Not on rental agreement can I make him leave?

StbExDH is refusing to leave the house.

He's been abusive long term. I tried. I can't stomach any more.

His current thing is now to boast of all the shags he'll be having, while living here because "there's nothing I can do about it" lots of sneering in my face "you going to make me leave?" etc. I'm tired of the children seeing this as their "role model".

He's not on the rental agreement. We have not yet started divorce proceedings.

Is there anything I can do? I'm not involving police, I can't prove a thing, and it will just make him act like a massive bastard (even more so) in the divorce. I'm not upset or affected by his behaviour, it's like white noise. I just want to know how to get him out.

I think if you move out and he stays he's effectively squatting and it could take months and ££££ to have him legally evicted

Divorcing is also time consuming if he won't agree to a simple divorce

You mentioned he can't get another job as they would need to do a DBS and would not get it. Does his current job not require an update to his DBS? We have to update every 2-3 years where I volunteer. I think schools need to as well.

Any job that requires a DBS check should update every few years. There is no legal requirement for them to do so but it is good practice.

However, the OP talks about domestic abuse logged by herself and his previous partner. The way she talks about it suggests that he hasn't been cautioned or convicted for this. If that is the case, it may not come up on an enhanced DBS check. Non-conviction information is disclosed on enhanced DBS checks in less than 1% of cases where the police hold such information. There is statutory guidance on the disclosure of such information which says, amongst other things, that information can only be disclosed if it is relevant to the job in question, sufficiently serious, sufficiently current and sufficiently credible.
