Sounds like you'll be OK then - ours was an issue dating from the 1980s. I am so glad we were able to move, it was getting really unpleasant - neighbours falling out with each other and threats of court cases etc. It is still rumbling on, the issues haven't been resolved and I can see the unadopted roads needing resurfacing in the next 5 years and everything coming to a head again.

Outto I would keep an eye on that - we thought (as did our solicitor for the purchase) that the council had adopted the communal grounds as they maintained them (even adding a new flight of steps when the old ones were crumbling) and it was just the estate roads that weren't adopted. It was only when there was a problem and insurance companies got involved that we found that the builders said they had sent the paperwork to the council and the council said they hadn't received anything, just a one off sum to maintain the grass / shrubs / trees. Check what your deeds say about what happens if the council doesn't adopt the grounds, especially if you don't have management fees / factoring fees etc to cover maintenance of communal areas.

out I know. That's exactly what we thought too. We were perplexed as to why they'd think there would be a more recent letter.

randomly that sounds really familiar! There's an estate near us just like that but they date back to the 90's! Selling it must have been completely stressful.

Just had an email from our buyers solicitor to our solicitor. They (buyers solicitor) made another mistake! Grin will we ever move?

Randomly - it's different though, because we KNOW it's not been adopted, but our deeds definitely do not say anything about paying for maintenance. Anyway, I'm moving, it's for the ex (who is buying me out of the house) to worry about and as he can't even be arsed to buy home insurance I can't imagine it's something he would ever think about!

I have, at last, got the Memorandum of Sale (which seems to be trying to sell me home moving services in the form of a utilities and telephone service 'check'!), sol is getting going on searches - I changed property so just waiting for the broker to come back to me with it transferred to the new house....then we're good to get moving properly!

I very reluctantly need to join this awesome support group. We have a very short chain, bottom folks are living with parents as had already sold at beginning of year, then there's our buyers and we're buying off a couple who are moving into friends place whilst they hunt for land to build. It's grindingley slow due to the incompetence of the solicitors we're buying from, it's all waiting on details of a solar panel contract that they've taken 3 weeks to supply. Our buyers have been pushing for a compensation date since early April and have just rung our EA today to say if it doesn't hurry up they'll pull out.

Frantically tying to get answers and looking at options to break the chain as we don't want to lose our sale. Toying with holiday let or if it's only a few weeks going on holiday, though not sure what to do with elderly cat who can't go into a cattery if it comes to that.

The whole thing has been the most stressful and expensive move we've had, we've had to get £800 of roof clean / small repairs done and paid for countless Fensa certificates and indemnities for things done to our place before we owned it. Solicitors for the place we're buying are an online firm and are next to useless saying things like "the contract for solar panels is with X company get in touch with them for details" to our solicitor and losing documents left, right & centre.

Hopefully this is the last time we ever move until we're old and retired and don't have to juggle all the hassle with full time jobs! I've rearranged my on call weeks that many times for potential moving dates, my colleagues are going to stop speaking to me soon!

Out our deeds said it was anticipated that the council would adopt the communal land but in the event of that not happening the cost of maintenance would be borne equally by the proprietors. It was tucked away in the burden details. Since the council had been maintaining the grounds for 30 years nobody had any reason to think it hadn't been adopted.

Well my update is quick from my last post but not good news. The contract on the solar panels is in the words of my solicitors senior partner "a dogs breakfast" which no lender will lend on it, so unless they buy themselves out of it we're not buying the house! It explains why previous sale fell through late in the day, why they were offering a £1k insentive to to their solicitors (so they could brush it under the carpet) and why they've been evasive on the contract terms for three weeks!! So angry with them.

I've not hung around, got a friends flat lined up to let short term whilst she tries to sell it and a viewing lined up on a chain free property this weekend!!

Husband is chomping at the bit to pull the plug tomorrow but we need to give them chance to get back to us on whether they buy out the solar panel contract. Looking this eve it could cost them up to £75k so not a small cost Shock

Exchange still not happened Angry. EA chasing, our solicitors chasing, sellers solicitor chasing, sellers seller solicitor chasing. Everyone ready to go. Hoping contract is received by buyers solicitor tomorrow so exchange can happen tomorrow with completion on Friday.
Starting to feel they are being deliberately awkward

EA keeps chasing us because we're the only ones in our chain of eight who haven't had our mortgage confirmed, several weeks in. I wish there was something I could do to speed it up but I can't make HSBC work any faster!

Also found out today that the management company of our flat we're selling haven't even started to prepare the leasehold pack, a full month after I paid for it. Finding this all very frustrating and we've probably got a couple of months to go yet!

That solar panel thing sounds awful, Katkin - any update?

Our EA is being rather uncommunicative and I've had more sense out of the one we're buying through, which is kind of ironic considering I'm not even paying him! He found out more about where our sale was at on Monday than my own EA Hmm.

Our buyers contacted the EA yesterday to ask for nearly £8k off, due to the place needing a new roof. Fair enough to negotiate but they're only liable for half the cost (it's a flat) and were asking for the full amount! Also said valuation had come back lower than agreed price but turned out this wasn't the mortgage valuation, rather an additional one with the homebuyer's survey.

We've agreed a new asking price with a reduction of about a third of what they were asking for, with the condition that they pull their finger out and get the legal ball rolling. Now just got to cross fingers for our own survey later this week!

I had also hoped Camper that you would have exchanged by now - so sorry its just dragging on (still).

Bit of good news at this end - the ftbs' building survey is through and its fine (heaves huge sigh of relief). For reasons which would be too identifying to go into, that could have been a chain breaker.

So now I think we are just waiting for their searches to come back (due Mon) and then at least all the big jobs are done (although as Spickle quite rightly said, who knows how long the queries will take.

We didn't get the house we offered on (properties are going for 10-15% over asking price here - argh!) Have spotted a do-me-up with good potential, but it involves a bigger trek into school. A 15-20 min bus ride and we need to be in by 8.40. Would it make the mornings too stressful or should I go look if its right in other ways? What do y'all think?

Acat the EA we are buying through have been useless. Purple bricks so to be expected I guess. Our vendors EA has been the only person to keep me updated. My solicitor is equally useless and has done nothing. I wish I didn't have to pay her.

We have news today. I transferred our deposit into solicitors account. Jeez I came out in a hot sweat dealing with such a large amount of money. I checked the account number about a hundred times. I am so mad at our beyond useless solicitor. Once I had paid the deposit our vendors EA contacted me to tell me that my solicitor needed more ID for DH. Now I knew this as I asked solicitor two weeks ago what further ID she required and she hasn't got back to me. EA told me and I scan it over this morning. I don't get exactly what my solicitor is doing why on earth is my vendors EA doing her work. Anyway we should hopefully exchange on Friday Hmm

Ocelot The area we are moving to is a 15 minute bus journey for our older boys school. They will get the bus alone as I need to get my younger dc to school. We were priced out of the area we wanted (where we currently live) but got so much more for our money just a 10 minute drive away. I used to get a bus to school and many children do these days so I don't think it's an issue.

Thanks Beautician, it wasn't an issue for me as a kid. I was just wondering as school starts early (8.40) and DS is currently being investigated for ADHD. Mornings can be a little stressy anyway as he forgets what he is doing a lot and kind of drifts off.... Bit too young to see self to school yet (7) and I am sure there will come a day when I can trust him to do it. But right now, with the attention issues, I think he would just daydream and go right by his stop!

Well done on those that have made progress, wish we were at deposit paying stage Sad

Our vendors solicitor came back to ours with "Our clients advised that the property was sold with the benefit of solar panels and have asked your clients to confirm that they will pay for the removal of the same" uh no you stupid people - it's like selling us a car with a roof rack on that Halfords own and get to carry their deliveries on from time to time no thanks! So that's us pulling out. Angry they've incurred us about £1k in unecessary costs when they know it's stopped a previous sale, but also a little bit sorry for a couple now stuck with a house they can't downsize from as no mortgage provider will touch it!

Got some rentals lined up for viewings this weekend as our buyers are pushing us to fix a completion date so they don't lose their sale!

No news on our queries yet. Going to see the house again Friday as it's been so long and just to check bits and bobs out. Booked an electrician to go in next week and do a safety check.

Looks like we'll now get past next pay day before moving which is handy!

Sorry to hear the stress continues for most of you!!! Although happy to see there is some good news too. Just skim read as there were two pages since I was last online.

KAt that is ridiculous!

Well moving day went well and we are so so so happy here. I come everyday and think 'I cannot believe I live here!' The garden is beautiful and I have spent more time out there than inside as the weather is gorgeous right now.

However the stress continues!!! Our buyer isn't happy with a few minor things in the house and their solicitor has written to mine - not actually saying what they want done about it. It is minor things that do not affect the workings of anything and would have been plain to see on viewing, things that no one needs and would cost small amounts to put right if desired. Our solicitor is adamant that both legally and morally we are in the right to refuse to renegotiate on price, I was going to offer her some money just to make this stop as I hate bad feeling and want to be able to relax and enjoy the new house. However legal advice is to absolutely not as otherwise we will never hear the end of it anytime she isn't happy again in the future and it would be admitting fault which is absolutely not the case.

Surely it is expected that when you move into an older house there will be things not in new condition? Confused Also we accepted the offer a few k below asking and it was already priced to reflect the wear and tear in the house Hmm

So unfortunately the stress continues for us even though we are out the other end!

Crikey duke I didn't even realise that was a thing. I knew you could obviously complain if they leave stuff they weren't meant to or take stuff they said they would leave but that just sounds bonkers. Presumably they viewed the house and probably had a servey done?
Great news that you are enjoying your new house so much though Grin
