Iv made this new one as the thread I was following along with others has now been closed mine was scanned on the 18th Feb and still awaiting decision, I'm currently been waiting 40 mins on phone to DLA trying to get a update

No sorry got it wrong I got a letter about the update on my new element and it will appear on the next statement which I saw today but no letter yet about back pay was just wondering how long it take I just have to wait for the message in my journal about this thanks @Polly421 will keep u updated

I am still waiting for a decision from DLA but have been awarded a blue badge my son is 7 and been diagnosed with autism and has sensory processing disorder I applied when applied for DLA and got an email last week advised been susseful

Hang in there not long left to go I just got my award last week so I know the feeling was 10 week wait just keep calling dla every week to keep u updated @Indr

i feel your pain. My daughter was sent to a special needs school 40 miles away and when her carer quit I had to take her in my old rusty Citroen. That ended up having to be scrapped.
luckily I managed to get a really decent car on eBay through a proper dealer for only £500. So when your back pay comes through have a look on eBay and see what you can find. Mines been going strong for ages. Failing that ask your local council about transport help.
I assume your son qualifies for an ehcp and Goes to a special needs school? Surely he’d be provided with transport as part of that ehcp?

@Nicky80catri I'm few days after you, 23rd march, I haven't rang them at all for this claim, with my other child's claim I was ringing them and it added to my anxiety and made me stress about it. With this claim I've put it to the back of my mind and it's just dawned on me that it must be approaching 10 weeks now so I'm guessing a couple of week maybe.

@Sarah3587 school transport is separate to EHCPs and shouldn’t be in EHCPs unless there are exceptional circumstances - Staffordshire County Council v JM (SEN) [2016] UKUT 246 (AAC). There is separate statutory guidance covering it, which is why you can get transport without having an EHCP.

BTW if you didn’t want to drive DD isn’t of being provided with transport by the LA the LA cannot demand you do. If they refused to provide suitable transport you can challenge the decision. SENTAS can help with that.

Ladies your anxiety doesn't stop! Even when you get the award told to you over the phone, from that moment on you're keeping an eye on the post waiting to see it in writing.
I rang twice to make sure there wasn't a mistake.

Both my boys have just got hrc and lrm within a couple of days of each other just waiting to hear back for my daughters mine was scanned 10th March. Fingers crossed for you all still waiting not much longer for you with any luck.
Also how do I update uc and ask for it to be backdated I have no clue so if someone could tell me I'd be so grateful for the help x

@Elizabeth1412 on your UC account online go to changes section and under the people who live with you, you’ll be able to input under each child they now received dla and input the date it was awarded from and submit. Then write a journal message asking for it to be sent to decision marker to have it backdated until the start of the award for both children. State you could only make them aware now as it’s only been awarded. They will send it to decision maker. I got the element added to my next payment but was about 3/4 weeks for the backdated amount. They issued a letter confirming it was being backdated once decision marker approved it and I got payment 3 days later.

I have been following this post a few weeks now. I have seen how long some off you have been waiting, I’ve put in for a change off circumstances and now my son is 5 for motabilty. Forms received back the 1st Off March then sent back to me as I forgot to sign a section so the other part was 15th March, I’ve phone a couple off times over the last few weeks they said mid June when I called last week the lady said a couple off weeks. She said they have been taking 20 weeks!!!!! Is there anyone else in the same boat, feels like it goes on forever and ever I’m feeling anxious that they could lower his rate that he gets now I’ve heard that can happen me being me thinking worse case!! but his needs are more harder now he is older! Any other change off circumstances out there?? :-)

Hi guys so this is my first post. I sent my childs DLA form 17th march and was scanned on 17th march. i rang on the 8th week to be told a week or two. I rang again yesterday to be told the same thing.
Anyone on here had a descision roughly the same dates.

Wow that is such a long time I had a letter about a month ago saying 11 weeks I think I will be waiting a long time then!! The lady said it’s because they don’t rush change off circumstances through as you already are receiving payment and will do up until it’s looked at! I hope I’m not waiting to much longer I hate the waiting 😫

Yes when i rang not last week the week before i got told 1/2 weeks.
Then rang yesterday and i mentioned that and she said they shouldn't really give time slots as there not always correct abd she said im looking at proberly beginning of June. She said they are still dealing with up to 17th march and that 18th aint even with the DM yet x

yes I know you can get transport with an ehcp but I assumed the severity of the claimants disability would warrant an ehcp and therefore make them eligible for school transport due to their condition. I pointed it out because you don’t tend to get it unless you ask or are automatically entitled.

i didn’t mean it automatically gets given if the child has an ehcp.
I meant that if a child NEEDS one to attend school AND they have an ehcp then it is INCLUDED in an ehcp. Therefor as the posters son obviously has quite complex needs warranting an echp then the need for him to have school transport would have been discussed in the meetings for his ehcp and therefore would have been noted and included in that ehcp.
I suggest the poster ask for a review of their child’s ehcp and make sure the LA are aware of her sons needs in full.

But transport isn’t, or at least legally shouldn’t be, included in an EHCP unless there is exceptional circumstances as per the case law I posted and needing the LA to arrange transport is not on its own exceptional circumstances.

The PP may want to request an EHCP early review for other needs that aren’t being met but doesn’t need to in order to arrange transport she just needs to ask for it and it refused appeal (which SENTAS can help with) as it doesn’t require the EHCP to be amended.

Been a get days since I posted but can't stop worrying that I didn't send enough in and heard mixed reveiws about sending more stuff in (even though all the way through the claim I made it so clear to please contact me if they need further evidence) people say send it in regardless to add to your case and I've seen and heard to wait till they ask for stuff as A-sometimes it's not even seen or taken into consideration and B- that sometimes it either gets 'lost' or they cabt figure out whose file its meant for so I was wondering what it's the truth to this if anyone's experienced it and what should I do please, again scanned 12th April for anyone following around that date, I'm aware I've a while to wait yet
