We have handed in the signed contracts and everything else is done, so I presume we're just waiting for the buyer to decide when they want to exchange? Doesn't seem we have a say in it?

Can I join in? In the process of buying and selling our house. Hoping it won’t be too long before we exchange although the E word not been mentioned, nor has a completion date. All parties have mortgages offers, surveys done, searches back and most enquiries back. Surely we can’t be far off!? Confused

I just want to say that our vendors solicitors are condescending rude people.

Do you guys think it is reasonable to be able to confirm that a boiler is in “good working order” if it is 18 years old and not been serviced for 2 years? I’ve asked them if they will get it serviced and the response from their solicitor is “this is not a legal requirement and our clients have confirmed it is in good working order”

If we accept that, move in and it is not in good working order would we have any comeback? We’re expecting to replace it when we remodel the kitchen but that’s probably 2 years away. Just want to know it’s going to last until then.

@Lemonylemony no there wouldn't be any comeback if it breaks down after completion.

Unfortunately though they are correct, they aren't obliged to provide a gas check. If they really won't do it, it's worth considering having your own inspection carried out before exchange of contracts, as it's a "buyer beware" system. Obviously you may not want to do this and bear the cost, but it's an option.

It's not a fun process to be in is it Sad

I am fully aware they’re not legally obliged to, but the solicitors response isn’t clear to me that the vendors have even been asked if they would have it done.

@Lemonylemony sorry, I meant specifically for yours to ask theirs whether they have taken instructions and that sellers themselves have declined to have it serviced. They probably have asked them but you're right that it's not completely clear.

@jujuball If the buyer pays for a gas safety check and asks the vendor to have the boiler serviced/replaced as a result of that, can the vendor just decline to do so?

@BigHuff if you were going to pay for a gas check as a buyer I'd suggest asking for access to do the check via the estate agent and paying your own gas engineer direct. That way you know you've used someone suitably qualified and the report goes to you not the vendor

Just adding about our personal journey on this thread... we're planning to change agents in a couple of weeks after we've had a gardener round, which is hopefully next week.

I feel stressed at the thought of getting the house photo ready again! And typically, just as we're looking to switch, we've just got another 2 viewings booked for Saturday. I'm so done with all these viewings now it honestly feels like it's never going to happen Sad

Can I join? My house is under offer. It wasn't actually on the market, but the agent rang me (I took it off the market last year) and said they had some buyers who would be interested. So one viewing later and we are under offer! Trying to get hold of a conveyancer is interesting, they are all very, very, very busy.

@BigHuff I queried this with the sellers EA and asked for another visit to see it working. It was also raised in my solicitors enquiries as they had it regularly serviced and was due a service in 2 weeks anyway

@Lemonylemony if I were you I would budget that a boiler will be needed in the next couple of years, I don't think modern boilers tend to live beyond 20 years these days? If you weren't aware of the age of the boiler when you put your offer in you could try to renegotiate now to factor that in? Depends if you think your offer is fair or not.

@notheragain4 no as I'll be using a mortgage and the lenders will want somebody independent acting for them. Different lenders have different criteria but some (eg Nationwide who I'm with at the minute) allow my firm to act for me as long as somebody of at least my level of seniority or above deals with it Smile

Yay after the mortgage survey yesterday we've had an email to say we have our formal mortgage offer. Need to wait for all the paperwork but that's our last hoop. hurrah! just the enqueries to go now!

Just had the call that our house sale has completed. 4 weeks until our move into our forever home :) on our way to the Isle of Wight for a bank holiday break (poorly timed not realising we'd complete and need to move this week!), sat in the car entering our meter readings online and doing various other house admin before enjoying the weekend haha!
