ocelot - if the FTBs have now paid for the searches to be done, there would be no point in you paying for private searches. The solicitor acting for the FTB would not accept your searches as they do not act for you unfortunately.

We are still completely stuck with probate and no sign of moving forward. Also there is a boundary issue. Our buyer is starting to get impatient understandably. Fed up Sad

Can I sack my solicitor? Why am I paying this incompetent fool. DH called up today and couldn't speak to her just a colleague. The colleague informed him that one piece of our information is missing, a bank statement with DHs name on as proof of ID. Complete over sight on my part. Why was this not mentioned weeks ago as I scanned those documents over in February Hmm

The solicitor finally sent me an email but didn't actually reply to anything I had asked her AngryAngryAngry

I don't know. It is really stressful. It feels as though, at any moment, the whole chain could collapse and it would all be for nothing.

We handed in a load of paperwork today to demonstrate that we aren't mastermind money-laundering criminals and we are now working towards a moving date of May 12th. So getting there, slowly.

Are you buying a deceased estate Missy? When did the executor apply for probate?

I know that you can legally put a house on the market when probate isn't in place but it seems awfully unfair on the buyer.

Ocelot It's just plain rude. It takes two minutes to make a call or send an email. I really want to tell my solicitor to fuck off. What exactly am I paying her for.

Is anyone selling a leasehold property? My solicitor requested the leasehold information pack from the managing agents on the 10th, and I paid for it the same day - directly to the agents. (£360 which seemed steep to me!) Neither I nor my solicitor have heard from them since. I suppose a fortnight isn't that long, but really, how long does it take to photocopy a couple of documents? I wonder how long is normal. Mind you, these agents have always been useless. I'm glad the property we're buying is freehold - I don't ever intend to buy leasehold again!

I'm lurking but not sure if I've posted before. We're in rented as our house sale went through incredibly fast at the end of last year. We've found somewhere to move to and had an offer accepted. BUT the vendors haven't found somewhere to go yet. They are downsizing and want to move to a particular location but nothing is coming on the market so we can't do anything. As we think there is a chance of them changing their minds about going we haven't applied for a mortgage or applied for searches as we don't want to incur loads of money that might be wasted.

Any ideas what to do? We are still looking but don't like the look of anything. Are we just stuck waiting for them to find somewhere? I'd like to suggest they go into rented but not sure how that will go down... they've got a full sized billiards table to get rid of. Ffs.

donkey86 sorry to say you are being a little impatient. Leasehold packs are more than a couple of pages to photocopy and do take time for the managing agents to collate all the information together before they send it to your solicitor. They have to provide detailed documents regarding service charges, ground rent, the Memorandum & Articles of Association, Health & Safety & Fire Risk Assessment, Asbestos Report, the last 3 years accounts, copies of the Share Certificate or membership details (if one was issued), the current Buildings Insurance details, any notices issued and details of any major works in the pipeline. £360 is a lot of money, but the managing agents set their own fees and this figure is by no means unusual!

We always ask the client to pay for the leasehold pack asap as this is regularly something which takes a long time to be received, and of course, once received, the whole document has to be photocopied and sent off to the buyer's solicitor, who will then spend a week or so, reading through the documents before making further enquiries based on the information supplied.

Thanks, that's really useful - I had no idea it was so much stuff. I got the impression from the solicitor that it was basically just the lease! I've already provided copies of the ground rent, service charges, building insurance and notices but I suppose they still need to ask for them from them too.

Also, hello Raa. Don't know what I would do either, but nice to welcome you to the board.

I feel a bit better today. No possibility of expediting those searches so may as well get used to the idea of twiddling my thumbs for 3 weeks. No point railing against it if it can't be fixed. Really crap for my buyer to miss their preschool deadline tho.

Thanks for the replies. Basically we were told the house is owned by three siblings and were only told a few weeks after our offer was accepted that one of them had died last year and probate wasn't complete. We were raging that we weren't warned sooner.

Anyway I found out this evening that it is sorted and we are good to exchange hopefully later this week!!! The boundary issue still exists, basically there is a very thick hedge at the bottom of the garden, it was planted at the very end of the garden and has now widened to such an extent that it partially covers council grassland (just a big patch of grass that borders a road). Our solicitor suggested waiting until a process is applied for to try and sort it but we have asked to push on - worst case scenario is we remove the hedge and fence it - we wouldn't lose any of the garden so we can live with that. Though the hedge has been there for at least 20 years so it seems unlikely the council will ask us to remove it anyway! I cannot remember the name of the process, positional improvement maybe? We can still apply for it ourselves. The house has sold three times with this problem and not been sorted so I really am not worried about it,

We just want to move!!!

Ocelot, I am sorry you are having such problems with the EA's, you wonder how they get away with it. If we were so incompetent in our jobs we would surely be sacked.

We've exchanged! Hurrah!
It was touch and go for a while around 3pm as the solicitor in the middle of the chain couldn't be raised, but at 4 pm my solicitor emailed to say we'd exchanged on our sale and purchase.
We complete on Friday, eek! So it's all systems go with packing.
I'll keep an eye on this thread to see how you are all doing, but I wish you all the best luck in the world. This has been the most stressful 2 weeks of my life! Hoping to sleep well tonight.
