Can anyone please advise.
My ex is currently being investigated by the Financial Investigation team of the CMS.
He is continuing to claim he earns £5 per hour meaning I receive a tiny amount . Unfortunately the company he works is providing the info to HMRC. He is 'on the books' sometimes & cash in hand others. It's a small family run business. The CMS are willing to investigate as I think they have identified discrepancies in my case.
I'm happy they are investigating but I'm not hopeful of a positive outcome.
Has anyone had a positive outcome following an investigation? Or do you know what they actually do? I do know that they work along side the HMRC but unsure what other things they can do.
I really hope someone can help me. I'm actually at my wits end.

Definitely runs a car. Has been on holidays whilst claiming not to work but not since the CMS case was opened.
You've got a lot to go on there. Just get it all written down and pass it on. Watch out for new tech or reference to new tech too. Easy to miss an Apple Watch or similar but the signs will be there

Everything seems so slow still waiting for info from them will I hear back bf tribunal ?
Of no tribunal if I fail with them I just don’t know but it’s slow been so long .

Good news - I believe the FIU are taking my case this time.
In other frustrations, I told the CMS in march my ex is now employed. But they havent done a new calculation because I didnt state 'please recalculate my case' in my message to them. Apparently it's not a given that they recalvulate your case until either party states they want a recalculation. So frustrating! Feel like I'm always doing half the job for them. I'm sure if I said nothing they would do nothing but fortunately I wont give up that easy for the sake of my children. They deserve the support

My case is still with FIU. The investigator called me last week - he sounded positive but I don't want to get too excited! He says they normally get a 'positive outcome'

Does anyone know what happens if money is found ( my case is being looked at over the past 3 years) but my ex doesn't actually have any money now? How is this money paid? Say if £15k is found for example from over the past 3 years - my payments would be recalculated but if he doesn't have the money to use to repay then what happens?
Would it be court as the money would still be owed?!

I'm owed over £21k - it's been investigated multiple times and taken to court. I've had nothing.

I don't understand how the CMS can't do their job properly. I've written complaints, called, emailed and I get no decent response.

Can I ask why you've never received anything??

@Skyvanilla22 my case is years old - transferred from the old system and so it's been passed between multiple departments.

My ex-partner has also avoided paying at all costs, predominantly by being self-employed and saying his income is too low.

The last liability order sadly had no conditions attached to it as the judge thought he would pay.....

The whole system is flawed. He can pay road tax but not provide for his children. For me it's not about the money now, it's the principle of it.

hi, really interested to hear that CMS will open an investigation, as the person I spoke to yesterday, said I would have to report the paying parent to HMRC and CMS don't do investigations unless I can provide concrete evidence?!?
When I asked how can I can get concrete evidence of mortgage payments, I was told to ask him!! I have paperwork showing property ownership and purchase of properties whilst he was on benefits, but she wouldn't have any of it.
He also just reported a change in circumstances which they have accepted with no evidence. Not earning and not on benefits, surely that should raise questions.
Does anyone have advice on how to get CMS to take my concerns seriously please?

Just an update. My investigator from the FIU called me yesterday. The investigation is almost complete and it's sounding positive!! My ex is about to be called for interview!!!

Update for you all - my investigator from the FIU is calling me today with the outcome of my case, that's been 13 weeks investigation. I'm so nervous and pray for a positive outcome!!!

The investigator didn't call. Unsure why. Praying it's today. 13 week investigation.
My only concern is my ex will go NUTS if he is exposed. He's not a good person.

Update!!!
My ex has been caught by the FIU!!!! He's being pulled in for interview and the previous 3 year assessment period is being recalculated.

I literally could not have wished for a better outcome.
This is not about the money, it's about him finally being caught & he'll be squirming!
