It's been really useful to see the usual order of tasks dealt with by the solicitor. I feel slightly less clueless now!

Slow news day here. But I'm getting frustrated that, according to our EA, neither they nor our buyer can get hold of the broker regarding buyer's mortgage. This is the EA recommended broker! Unfortunately DH was the one who spoke about this otherwise I'd ask them why they were recommending someone who didn't even update them or their client. I'm about to fork out for my survey and really want to know that there has been some progress on that side.

@MinecraftMother I've realised you must be a conveyancing solicitor? I think I missed that earlier in the thread. I might just email tomorrow and just ask if they have had any responses to their enquiries and what the timeline for exchange might be looking like.

I didn't even realise they sent us a report until @Jujuball mentioned it! I have to say the house buying process is incredibly complicated and seems to differ between conveyancers and different sort of house/flat purchase. This isn't even the first house we've bought, but our first house was a new build bought off plan and seemed to have much less paperwork!

I had a quote from a painter & decorator today, and I've got a handyman coming tomorrow.

Thinking of pausing viewings for a week just to get the redecorating done, then going back on the market for another week. If no offers by then, I think we'll drop the price by £10K or so.

Oh man. Was going to type out a huge long message, but actually sod it. Spent the evening trying to understand the title documents and deeds and now my brain is fried. Still no mortgage - it's a month since we submitted our application.

We're going to send back contract and TR1 form to solicitor. What happens then? (Obtaining information from the solicitor himself is impossible.) Searches are ongoing. We had our survey done ages ago. We make enquiries to the vendor, and then assuming those + searches come back ok, we exchange?

ibuiltahomeforyou We had our house set up like a show home for 10+ bookings, and then a couple turned up on Friday evening (EA hadn’t let us know) and caught us snacking and drinking wine in the garden in very casual clothing (very hot weather) and the kitchen was a mess as dinner prep was underway, and the dog’s toys were everywhere. That couple put in an offer! It taught me that decor etc won’t make a huge difference if people like size/location.
I was mortified and can’t believe how it turned out Blush

Countdowntonap, me too, show home for a week and a half of viewings and I forgot one that had booked a couple of weeks early. My puppy had shredded cardboard all over the floor, the bins were out the front instead of neatly put away. Dog poo in the back garden 🤦‍♀️ then they put an offer in!

Also the house I'm buying was in a bit of a state when I viewed but I was so excited, I had that feeling where you fall in love with a place 😍

Not that we are remotely 'there' yet Sad but people are reporting that actually getting transactions done (after offer accepted) is proving tricky with our agent at the moment. How much does an agent actually do in this process and how much can you hassle them to make sure it is done in a timely manner. It seems that they are struggling with work load but not admitting as such

@longtimecomin @countdowntonap I do understand what you're saying and if that happened for us it would be wonderful... but our area is a bit marmite let's say (London Zone 4) so we do need the house to work hard for us during viewings.

I am starting to feel the urgency as the house we had our offer accepted on is going back on the market this week. We need to get back on track in the next few weeks to be in place for primary school admissions in January for our DD.

It's been a long week here. So after all the chaos with my sale last week it is now back on. The buyers apparently completely screwed up and thought they could buy it with tenants in situ and then evict them themselves and didn't realise what a legal position that created for their mortgage and no one advised them otherwise. We have moved on and they have the mortgage and survey complete. As part of this deal they have to get a new lawyer and i am awaiting their confirmation of a new solicitor before speaking to the tenants and asking them to move out...we are throwing in the furnishings for them if they want as a sweetner to get them to move quickly. I really didn't want to evict them but unfortunately just no buy to let bites as it's not the best financial investment. But it's making me very nervous and anxious about what is going to happen with it. Esp since a flat in the same block has now been reduced to an asking price just £2k above my offer (although the layout isn't at nice as mine).

The purchase of the property has been a little easier. We have the mortgage survey booked in for next week, awaiting the home buyers survey and searches have commenced. Hurrah. Spoke to the sellers yesterday (it's a private sale) and they're in a similar position with their purchase (which is chain free) so should be on good position to exchange some time in September. fingers crossed.

Hello! Our house has been on the market about a month, no offers yet. Waiting on feedback from our latest viewing. I am very fed up of nothing happening, and of constantly feeling I have to keep the house viewing ready.

So far we've had...
Didn't like there's no downstairs toilet - can't really fix that one.
Not enough storage - we have built in storage in most rooms and a garage+ eaves
Overlooked garden.

None of which we can easily fix.

Estate agent rand today, said he couldn't get any feedback from the last viewers, and that the whole market is very slow.

@MinecraftMother going to hop on with a quick qu if that’s ok - covenant consents! We have one, from what I can tell/what solicitor said it’s not a big deal and just needs indemnity insurance - my question is if the sellers quibble over paying it am I right in thinking that we can pay it ourselves just to get it done? I can’t see why not but you never know with these things. Also is the Umbrella Academy good?! It’s on our list to watch (currently doing Money Heist and loving it if you’ve not seen it!).

@Bells3032 what a palaver. Sounds like an absolute nightmare all round but at least you’ve got it sorted and can keep plodding forward once again.

@ScottishDream welcome and good luck with the viewings/feedback. I feel your pain on keeping the house viewing ready - 3 little kids and a tiny house, there was a lot of threats and screen time involved here 😂

Well it’s all going well here, searches due back this week, vendor has apparently sent back fixtures & fittings and property info forms but we’ve not seen them so hopefully they can be dug out of someone’s in-tray and sent over to us - I’ve made it very clear to everyone (my solicitor, vendors estate agents) that I want to, at the barest minimum, be talking exchange dates by the end of August, and ideally have already exchanged by then, with a view to moving either the first or second week of September. Everyone has agreed that there’s no reason that can’t happen if everyone pulls their finger out so I’m now packing some of the nonessential bits and will be pushing every few days to make sure things keep moving. It’s all feeling a bit real now!
Oh and I had another round of the ongoing argument with DH over the actual moving process (I want movers, he utterly refuses, we’re hiring a big van. I want to load the big stuff the night before, he thinks he can load the whole house on moving day morning. I think he’s a knob. Rinse and repeat) which is practically a tradition at this point 🙄

Yes of course! Just get your sol to buy it for you, they'll put it on your completion statement. Breach of freehold restrictive covenant is one of the more expensive title defect policies but still less than £300 I should think, depending on the price of the house and how new the breach is...

Ps if the breach is very old, like 20 yrs plus old, consent could be implied.

@MinecraftMother thank you! They might be happy to pay for it but they’ve been slow with everything else so I’d rather pay it if needed for the sake of not having to wait! And believe you me I would LOVE the movers, I’ve fought my corner valiantly but to no avail 🙄 sadly for me, the big Luton van IS the compromise! I’ve done the entire move, all the paperwork, running around, chasing etc etc so I’ve decided to just check out of this aspect and when it inevitably turns into a massively stressful shitshow on the day I will be staying quiet and letting him sort it out Grin

@scottishdream hi, just wanted to say hello as we are in a similar boat. Been on the market 8 weeks with 8 viewing but no offers. After viewings about half have been uncontactable. Other half have liked it but chosen to offer on similar houses. Our EA also said that while the market is quite buoyant at the moment, it slows as you move towards the bigger houses that may be thought of as 3rd/forever homes whereas first and second time type houses are flying out in days. Also very tired of living in a show house with small children both at home all day

@jujuball on my original title plan from the rear access to my house is shown different to how it has always been for me. I've only noticed this now I have come to sell the house. I have amended it as per the attachment and sent it to my solicitor. He said he has made a note of it. Should I be concerned and do you think this could delay the sale?

How did the amended access say come about and is it formalised anywhere or just by you and your neighbour together, and this drawing?

Access looks to be formalised splitting neighbour's garden anyway, so i should imagine your buyer will take a view.

If the brown access was suddenly removed (let's say there was an argument with the neighbour for example) I presume the original green access is reflected in the title register as an actual easement (right of way)?

The "amended access" was like that when I moved in over 12 years ago. ,( No idea why it was never picked up).
World out easier for neighbours too as no going through middle of their gardens.
AFAIK it's never been finalised , as you can see, the deeds show access through gardens

@FourForYouGlenCoco (love the username) I'm not sure what your moving situation is, I think moving yourself can be done if you're moving from a small flat without much furniture! We moved ourselves from our first flat but it was furnished by the landlord so there wasn't much furniture to move. Now we are moving from a 3 bed house we are getting a proper removal company to do it including the packing!
