Hi. New to the forum and PIP and am hoping some of the forum members can help me understand the claim process a little better, I applied for PIP in early December 2022. DWP told me that Capita had received my forms on December 9th. But i have not had a phone assessment scheduled yet. So i called Capita just to make sure everything was fine with my claim. They told me this morning that my claim "is in initial review" and that they "are requesting info from my medical contacts so they can do a Paper assessment". Is this a good/bad sign that my claim will be successful?

Hi. I got my report this morning. I got 13 points in the Daily living component and 10 points for the Mobility part. The assessor did say in the report though that i "did not engage well or build rapport" and made a few comments about my speech during the call (quite slow, flat, etc.).

Ah that's brilliant OP, you read so many stories of people who have to drag it to tribunal over the course of many months, if not years just to get what they are entitled to

Has anyone had experience of the DWP making them an offer a week before tribunal. ? Is it best to accept ? This is not for me but someone I am helping. I think the offer is reasonable but she is adamant she should get more. Ex colleague who is experienced in tribunals says the panel won't take well to the client turning the offer down. Just wondered if anyone has any experience of this.

It's called a lapsed decision. It is fairly common. Usually (but not always) happens if there was a previous award/s and the and lost at review, where there was no evidence to justify it. Also common where appellant has proceeded to appeal and a written submission (sometimes with further evidence) has been submitted to HMCTS and they've actually circulated it to all parties. DWP will then realise they got it wrong and offer to lapse.

I always warn clients this may happen. I advise them to Take details of the offer and then get advice from us (their rep). It isn't just what is being offered, but the length of award that is also important. Sometimes the offer is fine, other times not.

It'll need an experienced rep who understands PIP caselaw and legislation, and has sight of the appeal papers to look it over and advise her accordingly. It isn't hard to talk someone out of appealing once they understand they just won't win and risk coming out worse off.

The tribunal will not think any less of an appellant not accepting a lapsed decision anymore than they would if they accept the lapsed award and still proceed to appeal. Both circumstances can result in proceeding to appeal. So that isn't true at all!! It is no different to someone being awarded and going to appeal about one component or even one descriptor!! What is important is the merit of what is being appealed. Obviously the appellant risks losing the lot at appeal - this must be explained, she needs to know the risks to the existing award (in her case the lapsed award which she is accepting). Although the tribunal should give a warning of this (there is caselaw on this), so a temporary adjournment can be requested where the client is advised to withdraw (this doesn't risk the existing award). If this doesn't happen, the first tier decision should be challenged and it's an automatic set aside. She needs an experienced rep in there with her (and to look over the appeal papers).

It sounds like she needs an experienced rep/ service with lots of appeals representation experience to look at it.

Yes you can call and ask for a copy of the report. It is a rough guide as the decision maker it the one who considers the report and the evidence when awarding points.

I would ask for the report now because if you need to appeal you can use the report and what’s in it .

i think you only get 4 weeks to put in a MR so by the time you get your answer on the award and get the report you have already lost around a week

I did call them up yesterday and ask for the report. I suffer from severe depression ptsd and anxiety.. 2 of my daughters died 2021 and then 2022 and I’m mentally in a bad place … I jus hope they can understand my situation :(

I did, i got some backpay from them at the end of last week but i haven't received a letter yet to confirm how long the award will be for. Good luck with your claim, keep us updated.

I had my assessment on 23rd Feb and haven't had the notification yet to say they have received the report. Hopefully it is soon. I think the call went well but no idea about the points so a peek at the report would be good.

Call them and ask for a copy, you don't always get text alerts but they will defo have it by now

Hi all new to this thread, im currently on standard pip for care and mobility, i have been since the switch from dla in 2018 , an6way my old health conditions are alot worse since 2018 and i have a bunch of new health problems since then also but due to covid over the past couple of tears alot of my symptoms got ignored by gps and waiting lists for testing even longer to find out what wrong with me , i had my review assessment this Tuesday and i had pages and pages of things written down to tell the assessor including a list of all the tests iv been referred for and still waiting for but the assessor was rushing me and whenever i tried telling her everything what i had in front of me she just kept saying "we will get to that later , witch we never did i personally don't think it went well becouse i dont have all medical back up for new problems now as im still waiting to be seen by professionals and tests MRIz ect. and what i found strange is it was a hour and half call and i only hered her typing TWICE ?? has anyone else had this problem or recently just had there review assessment? thank you.

I also just got of the phone with pip to ask for my report as its been 48 hours since assesement and they seid i cannot have my report sent out untill i have my new award letter?? how is it everyone else can get there report before decision has been made?

That's not true. I have heard of them telling people this before it's usually come from confusion. Did you ensure they knew you were asking for the assessors report?

I had mine on 22nd and got a message exactly 7 days later saying they received my report .. I am currently awaiting my report to come in the post … fingers crossed for u hun …

That’s a lie coz I haven’t got my award letter and they are sending my report out to me. Call back chick .. and say I know so many friends who have got there report

hi yes they definitely new i was talking about the assessment report , i was so confused when she seid i couldn't have the report because when i had the assessment Tuesday i got a txt 3 hours later from DWP to say they have received my report from health assessor i will probably ring back tomorrow 😒

Thanks for taking the time for the detailed reply. It wasn't a review, it was a first time claim. She has now turned down the offer so tribunal is coming up soon. Knowing this lady and her health issues well I would have advised her to accept the offer but I am not experienced at tribunal representation, just going by what I know of the PIP scoring system. I guess we will just have to see and hope it goes in her favour.
