Interesting news on the judicial review... I'm not sure what impact it will have though. I think all the court can do is quash the decision, and the SG have to make it again, but given the "framework" for setting the tiers has a hefty dose of "taking into account the context" and "all other things considered" they'd probably make the same decision again. And even if they didn't, the next review is Tuesday anyway, so they could make an entirely different decision then anyway. The court can't say it was a "wrong" decision and the decision should have been "x" - but that the way the decision was taken was improper, so it is invalid. At least, that's how it works in planning... Assume it is the same here.
Unfortunately, I think the (rushed, and not properly debated) legislation underpinning everything is so vague, and is all at the discretion of the First Minister, it would be hard to argue that she was exceeding her powers as, in terms of Covid, she has All The Power.
I do think, on a Scottish and UK basis, this could well run for years. So many decisions made and restrictions imposed seem so disproportionate, and I really don't think there's been the scrutiny that should have been given to the legislation.
