Sainsbury- almost 7 months out of date Apple Crumbles

Am I being unreasonable? Sainsbury’s online sold me Apple crumble which was almost 7 months out of date.

Said it’s quality over safety

Am I being unread to refuse £ 25.00 compensatory payment

A frozen crumble? It will be fine anyway, although shouldn't have been sold.

Why would you refuse the compensation? Are you saying you don't think compensation should be due?

Someone made a mistake, they've put it right and made a more than reasonable offer in regard of your time. No one was in any danger, they've done more than necessary, surely you're not hoping for more? What do you want?

There were 3 apple crumbles. We ate 2 and became sick. We retrieved the packages and noticed it was out date.

I believe Sainsbury has a legal duty to sell food which are in date.

Was it a best before or a use by date? Did you eat them? Unless you were made demonstrably ill by consuming them I think £25 is very reasonable.

I don't think apple crumble would make you sick, even if it was "off", there's nothing in it that's "dangerous"

Presumably they were frozen. Was it a use by date?

I imagine you're refusing the compensation as you don't believe you are owed anything, as you didn't eat them.

Unless you want more money for absolutely nothing. If it's that, then yes. YABU. And grabby.

The date on the item is not an expiry date and is the best before date. The best before date, sometimes shown as BBE (best before end), is about quality and not safety. The food will be safe to eat after this date but may not be at its best. Its flavour and texture might not be as good. Please be assured that as long as the storage instructions for the item have been followed correctly after purchase, due to the item being frozen, it would not be possible for bacteria to grow. With this in mind we do not believe the symptoms you have advised of are not consistent with food poisoning, this is also taking into account the time frame in which you have advised yourself and a friend experienced these symptoms. It is possible that these symptoms are due to repulsion sickness.

That's an excellent response. Quality may diminish over time, but that does not make the food unsafe.

Why did you eat them if they were mushy and acidic? Surely you'd stop after the first mouthful and realise they weren't at their best.

I have previously noticed out of date frozen food in Sainsbury’s, notified staff and they have taken it off the shelves. I think given it was BBE they are correct that it’s simply a quality rather than safety issue, particularly with frozen foods. I.e. crisps have a BBE and I find are a bit soggy after this date, but not unsafe, however, meat has a Use by date and I wouldn’t eat it significantly past this date. I’m a bit surprised though - Did you seriously taste it acidic and keep eating enough (two crumbles) to make you vomit? I think some personal responsibility is required there.....

Out of date frozen crumble would not cause sickness IMHO. And Sainsbos obvs don't think so either. They think you're trying it on. As do I.
Take the £25 with good grace and stop looking grabby.

Crossed over with the update, acidic apple would not make you immediately sick. Apples tend to taste 'fizzy' if they're off, there's no way you would ever think that is how they should taste.

More likely the apple crumble was defrosted and then refrozen.Which would account for the mushy taste.

I also don't believe that FROZEN apple crumble, correctly stored, would make you vomit. The £25 is a good will gesture, not an admission of liability.

Perhaps you left your freezer door ajar and the crumble defrosted and then froze again? That might allow enough bacterial growth to make you sick - but it would be your fault, not Sainsburys.
