Can't get through on the phone to Barclays this morning - not without waiting half an hour anyway - so I'm composing an email to the person who sent me the offer. The email will be fairly personal, not one of the templates, to see if I can appeal to their better nature (BIG FAT HA!) but it will also state that I will have to press on with the court claim if I have no reply within (7 days? 14 days? what do you think?).

I've been charged another £120 since my last letter!!! including one charge of £30 which says is 'commission'??? instead of the usual 'referral'. Never had that before.

Moomin · 11/04/2007 10:44

any idea of the email address?

that's brilliant, thank you. I got the settlement letter from a Customer Services Advisor and obviously I have his name. Do I make reference to this in my email? Think I will send it to Krysta Campbell. I'm quite pleased with my email - so you want to see a copy?

Thank you for your letter of 4th April offering me the sum of £825 in settlement of my complaint against the unlawful bank charges to my two accounts. After careful consideration, however, I regret that I do not feel I can accept this as settlement, especially as more charges are being added to my account on a regular basis, thus pushing the amount I am overdrawn to a level where I am finding it hard to manage financially.

As I have stated in previous correspondences, I am aware that the bank is not a charity; although I accept that I have not always managed my accounts in a way I would wish to, I see this as a temporary measure: the majority of my charges have been accrued since having my second child in 2005 and my wages have reflected a second maternity leave and reduced hours on my return to work. I fully intend to increase my hours in the coming months and get my finances back on track but I am finding the charges being applied to my accounts crippling and disproportionate to the administration charges I believe my going over my agreed overdraft limit truly cost the bank. One of the most recent charges for £30 was applied when my account was only £6 over the agreed limit: I find this unacceptable and, I believe, unlawful.

Up to today?s date the charges on my number one account now amount to £876.16, with £92.20 interest over the past 6 years; the charge for my number two account today stand at £478.39 with £38.55 interest: overall the cost of all charges and interest total £1466.30. I feel that without the full cost of these charges and interest being refunded to my accounts I will be in debt for some time and, although I am sure my custom is more valuable to Barclays in this state, I do not wish to be in this level of debt for much longer.

I hope a look at my recent correspondence with the bank will also show that I have had reason to complain to Barclays twice more in the past 6 months and, although both complaints have now been satisfactorily resolved, it has not given me much faith in Barclays and its assurance that I am a valued customer (and I use the term ?value? here in the sense of respect, not monetarily).

I look forward to hearing from you within 14 days of receipt of this email. If you feel you cannot refund my charges in full, then I reluctantly will proceed with a request to the Small Claims Court.

Yours sincerely

Mellowma, where did you get the banks address from, Im not sure if I sent the letters to Abbey to the correct address and maybe that is why I have had no reply from the first letter yet?

i wonder if you can help me - it was many moths ago when inspired by this and other threads i asked for my bank statements.

howeveri haven't done anything with them

just this minute i asked the bank what a "debit commission" was

it appears as "commission" on my statements.

its a charge for not haveing sufficient funds in my account for a DD.

can i claim this back?

£35 huge amount. i get them loads.

electra · 12/04/2007 15:32

I'm confused about which initial letter you should send - there seem to be different templates on different sites. Any advice so that they won't think I don't know what I'm doing?

Trix11 · 12/04/2007 16:18

mellowma, I sent it to an address in Milton Keynes, shall I resend it?

FoghornLeghorn · 12/04/2007 16:20

We got a letter from NatWest today saying they will be crediting DH's account with £1172 providing DH agrees with this and returns an agreement slip.
We were claiming for £1300 but to be honest we could really do with the money atm so £1172 is brilliant for us.

Am a very happy bunny now

custy · 12/04/2007 16:26

please can you hepl re post of 15.21

total newbie to this thread. Am i correct in thinking that people are claiming back money from banks when they got charged for overdrafts and unpaid cheques and DDs? We have had a rough couple of years financially (to say this least) and have been made worse by what in my view are xs bank charges. I'm nopt sure they were unlawful though as we WERE over our limit and having lots of dds bounce etc. Things are getting better but i dont think we would have been in half the trouble if it wasnt for the bank charges. Now because the nationwide (fuckers) have reduce my dp overdraft by £800 because we went over the limit we are in shit street again as we are being charged for being over the limit and any money we put into that account is being sucked straight out? I'm very wary of sites which claim they can get money back for you etc, we have all our bank statements etc but to be honest im actually scared to look at how much we have paid in charges, it may even outweigh our mortgage its that bad. So what i am really saying is, have we a hope of claiming these back and where the hell do i start. Like one of the posters we have been charged if the account went over by silly amounts too.
