Hi everybody, thanks for lovely messages as ever!
Up and Across, yes you do have to wonder don't you? That is going to be the next battle. I also think that men should not be allowed to abandon their families onto benefits and just walk away. I can't wait to get out of this hole, which I will one way or the other, but I agree, taxation would be a very good thing! It's disgraceful.
Anyway, onto today's hearing. Mr WT did turn up, 20 stone of unshaven blubber sat in front of me. I literally cannot get over how bad he looks or how he has let himself go, I haven't seen him for a couple of months probably, maybe a bit longer, so it was a shock. Yellowing, lined, so so lined, he used to have such a baby face. It's a pity really, more fool him and OW for letting him get to that state.
So, this is where we are at. The remarriage clause remains as according to DJ Slow-Speaker that is the "law". Indeed. He is correct, but he did say at the last hearing that he wouldn't be ordering that clause. I did point this out and he said he "might have insinuated it" but that it is normal for it to remain. However, what it actually means (and this is what I misunderstood but have now been able to clarify) was that the "spousal payments" of £1.00 per year so very generous would stop if I were to remarry, it doesn't mean that I can't claim on the nominal order in terms of DS and that remains joint lives. That is absolutely fine by me. I have no intention of ever remarrying or living with anybody again, that is just not going to happen, I will never ever invest anything in a man ever again after this, however, I wanted to be sure that Mr WT was held responsible for the little boy he has failed so spectacularly and that remains
.
Mr WT appears annoyed that he can't be removed from the mortgage. That is just tough apparently. When I sell the house and when the mortgage is paid off, he will no longer have to worry about it. It's amazing that he is even allowed to just stop paying his own mortgage and leave it to the taxpayer and yet complains about it!
Finally, he tried to get the consent order signed and indeed sealed during the same hearing. I refused as I want to have the document he placed in front of me at the hearing checked by a solicitor before I sign it. Judge said "sensible". So, I shall organise that over the next few days. This could have been dealt with at the last hearing, Mr WT's excuse for not turning up was that it was a "mention", er no, it wasn't. It was a clearly worded listing for a "all parties" and indeed was set because Mr WT wrote a load of shit to the court!
Lastly, and it was a warning shot, if the consent order is not returned to the court within the timescale listed on the order, then we will be sent to trial, with full up to date financial disclosure required. Obviously, I have nothing to hide, Mr WT and Pauline can't say the same. I am absolutely sure they would wish to avoid that alongside the barrister and solicitor costs, never mind cross examination. I don't anticipate any further delays and know that I will be able to invoke the nominal order when not if it becomes necessary.
So, I am hopeful that I will finally be divorced within the next month! As the judge said, this has gone on too long. Frankly it was all completely unnecessary but I am glad that I can finally see a future for the kids and I! Am very happy today!
