I'd be tempted to vote green for the list if they didn't have such awful leadership and hadn't hounded out Andy Wightman. They need their own VONC in Patrick. I'm sure there are individually admirable green candidates.

It’s the SG that are obliged to keep minutes, not legal counsel. If the SG took or lost the minutes then there is no effective record. Which is what it looks like

Greens fancy themselves as the Kingmakers of the next Parliament, so they aren’t a fantastically good alternative to the SNP. They will move to bolster the SNP with concessions they want. You can already see the movement from them on this

Per se it isn’t odd - it wouldn’t be odd for a note not to be written if there wasn’t a legal point to deal with. Even then, your client might say that they didn’t want further legal advice in a written form. So not that suggestive, though the Scottish Government Lawyers should have recorded and made a note themselves. If that isn’t there, then that is odd...

I think purely from a public cost audit POV, the decisions made at key points in this process, which then led to the extraordinary outcome & excessive costs, should be noted & kept on record. I work in a private company, and it's just not feasible at all, under any circumstances, to make a decision on a litigated case & not have it recorded. It's just so alien to me I genuinely struggle to get the 🤷🏻‍♀️ response by Scotgov on this. Like "oops, sorry!" And we all move on? 🤨

I don't think it was the wisest move to cast aspersions about GA who by all accounts is well respected by many, and highly regarded too. Nor the others, also highly regarded/well respected etc who verify what GA said after that discussion.

The implausibility of no record is striking for these meetings but they would never have been disclosed in court if there had been written up if there was legal advice. So why no record?

Legal advice is confidential to the client- SG would never have expected to disclose it. I know some legal advice has been released in response to the enquiry, but that is different.
