded before Christmas as we feel like brothers in arms!

You might remember that I got MRC but no mobility, which feels wrong as I included so much written evidence and feel that the reasons we will have been awarded MRC pretty much sum up why we should have LRM!

I phoned today to ask for a statement of reasons. The lady on the phone said the DM has not uploaded the reasons to my file so she is going to have to email them to ask them to revisit and upload the reasons so she can send them to me. It felt as though all my mobility evidence had been overlooked, so hoping this will get the DM to put money where his mouth is!

However; the lady on the phone also said my award letter will tell me the reasons too? Is that the case?

Mines a MR 06/08 same timeframe. I expect it’ll be first to second week of Jan for a decision but new claims they seem to be doing August ones now
