Sainsbury- almost 7 months out of date Apple Crumbles

Am I being unreasonable? Sainsbury’s online sold me Apple crumble which was almost 7 months out of date.

Said it’s quality over safety

Am I being unread to refuse £ 25.00 compensatory payment

Sainsbury's has always had issues with selling out of date food. Years ago I saw raw prawns that were at least 4 days out of date.

I don't have a Sainsbury's near me so I very rarely shop there now but it looks like they still have the same issues.

All you can do is feedback to them and hope they make improvements. If you are doing an online order it might be worth switching to another supermarket.

The Apple crumbles were delivered via online service . I hope they were still frozen on receipt .

It was the first time my guest had that brand of Apple crumble. I thought he was lying when he said it did not taste right. I ate mine later and it was not immediately that we both stated to puke 🤮 . That was the only thing that we ate.

That was also the only thing that came up.

We check the packages and found them to be almost 7 months out of date. Received on the 11/6/20 best before date 20/11/19.

OP, not sure what response you're actually looking for, you've had quite a number of perfectly reasonable ones.

No, Sainsbury's should not sell out of date food. They've offered you £25 compensation which is more than adequate.

It's highly unlikely the crumble gave you food poisoning and Sainsbury's are right, if you were actually sick it was revulsion. I've had food poisoning and trust me, it is not instantaneous.

So which is it? Your statements are contradictory - the apples were mushy and acidic but you ate them regardless, you didn't continue eating when your friend became sick, but you ate your portion later (not with your friend and then also became sick). None of this is very clear.

You clearly have anxiety around BBE, there were no safety issues here - you can't get food poisoning from frozen apples - you can keep apples unfrozen in a cool dry environment for a year, so I'm pretty confident they're fine in a freezer for 7 months. As Sainsbury's have said, it was likely repulsion sickness and you're way overthinking this.

What is it you're expecting?

I get a weekly Sainsbury delivery and items that are on or near the best buy date are often flagged (in an email sent the morning of) with directions to just send the items back with the driver if they're not acceptable. Was this not an option, Op?

Symptoms of food poisoning take several hours at the minimum to start to show, usually it's a day or two.

What exactly are you hoping to get if you think £25 isn't enough?

What do you consider to be an appropriate response?

Fact your gp isn't concerned should tell you something, they are right, its frozen, bacteria cannot grow.
Just because this was the only thing you threw up does not mean this makes you sick, this is not how it works Hmm

It wasn't out of date..... It was just a bit of fruit past it's best and you were sick. Potentially just from the taste. Proper food poisoning takes longer.

If you noticed it tasted bad why push through more than one mouthful?

Did you end up in hospital? Any long term issues? It doesn't sound like it.

What more do you want?! If you have a moral objection, just don't shop there again....?

So the only thing you had eaten was this frozen apple pie (that for some reason you bought several of), your guest ate his first and you didn't eat it until later, by which time he had started vomitting. I would say £25 is great considering you are talking crap.

Further, I could and would have reported the matter to Trading Standards

My concerns were Sainsbury’s stating that it's about the QUALITY of their food and not SAFETY.

Therefore it is OK to sell customers food and multi food products after their best before date and your rights goes out the window.

What about customers ? Do I not have the right to choose?

I would not have bought any products from any grocery stores after it's best before date.

So why is it reasonable for Sainsbury to take away my rights ?

If it was a use by date you would have a point. I don’t know what rights they have infringed. An error was made, they have offered you generous compensation. Let it go.
