Looks as though we are heading for simultaneous exhange/completion next tues. not heard a thing from our solicitor. Bottom of the chains has been AWOL but apparently ready. Really didn’t want to have to do it this way. People have paid for removals with absolutely no guarantee! Solicitor in the chain is on holiday Monday so it’s the only way now.
Last I heard our funds were not confirmed for tues. it’s so nerve wracking !!!!

Has anyone done a SIM before ??? I’m so nervous for those who has paid out for removals.

Turns out the outstanding enquiry is related to my question about section 20 notice. I half suspected that my solicitor didn't send it over to the other side as I have asked about it many times and didn't receive any answer. What an important question, left to the very last minute Hmm

Nothing surprises me at the moment. I’m half expecting something really important to have been left last minute also. I hope everything is sorted for you now?

I have accidentally cancelled my current mortgage direct debit. Kids messing about while I was checking dates and I have pressed to cancel arghh!!! I really hope this doesn’t effect anything

@Mumsybud I hope your exchange/completion finishes smoothly next week. Was it because your mortgage offer expires? Mine hasn't been sorted out yet, we have just sent the questions to the other side last Friday. I feel sorry for the seller for the last minute surprise due to my sorry of a solicitor, but section 20 can result in a large cost so this needs to be answered Hmm

On top of that I've just discovered that the flat is on a privately maintained road. Does anyone have any experience with that?

A friend of mine recently moved to a home with a privately Maintained road. I don’t know the full details but she told me she has indemnity insurance as she showed me the certificate on her phone.

Do you mean the reason why we are doing it together ? If so no, it’s because top of the chain are set on tues and have actually paid for removals as they seem to be very limited to what dates they can actually move. The shots have been called from above all along and it’s made it hard for a chain of 6. Well fingers crossed solicitors are sorted and we can actually get it done.

Also rung the bank and they said they can ‘push’ the direct debit though for the mortgage tomorrow so it doesn’t mess anything up. As apparently it can cause big issues with the redemption. I’m just sick of it all now. Myself and my husband have put a limit on things now. 3 more weeks we are 6 months. It’s just exhausting

@Mumsybud uhm I need to contact a mortgage advisor tomorrow for a quote. No idea what indemnity insurance will cover for private road Blush

Section 20 is when the freeholder gives notice to leaseholders to consult about a work that will cost more than £250 for each leasehold, so it's fairly important to find out what that is. If it's for regular repairs i'm not too fussed, but will be another matter if the roof has fallen or they want to change the entire flooring Hmm

@Okigen we have a privately maintained road but only because it’s a new build estate and eventually the council will adopt the roads. Most people around here that have sold took out an idemnity. It’s held up nearly every sale in the area trying to sort this out.

We’re supposed to exchanging with our buyer today. Just waiting for confirmation from our solicitors. We should exchanging with our seller in the next couple of days.

The private road at where I'm buying has been there for the last 40 years since the development was built.

@Okigen I believe ours would cover any repairs, any extra works that the council are not obliged to do legally. Anything the developer won’t cover once building as completed. Although ours is slightly different because our roads will be adopted by the council but the indemnity is for cover in the meantime.

I wondered the same but that makes sense now. Our new house has an unadopted road until the council take it on, but I Havnt heard anything about insurance. But I suppose the seller would sort that?

I have rung our solicitor this morning as we are supposed exhange/complete tomorrow. Everyone’s houses are empty and vans paid and booked. Our lender still hasn’t confirmed the release of funds. It’s so close. EA said not to worry this morning as others with the chain are not expected until later today. Is this normal??

Why are solicitors knobs?

She ignored my "in your professional opinion can we move by Xmas" question as well. Why do they do that? It's so fucking rude.

It is possible but I think unlikely to complete by Christmas. I think this because:

  • You've got just under 4 whole weeks until the big day.
  • I doubt that moving companies will be keen to book in many jobs in Christmas week. They'll be focusing on a few bigger jobs (potentially even commercial). That takes us to Friday the 17th as a good, reasonable and dependable last day.
  • It usually takes 5 working days to draw down a mortgage, even if you exchange and complete on the same day. That's in theory the 13th although in practice it could need to be the 10th to allow for any timing differences on the BACS.

That gives 2 weeks/ 10 working days from today for everything to be sorted. Given the amount of back and forth between solicitors that goes on, and the fact that you can't rely on anyone but yourself in this game, I would resign myself to a post-Christmas (probably January 4th or 5th) completion date.

You should absolutely keep pushing to get dates nailed down though.

We've exchanged!! Can't believe it. I had resigned myself to the end of the week at the earliest.

Completion is set for 9th December. Most of our stuff is in storage so not much packing to do but time to check out Cyber Monday deals for white goods!

Thanks Claudia I think you are right. Would just appreciate some honesty from the solicitor instead of her ignoring me.

Guessing we won't hear anything from Santander today. I'm really really fucked off.

@Getyourarseofffthequattro The most important thing will be to set dates for exchange and completion. Once you've agreed those dates you can hit people around the head with them to make sure it goes through. As soon as you've received word from Santander and your solicitor agrees you're in a position to exchange I would push for dates to be confirmed.

Have you worked out whether Santander will cover home insurance for you from the date of exchange? Our provider covered us from exchange date for no extra fee (we start paying from completion date). If so, you don't have to worry about exchanging now with a completion date post Christmas. If you're going to be paying from the date of exchange I'd be keen to keep the two dates as close together as possible.

This is the issue I can't get anything out of either of them. Santander are presumably doing fuck all and just say "we've got it" well yes I know that you've had it for four weeks.

Solicitor just says she hasn't heard anything. She doesn't even chase anything anymore.

I don't think you need to discuss the dates with your solicitor - just instruct. Choose a sensible day (not a Friday, avoid just before or after a bank holiday, Mon-Wed the best!) with a couple of contingencies in case Santander don't pull their finger out and then you can pounce as soon as you get the information through.

@Getyourarseofffthequattro ughh unfortunately if you haven’t got any updates in the next couple days I don’t see Christmas happening. Most solicitors start winding down from the 15th December. We got our mortgage from Santander and it was really straight forward. I wonder if there’s any sort of missing paperwork? I know with our buyers because they were using a conveyancing firm, they didn’t seem to know what they were doing and anytime there was a query they couldn’t answer they’d send it back to bank and of course they wouldn’t know or want any risks so queries to ages to answer.
