It's an excellent idea, Toobusy. I'm sure that many thoughts will be forthcoming in the course of this thread. Smile

cozietoesie · 16/03/2016 10:04

In fact, you might be advised to repost that request at regular intervals? Smile

cozie what do you think about a gp handout? Do we have any GP's/med professionals lurking? Im sure there was one a while back... It would be really good to hear a POV from a med professional on how we would be best going about a handout?

I'm not clear that that would be allowed by the NHS, Melaw. GP surgeries should really be entirely neutral places I would have thought?

  1. Fraud by false representation

(1)A person is in breach of this section if he—

(a)dishonestly makes a false representation, and

(b)intends, by making the representation—

(i)to make a gain for himself or another, or

(ii)to cause loss to another or to expose another to a risk of loss.

(2)A representation is false if—

(a)it is untrue or misleading, and

(b)the person making it knows that it is, or might be, untrue or misleading.

(3)“Representation” means any representation as to fact or law, including a representation as to the state of mind of—

(a)the person making the representation, or

(b)any other person.

(4)A representation may be express or implied.

(5)For the purposes of this section a representation may be regarded as made if it (or anything implying it) is submitted in any form to any system or device designed to receive, convey or respond to communications (with or without human intervention).

  1. Fraud by failing to disclose information

A person is in breach of this section if he—
(a)dishonestly fails to disclose to another person information which he is under a legal duty to disclose, and
(b)intends, by failing to disclose the information—
(i)to make a gain for himself or another, or
(ii)to cause loss to another or to expose another to a risk of loss.

  1. Fraud by abuse of position

(1)A person is in breach of this section if he—

(a)occupies a position in which he is expected to safeguard, or not to act against, the financial interests of another person,

(b)dishonestly abuses that position, and

(c)intends, by means of the abuse of that position—

(i)to make a gain for himself or another, or

(ii)to cause loss to another or to expose another to a risk of loss.

(2)A person may be regarded as having abused his position even though his conduct consisted of an omission rather than an act.

Melaw21 · 16/03/2016 10:14

Hmm, yeah, fair point Cozie... But you often see notices in mine for local clubs, chiropracters etc... Just didnt think this would be that different?

Melaw21 · 16/03/2016 10:15

Also... Hospitals are soooo not neutral! Costa coffee anyone? 😂

Melaw21 · 16/03/2016 10:16

But thats a whole other thread for a whole other day! 😂

throwingpebbles · 16/03/2016 10:18

Or maybe we could work up a letter to send to consultants, Gps and Specialists etc warning them that their patients might be being approached by people making very misleading claims? And give examples of the claims made etc?

Melaw21 · 16/03/2016 10:20

Yes throwing thats a cracking idea, is there a specific association for gp's that we could get advice from does anyone know?

throwingpebbles · 16/03/2016 10:20

So eyes if someone uses Facebook to create the impression they have a fancy house and a glamourous lifestyle when really they live in a bungalow in Grimsby (say), to encourage new recruits to sign up, then that would be fraud? Smile

throwingpebbles · 16/03/2016 10:21

BMA? Plus various specialist groups... I know lots of medics I can pick their brains more tonight! (Needless to say I have got them googling Forever and they are appalled!)

Melaw21 · 16/03/2016 10:22

Bot watch now has so many examples to back up the campaign, if we go about it the right way, hopefully it shouldnt be too difficult to convince them that this is very important...

cozietoesie · 16/03/2016 10:25

That might be useful, throwing. Smile

Melaw21 · 16/03/2016 10:26

Ok throwing thats great, pick their brains and we can crack on with a plan when you have a bit more info.
I am not surprised they are apalled! Sadly as they are probably beginning to realise, forever are merely the tip of the iceberg (or dare I say pyramid) when it comes to dubious and erroneous health claims!

Eyespying · 16/03/2016 10:27

throwingpebbles Yes.

That said, given the almost univerally catastrophic, hidden, quantifiable results of 'MLM' rackets, any fair minded person (including a judge) would be forced to conclude that the dubious occupation of acting the scripted comic-book role of a successful MLM business owner, has been intrinsically fraudulent.

Melaw21 · 16/03/2016 10:28

Btw, is there an injury called 'mumsnet elbow' I think i have RSI! Lol, maybe I need some warm parslaii jelly....

ambler21 · 16/03/2016 10:31

We're still waiting on answers to a number of questions from many threads ago. Debate is indeed a two way process.

Chimps attempts to portray as a victim are frankly laughable and vomit inducing in equal measure. The best side we've seen from the WWC ghostwriting team has been passive aggression and cheap NLP tactics, the worst being exactly what they accuse this large, diverse and independent minded group of people of. When the threads are re read in the cold light of day it all becomes clear what people's true intentions are. Maybe the full unadulterated/undeleted threads will all go as an appendix to the book.

Motorheadmum · 16/03/2016 10:37

Morning all! This thread is moving fast again!

I think the biggest problems with the MLM's are the lies. Claiming products cure cancer or will cure other things when they blatantly don't are some of the reasons I am on here and I am glad that people can see this.

Melaw21 · 16/03/2016 10:37

Thing is Ambler I think Hell would freeze over before a cogent argument appeared from that corner... Its a (deliberate) waste of our time, just need to ignore it now I feel 😉

Melaw21 · 16/03/2016 10:40

And I am as guilty as the next person at having taken the bait from them and argued back on several occasions. Not anymore...

Melaw21 · 16/03/2016 10:42

As an earlier poster rightly claimed, "you cannot argue with stupid."
