@notheragain4 assuming everything's sorted on your sale, to exchange on a new build purchase I'd just need:

  • signed paperwork
-deposit + my fees cleared into the firm's account

So if everything was done, I wouldn't even need a week's notice to be ready to exchange to be honest (if you're tying in exchange on a sale of course you'll have to bear in mind waiting for the buyer's solicitor getting things lined up for them too).

This is on the assumption also that they've already reported to you about the property and you're happy with everything, things like the expected completion timescale/long stop date are agreed and all good with you Smile

@Jujuball thank you, we are tying them together, not been asked for funds yet (although I think we have enough from the sale without having to add more) I'm guessing we need an updated completion statement from selling solicitors as it's been a couple months and I assume our mortgage redemption figure will be different. I was really hoping to be completed on the sale by end of next week but doesn't seem very likely.

@notheragain4 yes if you're completing your sale before your purchase, they'll get a final redemption statement for your mortgage once a completion date has been agreed that is calculated exactly up to that date. Then they should send you the final completion statement to approve.

No harm asking your solicitor for an update on timescale since it sounds like you're almost there Smile

Thank you Smile I will chase him again tomorrow, it was only Friday I last contacted him but they know we are desperate to complete next week, I wouldn't mind if they said it's not going to happen but would just like to know what's going on. See what comes of tomorrow.

On a side note, my Covid results also didn't arrive today Angry we have loads we need to do tomorrow and weds and I'm paranoid they've been lost, most other people get theirs the next day and I will be fuming if I have to go again and self isolate another 48 hours!

@kerrymucklowe2020 is that your actual Land Registry title plan (the boundaries of your house should be edged red unless the solicitor has sent you this one as a scan or something which isn't picking up the colour).

Is the one edged with a thick black line the one you're buying? Or is it just 2 properties with that black edging literally in the middle of you?

Unless your solicitor has coloured it blue themselves to highlight the area to you, blue tinting on a LR title plan generally refers to rights of way (it will say in the title register what exactly the blue relates to - eg "the land tinted blue is subject to the rights of way contained in a Conveyance dated X"). Rights of way aren't always what you'd generally think of, like someone being allowed to walk onto your land for access to take out bins or something, sometimes there are historic ones for the free passage of water through pipes/gas/electric etc which cross neighbouring land.

That would be my guess without seeing the full title register, but your solicitor should be able to tell you exactly what's what Smile

Hi gang, reading with interest as another property solicitor. Hi @Jujuball 👋 😘

I responded on the simultaneous exchange/completion thread. Absolutely awful, but arguably better than the alternative (exchanging the day before and then it didn't happen).

I remember having a client - a wonderful client - with small twins and a husband in the States. The chain of 4 ended up at a simul ex/comp and despite my pleadings with her to let me push for the usual exc then comp one week or so later, she insisted she trusted everyone in the chain. She was on the way to the new house when we got news her buyer simply changed their mind.

I was so upset for her but she took it like a champ. She was intelligent and had read my warnings, so what could she do?

We bought something else for her a year later - a perfect house. It really does all work out in the end and if it isn't working out, then it's not the end.

That was extremely rare, btw. In fact in my time (and I've been plugging away at this feckless profession for many years now and own my own firm) it's only happened like that once.

I've also only ever had a late completion a handful of times and never had a non-complete.

@Jujuball are you my solicitor and her assistant? Grin They have been on the ball and very prompt in my queries. All emails are responded to almost on the day but normally within hours.

@kerrymucklowe2020 I work for a public body and we do have certain rights of way to access private property to inspect or complete work to the assets that we look after. Usually the deeds mention 'with only tools' so we can't just to try enforce the rights with vehicles and other machines. That is normally negotiated with the land owner. We don't normally exercise this right as nothing goes wrong on those assets in those locations but I recently have started to ask 'questions' from our company legal teams about access some properties where the 'Right of way' hasn't been used before as I might need to in the near future to manage a certain risk that comes with the way the assets were built. Sorry this is such a digression and potentially quite outing but alas, the picture you attached doesn't look like one of our assets goes underneath.

Our house is starting to look a mess and no amount of cleaning is making it any neater. There is box or two in each room as we have started to pack. No box in DD's room as I can imagine her using it to climb on to it to reach the window or other more dangerous things. I aim to pack a box or two every day now as I don't like the mad rush at the end.

We don't have much to update apart from just waiting for the survey on 1st Sept. I reckon this when our vendors will send the draft contract and TRI form for us to complete.

Ooh hello @MinecraftMother!  Don't the stories on here make you annoyed at the numpties out there giving us a bad rep?! I agree I've only ever had things fall through on a simultaneous exchange and completion a couple of times. I've had to serve notice to complete a couple of times but completion did then happen in the timeframe allowed after that rather than completely collapsing, thankfully.

I actually started lurking because I'm hoping to move myself (house on the market but no offers), so I'm hoping I have some luck sometime soon!

No updates from me except that I'm still trying to book in a survey after finally deciding on who to choose to undertake it.

Mainly wanted to say to @Jujuball and @MinecraftMother how informative your posts have been so thank you for posting!

I also think our vendors are waiting for the survey before they sent the TR1 form etc. Except that we have already sent that to our buyers and they've not instructed a surveyor yet. I hope that wasn't a mistake on our part.

I have to say our solicitor is wonderful! She is so quick to respond. I genuinely think she will have us ready as soon as she can. It'll be the others that hold us up!

Although I dreamt our buyers reduced their offer by 20k!! Aghhh

One question for the solicitors! Our vendors are divorcing so have only just sent their paperwork to their solicitor.
As a result our solicitor hasn't heard from theirs yet so hasn't ordered our searches. Is this right?
How long do searches take?

Weirdly when I look up our neighbouring council there's came up (10 working days). So mine must just not say, not sure if that's good or bad! I've asked our solicitor
