I'm beyond furious about this.

That's shocking, that poor child...

AnotherDelphinium · 03/04/2023 22:22

Wow! I would be too!

Before I read it, I’d initially wondered if this was another 13/14 year old and it was a statutory rape prosecution, but nothing of the sort!

FlamingoCroquet · 03/04/2023 22:26

From the article:
New guidelines for sentencing under 25s were introduced in Scotland in January 2022.
They made rehabilitation rather than punishment a primary consideration, recommending an "individualistic approach" taking into account their life experiences

Whoever naively brought in those guidelines should have foreseen this kind of outcome 😡

piedbeauty · 03/04/2023 22:27

Absolutely shocking.

He was 17. Old enough imo to take a proper penalty for rape. I wonder if it's statutory rape, as it happened many times.

Rainbowshit · 03/04/2023 22:37

Not statutory rape. He threatened her and seized her wrists.

Just another example of the complete incoherence of the SNP. Old enough to vote at 17 but not old enough to take the full consequences of your actions.

I just have no words for this. The fact he was 17 seems to have been greater consideration than the fact she was 13.

worktired · 03/04/2023 23:02

It's a disgrace

Sodd · 03/04/2023 23:05

Scotland? Not surprised, poor safeguarding due to woke washing.

No "seems" about it. We can't let this ruin his life, after all...

SammyScrounge · 03/04/2023 23:25

It would be good if the courts paid as much attention to the state of mind of the victim, her traumas, her having to adjust to what has happened to her.
The courts might also take into account the offender's viciousness at such a young age - it might not be a consequence of an immature brain but a pretty good indicator of a psychopathic personality. A good example is Angus Sinclair who raped a little.girl when he was 15. He went on to rape frequently and his offending culminated in the notorious World's End Murders.
This theory that people should not be punished up to the age of 25 is garbage, just another justification of criminal men's appalling offending. And it is women and girls who will suffer for it.

Same here. I really cannot stand the SNP

Pantsonfiretoday · 04/04/2023 00:03

Apparently 70% of the respondants to the consultation on softer sentencing of under 25s were against it but they were ignored/overruled....sound familiar 🤔

This

Pantsonfiretoday · 04/04/2023 08:57

So the SNP want rehabilitation rather than punishment for under 25s but where's the rehabilitation scheme? Is it just lighter sentences?
The papers have another under 25 rapist awaiting sentence for multiple rapes started when he was 16 . It will be interesting to see what he gets.

Y0uCann0tBeSer10us · 04/04/2023 09:17

I was absolutely gobsmacked when I heard this story yesterday as I had no idea that judges have to put the 'rehabilitation' of sex offenders above justice for victims now. Quite apart from the hypocrisy of saying under 25s need lenient sentences because their brains haven't developed but teenagers can absolutely undergo mutilating surgery if they are confused about gender, which idiot thought this was a good idea, and why wasn't it publicised that the SNP were making this change? Another poorly thought through shit show introduced under the radar. Scotland really is becoming quite a dangerous place to be a woman or girl under the SNP.

Peckhaminn · 04/04/2023 09:18

There's going to be uproar at some point. This cannot continue. Putting rapists back out on the streets with a slap on the wrist!!!!!

Workerbeep · 04/04/2023 09:44

I do not agree with this.

what a mess the SNP have created in Scotland and I do lay this on them.

so, for the purposes of voting and gender reassignment and self Id 16 years old are young adults and can do what they like but for the purpose of rape they are…what, children?

this way of thinking is demonstrated by the nefarious SNP MP John Nicolson, shown in his evidence to some gender review committee (see Graham linehan, sep 13th 2022)

user567543 · 04/04/2023 11:49

There are so many areas where the age of responsibility doesn’t line up - see also medical care.
I’d want to know what the rehab scheme and ongoing penalties are - is he on the sex offender register for life? Does he have a restraining order against the girl? Ie what’s her mechanism for making sure she doesn’t bump into him on his community service?

it’s a horrible situation and agree about age of victim - another foreseeable exception to this guidance. But equally, I’m sure that under 25 your big goal is to avoid future offending, whilst also putting checks…

FredandAmy · 04/04/2023 11:52

This is not justice. I would be afraid for my daughters if I lived in Scotland.

ColdAsAWitchsTit · 04/04/2023 11:56

It's sickening. The government need to decide whether 16/17 year olds are grown ups or not. They seem to be grown up enough when it suits the government's agenda. I'm horrified by this, that poor child.

We know exactly who introduced these damaging guidelines.

user567543 · 04/04/2023 11:59

Ah I see sex offender reg for 3 years - not good enough.

PicturesOfDogs · 04/04/2023 12:05

This happens all over, and people wonder why there’s vigilante groups.

there was a case in America where someone got a suspended sentence for the rape of a baby.

Sexual violence against women and children may as well be legal, it’s a fucking disgrace.
