No he was declined so I have just sent off for mandatory reconsideration

Did you have much evidence? My son got awarded at 3 but I think only because he got his diagnosis early. My daughter is 2 and a half but is the same as my son but not much evidence for her atm

I sent his diagnosis report, ehcp and then a further ehcp that stated he recieved his place in a specialist school in September, I also sent a letter my son’s nursery had written. I wrote pages and pages about him. My problem is he isn’t under that many people at the moment because he is so delayed things like OT wouldn’t be beneficial because he really does have absolutely no understanding and this was also stated in his diagnosis report. They extended his HRC by 6 months which obviously I’m pleased about but it’s frustrating that they recognise he needs around the clock care but can’t accept he is severely mentally impaired.

i expected to be declined and I’m expecting to be declined again but I will keep trying!

Wow can't believe they declined you with all of that evidence. If they say no again deffo fight it as clearly he needs the help.

His ehcp says that he has come on at nursery since he started in 2022, which he has but for example when he started he wouldn’t wear shoes and he would only walk on carpeted floor. He now wears shoes and will walk on any flooring but that hasn’t changed the fact he has no awareness of danger, in fact I would argue he’s more of a danger to himself now being able to just flee if things are too overwhelming.

They have also said he has a specialist pushchair for his safety not because he’s virtually unable to walk. He’s virtually unable to walk because he isn’t safe amongst other things!

it’s crazy to me the things that they try contesting!

Lou84lou · 20/03/2024 06:58

I was awarded HRC and LRM as of yesterday after requesting a mandatory reconsideration following being turned down first time: scan date for MR was 4/1….. after a full 28 weeks from start to finish , I’m glad it’s ok!

Yes believe everyone gets this letter when they apply. I'm on 15weeks this week but from what I can tell it actually takes about 19plus weeks for a decision xx

I posted my son's reform on 5/2 but haven't heard anything yet. Is this normal? I'm not expecting a decision but I thought I would get a letter saying they had received it.

Lou84lou · 20/03/2024 18:21

@elliejjtiny i never received a single thing from them until it was 9 weeks in to say sorry they haven’t looked at claim that it could take 15 weeks, but mine was awarded at 11 weeks

WillowS08 · 21/03/2024 12:37

does anybody know how long a claim can sit with a decision-maker for? Was scanned on the 9th November and last Wednesday when I called they said it’s with a decision maker so won’t be much longer. Still heard nothing at all- no txt , letter , nothing since the claim went in.
