Brexit: what would happen to EU citizens living in UK?

marghini · 13/01/2016 19:07

I am a EU citizen and I have been living, working and paying taxes in the UK for a while.

I am really concerned about what would happen to the EU citizens who built a life for themselves and settled here in the UK in case of a Brexit.

Do you think all EU citizens already living in the UK would be pushed out? Or perhaps the government would just stop allowing further EU immigration?

Potential good news for some

Apparently Germany might reconsider its stance on dual nationality

rosierrosierrosier · 04/07/2016 19:52

As far as I know Germany already allows dual nationality, my dad has two nationalities.

AdultingIsNotWhatIExpected · 04/07/2016 19:55

My limited understanding of it is that they allow dual if both are EU, but don't allow dual with non EU (which Britain will be)

whatever it is, they're talking about allowing dual for English people living there in whichever circumstance that would mean they can't

Forage'll be pleased at least!

misfitt · 04/07/2016 20:15

Before this week I would have said don't be silly but now I am not so sure after Theresa May refused to give any assurances. Technically she is not PM yet so may be more understanding when she is considering the large amount of UK citizens living in the EU, many in Spain.

A friend of mine has a French wife and he is equally concerned. I said to him I am sure it will not come to that but he predicted these sort of headlines. I certainly did not.

Let's hope some common sense prevails soon

Girlgonewild · 04/07/2016 21:16

We certainly would be very foolish just as negotiations start to concede everyone foreign living in the UK will be allowed to stay as a key thing some of hte other member states want from us is rights for 1m Poles etc to remain in the UK and we don't as quite 1m UK people rushing to be allowed to remain in Poland. So if we concede the rights of the Poles etc then we need some massive concession in exchamnge from the 27. If instead we concede the point immediately we would be idiotic negotiators and damage this country. What a mess the Brexit lot have put us in.

Lonelycher123 · 05/07/2016 08:18

You'll be fine. You're allowed to go on holiday. It's just that if you were away the whole time for something like 2 yrs then you would have had to say you were not here 25 yrs.
I was here 40 years and lost it all, I've paid so much tax but had to fill in that I'd gone and come back and am classes as been living 5 yrs too, they just don't explain if we need to wait another year with this new residency card before applying for citizenship. They do not return your money if it's refused and they DO NOT call you up asking for more paperwork, only the passport office ask you for more paperwork.
But you should be fine.

Lonelycher123 · 05/07/2016 08:21

My last message was for Christmaswreaths

About the residency card

AdultingIsNotWhatIExpected · 05/07/2016 11:58

My understanding about the year wait:

IF your PR is sucessful and you get a card/passport entry back after applying, at that point you can count your PR from the last date you counted on your PR application.

So for example:

If your PR application included the following evidence:
Yr1: June 11- June 12
Yr2: June 12- June 13
Yr3: June 13- June 14
Yr4: June 14-June 15
Yr5: June 15-June16

And you don't get your PR card until say October 16
You "qualified" in June 16, so you can apply for naturalisation on June 17, not October 17 (a year after getting the card)

christmaswreaths · 05/07/2016 21:43

Fingers crossed then! I sent mine off yesterday so now I am going to see how long it takes... Someone said over 6 months as they are swamped!!

Lonelycher123 · 05/07/2016 23:08

Christmaswreaths
Maybe 3 months or less if you're lucky! I'm sure you get an email explaining, saying that it could take upto 6 months for an EU residency certificate and if it's a for a visa it's 4 weeks (something like this)
The problem is getting an Eu residency certificate is really hard because you can not speak to anybody about your case, there is nobody to ask questions believe me. Because they refused one application for a stupid reason which they could have called me and asked for what they needed, but NO! Just keep the money! I don't see why it costs £75 to refuse an application if all they did was open up the envelope! It costs £75 to open an envelope and write back saying you've not sent the right form!

Now if I make a mistake on the citizenship application will I lose £1200 as well?!!!!

Lonelycher123 · 05/07/2016 23:12

Thanks adultingisnotwhatiexpected

I'll wait a year just in case because I'm not giving them £1200 for them to refuse my application, they better contact me if they need anything else not send everything back and keep the money!! Is this a joke?

Lico · 12/07/2016 09:20

Thanks for the website. It does mention under EU law. The main question is what will happen when EU law no longer applies?

AdultingIsNotWhatIExpected · 12/07/2016 12:31

That statement reads like the statements businesses put out when they're planning reduncancies but don't want people to panic (i.e. stop working/look elsewhere) until they're good and ready to make the cut and boot them out of the office with a security escort.

It says nothing reassuring at all, just the status while we're still part of the EU

Also it implies that applying for citizenship is just a technicality and anyone EU can get it if they want (in other words, if it gets to Brexit and you haven't, you obv don't wanna be here)

It is NOT easy any more to apply for citizenship, people are getting rejected at the (now compulsory) EEA(PR) stage!

Oh and it doesn't mention formalising your residency with an EEA(PR) - which is compulsary if you want naturalisation, that in itself is suspicious and shows me that the aim of the statment is not to help EU nationals, but just to keep everyone calm and beavering away… until they can't!

AdultingIsNotWhatIExpected · 12/07/2016 13:38

I imagine they'll refer back to it in 2 years time with "well we did advise people that they could have applied for citizenship at that time "

Lico · 12/07/2016 20:39

I agree with you but DH keeps telling me 'don't be ridiculous!!' which is winding me up no end..

MrDebenham45 · 13/07/2016 19:56

But as mr cameron say on the day before the election that eu citizens living in the uk should be worried if the uk leave the european union... ANd also many EU citizen didn't realized that the tax the you paid here in this country are use for your own welfare so it is unfair to blame that you pay taxes.
Hope evrything would be fair that all eu citizen should be reviewed and take all the necessary requirement to stay here in this country.. including those people who just claiming benefits on the first day they step in this country.
and i think it is too late to apply for the citizenship coz as the referendum suggest that leaving the EU is to avoid so much benefits outcome of the government..

Lonelycher123 · 18/07/2016 04:57

On the 20th July there was going to be a talk about EU nationals .
A 'right to remain' bill (which is being drafted with lawyers) rule will be introduced
To the commons by a Green Party MP Caroline Lucas, will probably ensure this by opening a new and expeditious route for them to apply for and be granted indefinite leave to remain in Britain under uk law.

It's not straight forward to become a citizen, has anybody passed the life in the UK test lately? It's really hard.
Even if you've lived in the uk from a very early age you're rights are limited, if you go out for a year or so, once you come back you're starting from scratch. And when you get the residence card you still have to wait a year to apply for citizenship, but they tell you different things, it's not like tesco wher you can easily speak to a manger if you have questions. It's send us the money and I'll see you later! (Well NOT see you later at all)
Wish I had settled somewhere sunny, now it's too late, if they want to throw me out and keep all my money, good luck to them they're going to need it.

Tryingtosaveup · 18/07/2016 20:03

I voted leave and the sooner the better. One of the reasons I voted was high immigration from other EU states.
The Government needs to take note of the wishes of the British people who voted to leave. This is one of the reasons Teresa May won't commit to all the immigrants staying.

CorkieD · 18/07/2016 21:12

Tryingtosaveup,

So you are saying that the wishes of the British people who voted to leave is that the EU immigrants are no longer allowed to stay.

I'll miss Graham Norton on a Friday evening Sad

Tryingtosaveup · 18/07/2016 21:59

You can listen abroad!

CorkieD · 19/07/2016 00:17

Tryingtosaveup,

You missed the point. It's Graham Norton, not me, who will have to leave.

MariscallRoad · 22/08/2016 22:31

bump

MariscallRoad · 22/08/2016 22:52

AdultingIsNotWhatIExpected
I don't really know. You need to follow news because things change daily.

Some Countries do allow dual nationalities and all depends on the countries themselves.

We read daily of plans to make Law cahnges in the UK.

www.telegraph.co.uk/travel/travelnews/5170688/New-border-controls-could-penalise-Britons-with-dual-nationality.html

New border controls could penalise Britons with dual nationality

Tens of thousands of Britons with dual nationality risk being stranded abroad when the Government introduces computerised border controls.

These news are important. They tell that citizens of dual nationality UK and another - whatever EU or other - can run into various problems and become stranded.

Misti, I've only just read your above comment. But I was in the last stages of a massively difficult pregnancy, in hospital for a lot of it, then giving birth to twins who spent several weeks in special care.

So I wasn't particularly in the mood for debating with a lot of hysterical sore losers. But thanks for the concern about my whereabouts.
