Universal credit managed migration thread

Anyone else waiting for a migration notice this year?
Looks like they are planning to move people on tax credits only onto universal credit this year but haven't released any detailed timetables about areas.
Thought it might be useful to share experiences and information on here for those affected.

Oh sorry. Yes he gets DLA. hrc

catrescuelady · 16/10/2023 14:04

Starting to think it's not worth all the chew on for an extra years money. I know I won't be entitled to UC after the migration year. They want to know so much. I feel intimated. Told them about money in bank etc. they want proof. As it's migration I understood you were guaranteed no loss of money for a year, or have I misunderstood this.

Snickerdoodles19 · 16/10/2023 14:13

I’m the same, just had the notice through today, got until 13th January to apply but I don’t think I’m going to as I’ll only be entitled for the year, plus both myself and husband get 4 weekly pay so I know that messes a lot of things up

Snickerdoodles19 · 16/10/2023 14:20

My last payment for TC would be 18th January but I’d have to apply by the 13th January, what happens if I don’t apply for UC? Will TC just end on that date and then TC will do an in year finalisation or will they wait until April as it’s end of the tax year?

Bromptotoo · 16/10/2023 14:45

The migration letter is generated because Tax Credits are ending. You're invited to apply for UC to replace it but are not obliged to do so.

If you do nothing TCs end. The letter should make clear when that will be.

Bromptotoo · 16/10/2023 14:53

@catrescuelady AIUI showing one is gainfully self employed is necessary as, if you're not, a claimant might be subject to a requirement to seek/take other work. It might also affect whether the Minimum Income Floor is applied - in your circs it should not.

As a Carer you're not subject to any work search etc requirement In that case there's no need to show your SE is 'gainful'.

You can of course work if you want to. Earnings will need to be reported and will reduce UC in the usual way after any Work Allowance etc if applicable.

I'd suggest attending the interview with your paperwork but make clear that you're a Carer for 35+hours for somebody on PIP/DLA.

If you have any problem come back for further help.

Snickerdoodles19 · 16/10/2023 16:53

Yes I understand it will end if I do not apply, I just wanted to know whether the TC would be finalised when the payments stop or would they wait until April 24 to finalise as they would normally do with a renewal?

I would expect TC to end with the 18/01/24 payment. As I understand it that's why 18 Jan is mentioned.

Snickerdoodles19 · 16/10/2023 17:10

Thanks for replying, I just wanted to know if TC would on the 13th when the deadline on the letter is but a payment would have been due on the 18th, I don’t want to incur any overpayment that’s all if I’m not entitled to the payment on the 18th.

Chasingsquirrels · 16/10/2023 18:02

My understanding was that;

  • if you complete a migration application then your final year TCs will be calculated on your actual income for the relevant period only (so 6 Apr - UC application date).
  • if you don't complete the migration application then your TCs end on the relevant dates but the final year TCs will consider your income for the entire year (pro-rata) against the TC entitlement for the relevant period.

This may make a difference if you make lump sum pensions contributions or receive irregular income.

But I can't find the information on that now.

Snickerdoodles19 · 16/10/2023 18:23

I don’t make lump some payments for pensions apart from normal work pensions, no irregular income, wages are generally the same every month give or take a few pounds.

Snickerdoodles19 · 16/10/2023 18:25

So the relevant period would be 6th April- 13th January which is the deadline on the letter

Do you think I should put a note on my journal asking if this is necessary with being a carer? Although maybe rules are different for migration. Someone on another group mentioned these appointments are computer generated so they won't see I am a carer until they open the file on the day of my appointment.

@benefitstaxcredithelp Would it be better for your family if you registered as the carer; and your DH relied on his disability status to not have onerous work conditions placed upon him, as it sounds like he could be eligible to claim LCWRA?

(Sorry if I've got that completely arse about face. I'm familiar with PIP, but UC fries my brain.)

Hello @AutumnCrow thank you for replying.
I had wondered that about transferring to me as my child’s carer. It does make sense. Do you know if this is easy to do?
Please what is LCWRA?
I appreciate your help and advice.

Bromptotoo · 16/10/2023 20:27

@catrescuelady Yes, a message to make it clear you're a carer would be good.

Just to clarify a couple of things, @benefitstaxcredithelp - what disability benefit is your DH on, and at what level(s) and for how long? And which country of the UK are you in - is it ok to assume England ... or not?

benefitstaxcredithelp · 17/10/2023 00:00

@AutumnCrow yes England.
He’s on higher rate DLA for mobility and has been for a long time, 20+ years.

I only really know about PIP, tbh. I had heard that there are still adults on DLA but I'm not familiar with the rules/descriptors or longevity of the awards.

Does he find it harder being a carer of the DC since they all got older? That's something to think about: perhaps, for example, he can't do it any more as he has been doing; he asks to be placed in the Low Capability for Work and Work-Related Activity Group; you become the main carer and claim the Carer's Allowance. The CAB might be able to help you with this.

benefitstaxcredithelp · 17/10/2023 08:09

@AutumnCrow yes he’s still on it and has had no contact at all about moving to PIP.
The circumstances of our caring haven’t changed to be honest. The only reason he applied rather than me originally was because I was working back then and he was at home with the disabled child who was then a toddler.
Thank you so much for your help, I really appreciate it and will start making enquiries about making me main carer x

benefitstaxcredithelp · 17/10/2023 08:19

To clarify, we’ve both always been our child’s carers but as he was at home during working hours and I was out at work it seemed to be natural that he would be the main carer ‘officially’.
As we are now both at home, we care equally for the disabled child.

They said this doesn't affect my app and they will explain when I am there.

Nochoiceleft · 17/10/2023 12:30

@catrescuelady the appointment is called a gateway interview and it is a payment blocker so has to go ahead. It should be nice and straightforward in your case. They should very quickly agree that you are not gainfully self employed and therefore the MIF does not apply. They will spend some time explaining how to report your earnings and what expenses you can report. It should all be fairly painless.

Thank you. It's just getting all the paperwork together what they need now. 😵‍💫

Sorry me again. I am being asked for loads of info for my self employment. Do I need to take everything they ask for, like all 13 things on the list or do I just need to take a few things for evidence. I am so confused about all this. Tax credits were a breeze.

Hi all. Quick update on my migration journey if it helps anyone.
Finally, after just over 5 weeks of responding to the migration notice, losing 5 weeks of CTC (!), and two summons to the job centre...I finally received my first UC payment today!
Despite having a large amount of savings I'm allowed the transition year, but a big old chunk is deducted from the UC payment (fair enough I suppose). And as a carer claiming Carers Allowance I don't have to look for work (but this also gets deducted from my payment). My small amount I earm from self employment just has to be noted each month. I'm basically getting a few quid more than CTC.
It's only for a year, but i'm glad I talked myself out of NOT applying.
Tbh, everyone i've dealt with has been very nice, just brace yourself for the stupid length of time it takes.
Good luck everyone x

How long was your appointment for self employment?
