Do UC backdate from when awarded or does the UC element just start from when you tell them? Scan 06/02 but just want to be prepared x

Uc gets backdated but you have to ask for it to be backdated in your journal

I feel so deflated! Waiting 18 weeks (nearly half a bloody year) to be told it’s a decline! I run my own business of 12 years that I can barely keep going right now because I’m up all through the night with him and his behaviour is so mentally and physically draining. God I could cry today! I will do a MR though! Maybe tomorrow when I’m feeling better xx

Aww I feel awful for you, I would do a MR if I were you. What evidence did you send? Do you have any further evidence to send for a MR?

MimiRae · 09/04/2024 10:29

CornishMama2 · 09/04/2024 10:02

Deffo do a MR!

What was your scan date?

All I have is my word and the school said they would confirm he’s been placed on SEN register, has special circumstances put in place and that he’s been referred for autism diagnosis so assuming they did do that! I’ve asked for proof in writing of all of this to send in and unsure what else I can do! 3 years ago my daughter got lrc and I fought for her and she now gets hrc and hrm because again she is up all night, has food contamination ocd, can’t wash or care for herself (she’s 12) and working on top of no sleep was killing me (still is) but hshe support meant I could drop a few clients and cancel if and when I needed to to sleep. It’s just so draining trying to prove yourself all the time isn’t it? I wouldn’t wish this on my children, I don’t want them to have autism it’s heartbreaking 😢💔 but I need the help xx

@Emmajm85 just me and you now 😅 what’s the plan today are you calling?xx

Yes! Let’s hope we don’t have to park on the next thread 😂

so I’ve called child benefit who confirmed they have the application now and the status is ‘in progress’. She said they can take up to 12 weeks 😂
Then I’ve just spoken to DLA and there’s no movement there at all. Still waiting for the NIno.

what about you? Have you called anyone? Xx

Me too but I'm not really sure xx

If you child becomes entitled to DLA and they are not currently awarded a child element (due to being a 3rd child and born after a certain date) the rules don’t apply to them and therefore you can apply for the child element for them too aswell as the disabled child element. I would use the same process as screenshot above.

Bless you, don't stop posting if it helps you, people are here for the same reason, ask questions and get the support, I would do the MR and take it to tribunal, if needed, whilst doing that, go to the doctor's explain your struggles at home ect and get as much evidence as possible now going forward so if it does go to tribunal you have all your extra evidence, keep bugging the doctors explain your struggles, they might push referrals quicker, and it's evidence that you are struggling, you can get doctors notes as evidence, keep going 💪 don't give up!! You know your child better than anyone 💗

About half an hour. I called at about 8:45am. Hope you don’t have to wait too long. Let me know how you get on xx

Berosey54432 · 09/04/2024 10:57

I am trying to stay hopeful I know it’s more about the care the child needs rather than the diagnosis my little girl is 3 she has epilepsy… she had two seizures (11 mins & 3 mins) on Wednesday and we were in hospital until Friday they’ve just put it down as febrile as she presented with tonsillitis and prior to that was July she had a tonic clonic seizure lasting 25 minutes. I applied for DLA because I think she has ADHD although the paediatrician doesn’t agree with me but she’s still under their care. She cannot manage her feelings she breaks down, her behaviour is difficult she is hyperactive constantly buzzing around and she tries to bite me often, she has no sense of danger and will run in to roads, off in a supermarket so still have her pushchair and needs caring for in the night as she wakes up probably 6 out of 7 nights a week. She is really clumsy (I’ve had her eyes checked) and at nursery they always tell me that “she’s been a whirlwind today” I only sent in the transcript of her epilepsy diagnosis (focal and generalised) and a copy individual health plan I did with school nursery. Anyone get DLA for what I’m describing? Thanks.

Be hopeful, if you believe she deserves it, then you keep going untill she gets it, it's not based on diagnosis, my now 7yr old, got it at age 3 with nothing but nursery support, he's non verbal ASD, had no diagnosis at that point. And hardly any evidence to support, it was purely what I wrote and a statement from nursery xx

Ceej1520 · 09/04/2024 11:05

Scan date 18/12 had a text yesterday to say my boys been accepted 🙌🏼 good luck to all still waiting! Anyone know how long the back pay takes after the text? Really hoping to do a huge treat for my boy before he’s back at school xx

Shabutie · 09/04/2024 11:10

I was under the impression on UC, if your only entitled to claim for 2 then the child with the disability can receive disability element but not the child element if that makes sense ( if born after the cut of date for more the 2 children)

My UC statement always says I claim for 2 of 3 children, so if awarded I expect to claim child element for 2 and disability element for 1.

Bossofthehouse · 09/04/2024 11:14

Has anyone sent emails you’ve sent to school as evidence?

Oh, sweetheart, so sorry they have declined. It’s just unfair that people make the decision don’t know your child, that are not there to see how hard things can be. I hope your kid gets assessed soon and given a diagnosis. I would challenge the school for failing to support you on this though… have a little time to compose yourself and get back to the fight. It is relentless but our kids have nobody else to fight their corner and they deserve it too. Big hug 🤗
