Lord Mc is to sue Sally Bercow and apparently a letter is on the way but don't you need actual evidence to win defamation cases? And didn't she ask a question, rather than a statement even if it was tongue in cheek. I genuinely don't know how these things work innocent face

I dont think anyone 'small' will be sued because everyone can say they watched Newsnight and trusted the report from our wonderful BBC.

Even though the BBC didnt name him it didnt take much to find his name on the internet especially because there had been other publications naming him years ago which he seems to have ignored.

I still cant understand why the BEEB are paying him our money when they didnt name him and there were 3 other victims who were also given his name by the North Wales police. Shouldnt it be the police being sued for defamation? They allegedly started this messConfused

Who and where is the police officer. Has his actual name ever cropped up? Is he dead? Didn't one of the victims commit suicide and the other went missing?

The stupid thing is if they had released the name of the officer who gave the incorrect name then all of this suspicion would have been avoided.

Maybe they need an inquiry into who gave the name!

You are right about the other victims, one committed suicide and the other is missing but the wife of Mark Humphreys said that he died thinking it was Lord McA because that was what he was told when he was shown the photograph. Channel 4 news covered it earlier in the week.

The BBC journalists were really dumb not to have shown SM a picture and there really isnt any excuse for that no matter which way you look at it.

Sally b only asked why Mcalpine was trending. I think if she fights it in court he will have a hard time proving any mischievous intent. She will say she was genuinely curious why his name was in the trending topics. She'll love the publicity of a good court case.

Seriously, if I was LM I would be furious with the officer who wrongly identified me and most definitely want an investigation carried out.

I would also want the name of the police officer who put my name to a photograph accusing me of the most terrible crime.

Surely NW police know who was sat with SM and the other victims, because it was recorded in the waterhouse inquiry and the man in the photo was thought to be dead. McA is very much alive so how on earth has there been such a mix up.

It makes it look as though the victims were told he was dead so that they didnt go after whoever was identified. yet again it creates more questions and suspicion and makes the police look dodgy.

Lord McA should definitely send his lawyers to the police, i would in his position.

..and they are such important unanswered questions yet the media just seem to gloss over them and dive back into the newsnight story/ Entwistle's resignation removing the original sexual abuse story from the headlines. The public are probably bored now and more interested in Celebrity Jungle along with Helen Flanagan breasts unfortunately.

I really don't see how they can successfully sue Sally Bercow. She didn't make any specific accusation. How can what she wrote possibly be libellous?

Sally said on twitter that she is off to get legal advice. I think she should still publically apoloise for adding to LM's distress by asking the question.

LM should go after the Police who started this and as he is an apparent millionaire, I would like the BBC to justify giving him my licence fee, not happy, BBC didn't mention his name. I am all for public apologies!

It was the way she wrote it and the fact she has a lot of followers which might take it the wrong side of libel but it could go the other way. If I were her lawyers I would probably not sue her as it's not a very sure case. There are many more people who said LM did it on line which would be clearer cases.

If i hadnt seen some of the pages on DI i wouldnt have had a clue either.

What are the BBC playing at with our money that we are forced to pay. Its almost as though they were the easiest target and the most likely to pay without a fuss.

It is clear that people did identify him on the basis of what was in the programme. That really is sufficient to argue defamation although I accept that it is not straightforward.

Two names were floating around the media after the programme. Now only one name is floating around.

I read names in DI's forum too, not looked in there since it kept going down due to attacks.
