Thought I'd start a new thread as previous one had hit 1000 posts and wouldn't let me reply!

@LookingOptimistic why do solicitors have to be so difficult at times? Hope it gets resolved for you soon.

The indemnity policy came through this afternoon, so we're hoping we might be exchanging sometime next week...unless something else crops up!

Can I ask... how do you know when you're nearing the exchange stage? FTB and I just don't know how long things should take!

If it helps, our enquiries seem to be going ok. First lot came back and solicitors only had to back to sellers with a few more questions, nothing much at all.

@SandyBayley sorry to hear your news. I also believe things happen for a reason. Our first offer to the house we originally liked fell through looking back now I’m pleased it did as we found a better house but obviously at the time I was annoyed. Fingers crossed for you.

The contracts are with our buyers solicitors and contracts with sellers solicitors so now it’s time for the solicitors to do what we are all paying them for and get everything ready for signing!

@ErickBroch - just ask your solicitor and EA! Seriously - you are paying them for this and they need to work for you. If all enquiries have been answered, mortgage offers in, searches back and contracts signed then things are getting near. If completion dates are being discussed then things look positive.

@Jem01 - thanks for your good wishes. You are right of course. What will be will be...

So we're back in the game! Listing changed to reflect new price and four viewings booked for Saturday. One is actually a second viewing who looked at the house just before it went under offer.

Cleaning and tidying to do but children have been really lovely have had a plan to help clean tomorrow and are cooking me supper. I am blessed with a wonderful family and a DH who loves me so I can't feel too sorry for myself.

I miscalculated how long this process has taken. But from offer to exchange on my house sale is 12 weeks on my purchase its 7 weeks! And completion is next week! 13 weeks isn't too bad but its felt ages (sorry to everyone who has had much longer @Tokyo I mean you for one!)

1 week in since offers made and received (that was day 1 of being on the market)

We have a cash buyer who isn't having a survey on ours.

Our vendor is moving in with parents.

We have had the valuation done, filled in our fixtures and fitting forms and paid for searches.

Now just a sitting and waiting game. All 3 of us want to proceed speedily for various personal reason. My last buy/sale process took 19 months which was hellosh but touch wood things seem to be going smoothly here so far (I'm not naive and I know how badly things can go wrong!)

Welcome @desmondo2016 sounds like you're in a good chain which on paper should move quickly. But as lots on here will tell you it sometimes isn't that simple!

Fingers crossed it all goes smoothly for you.

We signed contracts yesterday, and are exchange and completing on the same day next Friday....Shock

A BUYER’S GUIDE TO CONVEYANCING

You will have found the property you want to buy and the seller has accepted your offer.

A Purchase is what we call “Back loaded” because we cannot start work until we receive contracts from your sellers so even if you have made an offer and are keen to move matters along, we cannot proceed to stage 1 until the sellers have completed all their forms, instructed their solicitors and their solicitors have issued us with a contract pack, this normally takes a good couple of weeks or more.

Quite often clients will call and ask why their agents are telling them that the sellers have already signed up at the beginning and are worried because they have not, it is because the sale is “front loaded” do not worry if agents start to pressure you because your seller is “all signed up” this is normal and as a matter is “buyer driven” it will go at your speed not the sellers. You will sign at start of stage 2 (see below) the Seller at the start of stage 1

First Time Buyer Schemes

It is extremely important you let us know if you are a First Time Buyer and will be benefitting from any Help to Buy Schemes such as Stamp Duty Relief or Isa Bonus’ as this changes some of the documentation we need to prepare

Gifts

It is extremely important you let us and your lender know if you are a to obtain any help towards your purchase by a 3rd party and will be benefitting from any Gift as this changes some of the documentation we need to prepare

Valuation

It is your responsibility to discover whether the property has any physical defects. Your mortgage lender will often do what is known as a “mortgage valuation”, please remember that this is only a basic survey carried out for their information only.

It is often prudent to consider a more comprehensive “home buyers report and valuation” or even a full “structural survey”. Please remember buying a house may be the biggest investment you ever make.

Please be aware that we rarely see a copy of the valuation so if there is anything you believe we need to see please send us your copy

PRE-EXCHANGE
Stage 1

Once we receive Contract documentation from your Seller’s Solicitors, the first thing we will deal with is the submission of the various searches and preliminary enquiries.

The average transaction takes 6-8 weeks from this point (not the point of offer)

You will know when we have reached this point as we will send you a copy of the Title along with the Property Forms and any other important information we have received in the contract pack.

Firstly we order your searches:

Local Search - this consists of a large number of questions which are addressed to the Local Council, and we will summarise the information obtained from this and advise you of anything that may be onerous or unacceptable.

Drainage and Water Search – submitted to the Local Water Authority, this search is to make sure that the drains are maintained by the relevant authorities and will also reveal whether any public drains or sewers run under your land, again we will advise you of the result of this search.

Environmental Search – this reveals whether the property is affected by flooding, subsidence, radon, contamination or pollution. We are unable to comment on the result of this search, other than whether it has passed or failed. The search will be sent to you in its entirety for you to read through.

Additional searches may be carried out depending on the location of the property, ie. Coal Mining Searches, Brine Searches, etc.

We then check the Title, Contract Pack and raise any legal enquiries:

We, as your Solicitors also ensure at this stage that the Seller has right and title to sell the property to you. We do this by checking the Contract and the title to the property.

Then we check and confirm your mortgage offer

It is also our responsibility and duty to ensure that you have the money available to purchase the property and will liaise with your mortgage lender, if you have one. If not we will ask you to produce evidence you have the funds required.

Using the information we have gathered as above:

The Transfer Deed is now prepared by us, this is the document which transfers the ownership of the property to you.

We also prepare your SDLT (Stamp Duty Return) please note unless you are buying for less than £40,000 we must provide a return even If nil is payable.

Stage 2 SIGNING

Once all these elements have come together you will be invited to call at our offices to go through the necessary documentation. You will, at this stage, sign the Contract, the Transfer Deed, the Stamp Duty Land Tax Form (SDLT) and the Mortgage Deed, if you are taking out a mortgage. If you prefer, the documentation can be sent to you for signature We will also require confirmation of your building insurance arrangements at this stage.

We will now take your instructions regarding a completion date, in readiness for what is known as exchange.

Stage 3 EXCHANGING CONTRACTS

Exchange of Contracts is the point in time when you become legally bound to buy the property on the date stipulated in the Contract, ie. the completion date. Agents often tell clients to speak to us to fix a date for exchange, this date cannot be fixed, only a completion date (moving day) is fixed.

BETWEEN EXCHANGE OF CONTRACTS AND COMPLETION

We will now raise further enquiries, known as Requisition on Title. As we approach the date for completion the financial details are worked out and a completion statement is sent to you for your approval.

COMPLETION/MOVING DAY

If you are buying and selling you must move in and out on the same day. Often clients will tell us they have arranged for moving later than the agreed completion date, please be aware: if anyone in the chain has a mortgage this course of action breaches their Mortgage and it could be revoked! Therefore, if you are intending to make private arrangements or are approached to do so we must strenuously suggest you do not agree to this.

We do understand that this puts pressure on parties to be in and out of their houses, but that is we are afraid the English and Welsh legal system!

Completion is the day when you pay for the property, receive the keys and are entitled to move in. We do not usually get involved in the process of handing over keys as this is normally dealt with by the Estate Agents.

Please note that if there is a chain of transactions, the keys to the property you are buying may not be available until late in the day.

This is no fault or responsibility of us your Solicitors as often the transfer of money is held up in the banking system.

POST COMPLETION

After completion, we will send the SDLT form to the Inland Revenue together with the payment of Stamp Duty if this is payable. Please do not confuse Stamp Duty, Land Registration fees or VAT as being our professional charges!

We will then register your title at H M Land Registry and pay the appropriate Land Registration fee. Upon completion of registration formalities, the Land Registry will supply us with an updated Title Information Document (TID) showing you as the proprietor of the property and a copy of this will be sent to you. Any Deeds required by your mortgage lender will be forwarded to them. If you do not have a mortgage, the whole of your title deeds can either be sent to you, or held by us in our strong room. This service is free of charge.

Had a long chat with our solicitor this morning, things are moving in the right direction. There's a big question mark over whether the sewers will be adopted or not so that's worrying unless it's normal for new build estates?

House is finished and being handed over, home demo should be next week and we should be able to move in on the 8th! We're going to have to exchange and complete on the same day which sounds stressful. Better do some more packing!

We are exchanging and completing on same day next Friday and I am also biting my nails and worried about it, but my solicitor seems very relaxed about it all!

I'm starting to pack as well....this is going to be a busy weekend Shock

Yeah our sol seemed to be quite blasé about the exchange and completion I suppose they're used to it.

It is going to be another cliff hanger weekend for us. SadSadSad

The house we are buying have a garage that has defective lease demise terms (the house itself is ok). My lender asked for further information, which we sent, but have heard nothing.

A Deed of Variation to sort out the defect will cost about £400, but the sellers are adamant that they are not paying it Angry . Part of me just want to walk away, because it is really sellers' responsibility. If they are willing to let the deal fall apart like this, then maybe I should just pull out.

I agree with you @tenapenny2018 if they want the sale to proceed and it's an issue with their property title they should pay. I know we had no hesitation paying for our indemnity policy as it was going to hold up the sale.

Is it a dream house or do you think there are similar that you'd like nearby?

I agree, it was a handy post. But my solicitor has told me she has requested our searches (or whatever the terminology is!) as soon as we paid her 300 pounds for them 4 days ago. We haven't got the vendor draft contracts yet so is she lying to me or can it happen out of order?

So after the last two house sales being super stressful I decided I wasn't going to panic on this one. We are buying our hopefully forever family home. This is our third house we've bought in four years and I refuse to move again now we have a child.

I was well prepared this time for our house sale to take a long time and told myself to not stress. We went on the market a few weeks ago, the day it went online we had 3 viewings booked in. A viewer came the day after it came online, and offered right away. 15k under asking!!! Straight no, so they then offer 5k under asking and we said no and then asking price. We needed minimum asking price to get our money back for the new drive we paid last year and to cover moving costs. So we sold in a day! We offered on the bungalow we wanted that needs complete renovation and that has been accepted after negotiating.

She has now found somewhere which we were told was no chain to find out yesterday that it actually is a chain!! So we have to see if they find something, but have been told if all progresses well they will break the chain and rent (I hope!!)

Never been in this situation before, chain has always been complete an very sceptical or what is going to happen and think were going to be waiting a very long time!!

@tennapenny2018 I am sure if you stick it out, their solicitor will tell them they need to pay really as they will have the same issue with the next buyer.

When we sold ours last year we had to pay multiple indemnities for the people buying ours, it does sting because the people we bought from didn't pay half as much as we did! But it had to be done if we wanted to move! And the people we bought from had to pay some indemnities too for us!

we're currently 6 weeks on from accepting an offer for our empty house (for various reasons we moved out last year, and are currently in rented) from a FTB with a mortgage agreed in principle. All our paperwork is in order, solicitor thought we might be able to exchange and complete last week, except........

the buyer solicitor is getting very agitated about the shared driveway - there's a covenant regarding a pathway from the road to between the house and next door, and 2 questions on their list of 7 to our solicitor have been about this path which has been a tarmac-ed driveway for nearly 20 years, with no issues, quibbles or disagreements with the (lovely) neighbours. I understand their solicitor needs something in writing, but are getting grumpy because we don't have the bill for the tarmac-ing (done in approx 2002 FFS) and can't remember the exact amount we paid.

They also keep asking for land registry documents which don't exist, and the final thing which made the estate agent roll their eyes, was that the buyer had builders, electricians and plumbers round in the week, presumably to give quotes for the work we all know needs doing, but won't answer the phone to the estate agent, to let us all know what the position is. I'm worried they're going to try and drop the price post building quotes, even though we priced the house to take that into account in the first place, AND we went below our "minimum acceptable price", as they were the only proceedable offer.

GRRRRRRRR. That feels a bit better having had a mini rant. You wouldn't think that a no-chain sale with a FTB and and empty property could be so stressful. I cant imagine still living there, and not having a moving date or be half packed, half not!

It is not a "dream house". Just a bog standard terraced house. Almost distinctively average (in a good way). The price is reasonable. We are not "dream house" people. We are not picky. Just need a decent house.

The "not mutually destructive" way is probably the seller and us split the £400 cost to do a Variation of Deed. But I have seen so many people would cut off their nose to spite the face. if the seller refuse. I am really in a dilemma whether to pay it put of my own pocket or not. The house is otherwise OK. It is just this one last thing outstanding.

Ugh, back to looking in earnest after our purchase fell through. It was quiet before but now massively busy - loads of FTB out viewing which definitely wasn’t the case a few months ago.
Don’t know if people are hoping for a bargain with Brexit uncertainty but it was properly mental today. Good for those of you selling but not so good for trying to get on the ladder and not being outbid!!
