Hi. New to the forum and PIP and am hoping some of the forum members can help me understand the claim process a little better, I applied for PIP in early December 2022. DWP told me that Capita had received my forms on December 9th. But i have not had a phone assessment scheduled yet. So i called Capita just to make sure everything was fine with my claim. They told me this morning that my claim "is in initial review" and that they "are requesting info from my medical contacts so they can do a Paper assessment". Is this a good/bad sign that my claim will be successful?

@Babyroobs don't go with her, if there's no merit. As a rep the tribunal will be looking at you wondering why on earth she is there because you as a rep are in there with her. It'll be on you. This could be serious with the existing award. Unless you know what the tribunal are up to with how they word things - you won't pick up that the existing award is at risk. As a rep there there are lots of things you can say to protect the existing award. Not all tribunals will heed this though. Im afraid it absolutely needs an experienced rep (who reps at tribunals) to look over and to attend with her IF there's merit. You can't wing it. It won't be the appellant that gets a bashing off the panel - it'll be you. But she'll still lose and potentially lose the existing award. If there isn't an existing experienced rep that can look this over and attend - you need to withdraw representation and let her go alone.

Why? The panel 'may' take pity on her and explore scope for gaining points if there is any( it'll be fairly obvious from the papers) and leave the existing award. They may just ask questions to rule out more, and leave the existing award. It is a gamble. Not all panel members are that client focused. Some are vile, we know a fair decision won't happen. Others (most) are brilliant.

If we have a case with no merit, we would withdraw representation (if the appellant wishes to proceed). Generally as explained above they are more likely to win - with us no chance. But we are talking cases where there is at least something there.

Also. If there is merit and she proceeds. But doesn't get the fair decision, or loses existing points. We'd (with her consent) be requesting the Record of Proceedings and Statement of Reasons. Once received we'd then be drawing up and submitting a Permission to Appeal - providing we've identified errors of law. So hopefully it can then go back to first tier for a fresh appeal. Unless as a service you have that level of expertise - don't touch it. Refer it somewhere where there is that expertise or withdraw rep. You don't wanna be losing her the award.

I just phoned them and they said they haven't got my report yet - the assessment was on 23rd Feb. Seems odd when some of you seem to have them submitted so quickly. Will just have to wait.

That just means the assessor is on top of their paperwork, it's sent over electronically.

They will have it. Are they confusing it with your award notice?

i wouldn't worry about it i had txt same day to say they have received my report doesn't mean its bad news and it can still take 6 weeks for a decision i was told but mine was a review assessment not new claim.

She said that they have up to 4 weeks to submit the reports. I guess different people have different systems - my person must wait until she has loads to submit all at once.

@mrsfeatherbottom so have you not had a txt message from dwp to say they have received your report from assessors? i do think its just a thing some are getting sent to dwp quite quickly and others days or weeks 😕 🤔 but i don't think it means decisions would be made quiker the earlier they get reports.

I did go with her. the person from CAB that did the submission was not able to go with her. She needed support so I went with her. I wasn't trying to wing anything. I didn't get any bashing off the panel.

New claim. The woman did say that I would get a text when they got it and to ring back them and they would send out a copy.

@mrsfeatherbottom ah okay mine was a review so maybe thats why mine was sent to dwp same day or maybe im wrong , i will have to keep ringing dwp for my report as they refused to send it out to me yesterday saying i can't have it until i get my decision 🙄

@Shebaduke mine was a phone call was yours a new claim or review assessment ? mine was a review and i haven't hered anything since i got that txt same day as assessment, as i put in the other posts i did ring DWP Thursday to get a copy of the assessors report they refused me it not sure why, they just seid i have to wait untill i get my new award decision letter 🙄

Mine is review.

Had telephone review call on Tuesday 21st February.
Received a text from DWP on Wednesday 22nd Februrary saying they had received the report from the health professional but it may take up to 6 weeks for them to make a decision.

2 weeks and 3 days later and I am still waiting for the outcome🙄

From hearing from friends and some family who received a decision quick has been bad news for them say hearing after 2 weeks or so getting a decision, so im actually hoping i don't hear to soon 😅 but i also do no of a couple of ppl who have received a decision quick and been possative news

Does any one know how long reviews are taking atm? DP's forms were sent and received last February and over a year later he just keeps getting 'we have your forms' texts. It seems a long time.

If his rate changes will it be backdated to the date that the forms were received or the date they finally get round to looking at it?

Hi - it'll be backdated to when they received the forms. Hope you get news soon. Mine took nearly a year, too - but the back pay was nice when it finally arrived.

Don't worry about that. Some assessors are quicker than others at getting their paperwork out.

And remember, it isn't the person who assessed you who makes the decision. It can take several weeks for the decision maker to write to you with their award (or not).

Hi i had my video assesment last wednesdsy txt on thursdsy to say dwp had recieved the report and it would be 6 weeks before i hear i was asked if i was on sociol media and do i work im sure being able to work 2 days a week has gone against me has anyone else had a similar experience
