If he's actually found not guilty he cannot be retried, that would be double jeopardy. You can't be tried twice for the same crime per the 5th amendment. If it's a hung jury and a mistrial is declared, he can be retried.

I think a big gaffe on the part of the prosecution was not bringing up Cohen's 'stealing' that money from the Trump Org. It would have 'looked better' if it was admitted to under direct testimony by the prosecution rather than the defense 'dragging it out of him' during cross.

My understanding is that the jury instructions will be very long and specific. There seems to be a possibility - though I can't remember which MSNBC video I saw it in - that Trump could go down even if the jurors don't all agree on which exact crime he was guilty of - as long as he is guilty of one thing according to all jurors. Something like that! But I am not a lawyer so might have got it wrong.

Now we know another reason Defence did not get Trump to testify - they wouldn't have been able to describe Cohen as the MVP of liars if Trump had taken the stand. Cos Trump is a bigger liar.

I honestly don't think Trump will be convicted. There will be at least one juror unconvinced

I agree. I can't see it being a (reverse) re-run of 12 Angry Men in the jury room. Probably more than one juror who will be voting not guilty today. But it only needs one.

So now we're on verdict watch. Tick tock tick tock. What's Trump going to do without his daily speech verbal diarrhoea on the courthouse steps?

I'm assuming that the jury will deliberate until around 5pm-ish EDT. it's 4.15 EDT now, so I'd be willing to bet there will be no verdict today.

As far as how long they'll go, my inexpert opinion is that a quick verdict can go either way. But a long deliberation will end up with a hung jury.

Per MSNBC, the jury has asked for the testimony from Pecker & Cohen to be read back. This will take place tomorrow.

Deliberations over for today, the jury has been dismissed. Not sure what time deliberations will resume tomorrow.

Hmm, more explanation on the charges and how the jury can decide, which I think I understand!

In Trump’s case, prosecutors have offered three types of crimes that would make the state election-meddling charge come into play: federal election law crimes, tax crimes or false business records.

The jury must be unanimous when it comes to determining whether Trump is guilty or not guilty of each specific falsifying business records count, and whether he did so in an effort to unlawfully impact an election, New York Supreme Court Justice Juan Merchan said. He added, however, that the panel did not have to be unanimous about which of those three types of crimes could serve as the underlying violation that brings the state election charge into play.

So the jury members have to be unanimous in deciding that he is guilty but they don't all have to be unanimous in which of the 3 crimes it is... or have I got completely the wrong end of the stick? 😫

Basically he can't duck out till the verdict now as he may be needed to either answer some more questions or be present if the judge interacts with prosecution or defence.

I have been given to understand that he has to be in court the entire time that the jury are deliberating. It must be stultifying boredom mixed with apprehension.

Re sitting in the courtroom, I believe that a defendant must be in the courtroom whenever proceedings are taking place. But once the jury is in the jury room and there is nothing 'going on', they can be 'elsewhere' but must be within 'calling distance' in case of a verdict or further proceedings.

I seem to remember Trump being granted permission to be 'across the hall' so I assume they have some private, secure place for him to wait.
