Claim for being ill on holiday

Currently on holiday and have had a stomach bug been in room for 3 days now and TA said i cannot leave room until 48 hrs clear of all symptoms so looking likely one more day at least, ds was also ill before me for 2 days so we have lost more than half of our holiday to one of us being ill and not able to go out.
we have clearly picked up a bug dr said da was likely from something he ate and I have just self managed so not seen a dr as cost us a kit for ds dr visit and clinic and meds etc , plus i have been ok to manage myself.
we have not left the hotel/ resort so def picked up from here, can we claim from the TA or through our travel insurance for lost days of holiday
it cost over £5k for 3 of us so not cheap and have kist over half the holiday so far.
never had this happen before so not sure how this works
anyone know ?

Surely your travel insurance would need a drs report?

And no, you can’t be compensated for a “bug” unless someone has been negligent (eg food poisoning).

If you have received food poisoning from the resort they should be prepared for the consequences. depending on who your travel agent is I would start there, but also contact your travel insurance who will/should do the work for you with the travel agent:hotel.

Food poisoning wouldn’t usually last days.

You will need to see a doctor for the travel insurance. And then you will need to prove that the hotel caused it ie. by food poisoning. Otherwise, unfortunately it's tough luck. I know it's awful when you get on holiday but unless someone is actively to blame, there isn't much you can do about it.

I don’t think you can claim. You have the services you paid for. Hotel and flight. It’s really bad luck but passing a bug around in your family isn’t a fault of the holiday. You could always read your holiday insurance documents!

I’d of thought you’d need a drs report then go through your insurance. So might be worth getting an appointment whilst you can. Also if you are on holiday from work you may be able to put through the holiday as sick leave. I have don’t this with a drs note in the past. Not sure if it was just the organisation I worked for or a legal process. Just a thought x

I didn’t say if you were able to change it to sick leave you could have holiday days another time.

It does sound more likely to be a virus rather than food poisoning caused by the hotel, as your DS was ill for 2 days before you got it. Hope you feel better soon.

I just looked at the Tesco travel insurance. It says you can claim £xxx for expenses incurred due to being ill. However, at a quick glance, couldn’t see anything about having compensation for being ill.

Of course you can, from insurance, if you have the right cover, it's not about "suing" or laying blame but claiming against loss of time spent on holiday.

I would get the TA to put in writing that you've been advised to stay in your room, and if you can get to a dr (your hotel may be able to arrange a room visit) ask for some documentation, you will likely be charged but should be able to claim back.

I've not done this myself but had a friend whose family went down with a bug in DLP and got compensation, check your policy.

If it was food poisoning, for which the hotel might be liable, you wouldn't have caught it from DS two days later. I think you have been very unlucky but not sure if your travel insurance will cover this (I would think you would need proof of having seen a doctor or of being confined to your room by ?)

This, you can claim costs of medical care, prescribed drugs etc but not usually loss of enjoyment. Who is TA, noone forces you to stay in your room, it is only advice. Disagree that food poisoning is shortlived, I once had it on holiday and was wiped out for a week on return as well.

Well my da did see a dr and hospital who said it was likely from something he ate ,i then became ill 2 days later could of been from him or again from sometime we ate or the pool etc.
mysef and ds eat simlar things , dh does not and he has been ok
someone else who we were with also became ill same day as me and did nit have contact with ds when he was ill.
i only had symptoms of the actual illness for 1 day really then advised by the TA that I cannot leave my room for 48 hrs after the last symptom and yes i have this in writing from the TA along with several messages.
also have been others who have been ill whilst here , some who have returned home but seems over a course of weeks are a few people.

@fudgepie12 thank you that is it , its not about blame etc but we lost 2 days when ds was ill and now 3 and bit with ne so more than half the holiday.
i have contacted the travel insurance to ask as we have active claim for ds has he had to see a dr and they sent him to hospital for fluids as he became dehydrated very quickly.
i am thinking wether to call the dr as i can def claim that back and if they can be more sure what it is that may help my claim. I have never had to claim before and if it was just couple days then fine but its half our holiday, i feel fine noe but not allowed to leave my room and use the restaurant / public areas etc
pool im fine i was told not to use that
food poisoning varies in days it takes to evolve and get better depending on the type, also if ds had food posioning which I them caught its stil all from the food regardless

we have nit left the resort and we arenit the only ones unwell

@Someoneonlyyouknow you can catch food poisoning or the bug that caused it from soneone or perhaps i ate something like he did, or maybe it took longer to come out in me as food poisoning is not always instant. Who knows but we were both fit and well when we arrived
have brushed teeth with bottled water , only eaten on resort and washed hands etc done everything we can to avoid illness

I think your claim is more against the tour operator whose advice you are following. Are they providing food/drink to the room?

@LIZS yes but I guess there advice is just same as NHS or schools although they also said it could be caused by heat ,in which case I wouldn’t even be contagious ?? My dh is having to bring food back and drinks for me, they did say they would arrange but haven’t really , same as I asked for extra cleaning things to be left so we could keep wiping down toilet etc which they said they would but haven’t and there really is nowhere to go here. Luckily i did have some anti bac wipes so have been using them mostly.
i am not the only person ill here

Wtf, who is the TA? 🤔 bizarre that you feel ok but you're letting them hold you hostage in your room. You think it's food poisoning but it took 3 days to appear? It's not.

Absolute bullshit. You can't "catch" food poisoning from someone else. And it doesn't "evolve" nor does it take days
