Who should be liable for crash?

If someone can drive around a roundabout as many times as they want does this mean they have right of way ? They entered the roundabout in the wrong lane, not following the directional arrows and cutting people off trying to exit.

Someone crashed into the side of my car on a 2 lane entry and exit roundabout when they were using the wrong lanebut I'm told by insurance company it will be 50/50 and will affect my insurance now 🤨

This isn't clear. Are you the person who went round several times or the person entering the roundabout?

Ohownnoe · 16/11/2023 21:41

I am not the person going around the roundabout several times and not taking the exits as directed by the arrows on the road. I am the driver in my own lane and using the roundabout as per directional arrows. Was driving on the inside lane and exiting in my lane when she crashed into the side of me.

You cut across into the path of a car
I’d snap there hand off at 50/50

Chewbecca · 16/11/2023 21:50

Did you go straight from the inside lane to exit?

Ohownnoe · 16/11/2023 21:51

But if they're in the incorrect lane and it's even marked on the road that they have to take the first or second exit but dont . Arent they actually crossing over my path?

The inside lane is the one on the left in the UK. The one you should exit from.

This.

I'm not sure OP understands roundabouts.

Ohownnoe · 16/11/2023 21:55

I entered the roundabout on an entrance before them as I was taking the third exit. Yes it's a 2 lane exit all the way into a city like a dual carriageway so exited from the inside lane.

HollywoodTease · 16/11/2023 21:57

Which side of you did she crash into? Can you do a diagram?

Ohownnoe · 16/11/2023 21:58

Sorry I mean the right lane

Doesn't matter if they were in the wrong lane. If you cut from the inside of the roundabout to the exit and hit them it's your fault. It's your responsibility to ensure the way is clear. If they are offering 50-50 take it.

Diagram!!

Diagram!!

We really need one!

BountySunshine · 16/11/2023 22:00

50/50 sounds about right. If you went to court you may do better you may do worse, you are are likely to get away with nothing though.

HC Rule 184 tells you to get in right lane
Ruke 185 warns you to watch out for other Road users who might be in wrong lane and/or not signalling correctly.

Court will say they were positioned wrong but you should have been looking more carefully and not cut across.

BlueEyedPeanut · 16/11/2023 22:00

You're definitely lucky to get away with 50/50. It doesn't matter that they were in the wrong lane, the onus is on you to make sure the road is clear and safe before you perform a manoeuvre. Did you not check your left before you crossed lanes?

MichelleScarn · 16/11/2023 22:00

Definitely diagram!

Ohownnoe · 16/11/2023 22:03

So it was like this. I am the red car. They are blue

I did see her but I didn't know she was in the wrong lane. I would obviously have stopped if I had known!

EarringsandLipstick · 16/11/2023 22:05

Am I missing something?

What's the problem? You both entered & exited fine.

Do you mean instead that the blue car didn't exit where you are showing but continued to the 3rd exit?

HappyMavis · 16/11/2023 22:06

Ohownnoe · 16/11/2023 22:03

Thanks OP, that's really cleared the mystery up!

Pashazade · 16/11/2023 22:06

Unfortunately even though they were driving dangerously, the onus is on you to check before pulling off the roundabout especially if it's two lanes. 50/50 is likely the best you'll get at this point. Although I accept there was probably little you could have done to avoid the accident if you were positioned to exit and they weren't. Is there any camera footage?

EarringsandLipstick · 16/11/2023 22:08

If it is the case the the blue car continued when you went to exit, it's still your fault.

You should have seen she was continuing to drive onwards - not exit.

She is obviously completely wrong not to have indicated / followed lanes but if you drove into her, it's your fault and 50/50 sounds a good outcome

Ohownnoe · 16/11/2023 22:08

Yes blue car didn't exit and drove into the side of my car when I was exiting. That's just an image from the Internet to show what the roundabout is like! Also I was already on the roundabout before her as had entered from the previous entrance. So she didn't give way to traffic from the right either

How were you on the roundabout before her if she went round several times?

Anyway take the 50/50 sound slide its the best you can get. It doesn't matter if someone is in the wrong place/lane you still have to avoid crashing into them.
