Scottish government are passing a bill tonight that will give hate crime protection to every protected characteristic - apart from sex. Yes, women apparently don't register as far as hate crimes go.

But cross dressers will be protected so that's fine - don't insult a man in a kilt even in your own home, as you could be arrested. However, every day misogyny - that's fine.

SNP supporters - are you ok with this????

I saw on Twitter that Jess Phillips has been reading names of women who've been killed by men in the last year and in the comments that of the 118, none of them were transwomen.

Is that hate speech? Women don't have a place in the hate crime bill and yet the impact of hate is there clear as day.

Is the argument then that sex as a protected characteristic in the HCB would harm women because they would not then be able to speak about the very real harms women experience from the male sex (because men would be protected from hate speech and in some strange view, expressing female truth is hateful rather than fact)? Am I understanding that correctly?

We know that sex as a protected characteristic can be used to protect same sex spaces where there is a need (not a lawyer, so maybe badly phrased) under the 2010 Equality Act. So I would be very wary of the argument that sex as a protected characteristic is harmful to women. It seems the thin end of the wedge.

Ah so it’s because the term ‘woman’ would have to include anybody identifying as a woman and therefore man could just say they ide tidy as a woman therefore it’s not a hate crime based on sex?

I haven't read the full thead yet but I saw this passed last night and I was so sad but not surprised.

I forwarded Graham Linehan's statement to my MSP and Patrick Harvie because I think they just don't get it but Graham said it better than I ever could.

I think most people don't understand the implications for women.

I noticed it wasn't even mentioned on the STV or ITV news last night. Seemed like censorship to me.

I don't understand how we got here.

I actually sent the house of lords maternity debate to my msp and received a very positive reply but it's not enough.

The SNP do not have my vote.

@KatySun I was just watching some if Joan McAlpine's contribution where she touched on this fact of sex (both male and female) being a protected characteristic in the equality act. She argued that here, as there, it could be used more often with women than men just as the race characteristic will be used more often by black people than white people, because they are the group more likely to suffer abuse. From what she said, there's no inherent problem here. Except that they would then have to define 'sex' I suppose and admit there are only two (and you're born with your sex).

And yes the only explanation is that the SNP doesn't give a shit about women.
To the previous poster who said Rape Crisis and Women's Aid aren't 'politically motivated', that's not entirely true. They are government funded, hence they toe the party line or risk losing their funding.
Honest to god, it's a sad day to be a woman in Scotland.

What can we do?

I write to MSPs, I donate what I can to ForWomenScot and MurrayBlackburnMackenzie, and I tell friends that the SNP has sold women down the river. And of course I won't now vote for them in May.

But I want to do more.

How depressing.
In a year when huge numbers of predominantly female working parents have lost jobs, income, career prospects due to a loss of childcare and support.
In a month when a middle aged powerful male politician attempted to bring down his female successor’s career for revenge.
In a month when a woman’s aid charity was turned down for funding as didn’t also provide support for non-women.
In a week when a young woman was abducted and murdered for walking home alone.
In a week when a prominent woman has been publicly trashed for daring to not return the calls of a much older media hack (and to go on to marry a wealthy young Prince)
On a day when I was told that to win public sector contracts in Scotland I would need to play more golf.
What a time to be a woman.

Race and sexual orientation are included in the hate crime bill. This means you are protected if you are white and straight

Including sex in the Hate Crime Bill would have been neutral too. So men and women are equally protected. As it is in the EA2010.

The ideal solution would have been to add sex AND continue working on the specific bull around misogyny.

Women and girls in Scotland have been significantly let down by the Scottish Government.
