Claim for being ill on holiday

Currently on holiday and have had a stomach bug been in room for 3 days now and TA said i cannot leave room until 48 hrs clear of all symptoms so looking likely one more day at least, ds was also ill before me for 2 days so we have lost more than half of our holiday to one of us being ill and not able to go out.
we have clearly picked up a bug dr said da was likely from something he ate and I have just self managed so not seen a dr as cost us a kit for ds dr visit and clinic and meds etc , plus i have been ok to manage myself.
we have not left the hotel/ resort so def picked up from here, can we claim from the TA or through our travel insurance for lost days of holiday
it cost over £5k for 3 of us so not cheap and have kist over half the holiday so far.
never had this happen before so not sure how this works
anyone know ?

I meant to add that my advice is based on claiming for medical expenses, if you want to sue IF you do have food poisoning, then I'm not sure what you do as I haven't sued anyone. Probably a Solicitor first port of call when you get home.

Live your life according to what’s on Google and see how far you get. 😅

You'll find that proving this will be exceptionally hard, and you’ll likely get nowhere.

@Deathbyfluffy but its medical facts and tests will prove one way or the other which i will try and arrange now as another poster has said, also in touch with some others with same symptoms whi are here just returned back etc another poster posted clearly how food posinining and stomach bugs work as well where others were claiming its nit true etc when its cleary documented how it works by medical people not just joe bloggs on google
why do you thibk schools and nhs say 48 hrs
maybe I won’t get anywhere and thats fine some people have explained that in a helpful way ratter than just being dicks about it
why is it hard for some people to just be nice
mumsnet certainly attracts them thats for sure

@Wendysfriend that us pretty much what i expected and I had already spoken to insurance company and sent paperwork of for ds and his medical bill etc , unfortunately taxis do not gve receipts so could not claim for them
i may call the dr tomorrow aa well to give me the all clear so i can go back to enjoying remaining 2 days and to confirm i an fly etc
everything has been documented with TA & hotel etc and has bee a few people Ill apparenly, although many haven’t reported as guess they don’t want yo stay in fir 48 hrs but some have reported
the hotel have still cleaned room daily etc can’t fault them there , Dh is getting food and drinks but linited what i have as avoiding fresh produce etc

This sucks OP. I was confined to my room (well couldn’t leave the loo) after eating something dodgy in Vietnam at a cheap restaurant. We were on a multi destination hol and the food poisoning part really kicked in when we arrived in Tokyo. Awful as never got to see the place. We didn’t claim on insurance as not sure what I could claim for. Hope you get better soon.

Some of the replies you’ve had on here have been unkind for the sake of being unkind; @jellyminelli instead of further mocking the OP, why not just admit that you might have got it wrong and apologise?

I can’t advise with the claim OP, but I’d definitely get yourself seen by a doctor if you’re planning to go down that route; I’d be annoyed too if I’d spent half my holiday ill and the hotel were to blame. I hope your DS is feeling better, as are you and you manage to enjoy the last couple of days of your holiday.

@Scrambledegghead thank you , yes ds seems totally fine bounced back quick so him and DH can still go out and enjoy
probably won’t be able to claim for loss of time just the expenses by sound of things but will see what insurance company say and fingers crossed i can go out the room tomorrow and get a couple days out in some fresh air at least

@NeverDropYourMooncup its not about not enjoying it as the facilities are crap its about being ill from something we have picked up here
we have nit left the resort and we arenit the only ones unwell

It's not an insurable risk. You're tour operator may chuck a couple of quid at you if you complain enough about it to them, but the insurance company will not pay you for not having a good time because you/your child were ill.

@Someoneonlyyouknow you can catch food poisoning or the bug that caused it from soneone or perhaps i ate something like he did, or maybe it took longer to come out in me as food poisoning is not always instant. Who knows but we were both fit and well when we arrived
have brushed teeth with bottled water , only eaten on resort and washed hands etc done everything we can to avoid illness

you cannot catch food poisoning from someone. you can catch a stomach virus. If someone ate something bad they can't pass the illness on to you

Far more likely to be notovirus, surely? Took down 2/3rds of our party when we went to Disneyland Paris one time. Was the kids got it first then their parent a couple of days later. (We didn’t sue anyone/claim off insurance.)

DnV from food borne bacteria can be spread from person to person...... hence ships and hotels being wiped out by such bugs and the need for thorough hygiene safety practices at all time.....
Though unpleasant to envision, bacteria generally spread via the "fecal-oral route," which is when trace amounts from one person's feces end up in someone else's mouth. Those poorly washed hands can contaminate a host of objects and surfaces, including light switches, doorknobs, and kitchen surfaces.

Where are you norovirus is heavily doing the rounds in certain Spanish resorts highly infectious but not the fault of your accommodation at all.

I'm guessing the Travel Agent advises staying in your room/accommodation for 48 hours after your last bout of sickness or diarrhoea. It will be hard to prove the cause without stool samples and although your family may have been very careful with hand washing etc others may be less so. As you say, some families may not be staying in at all, so as not to limit their holiday, and your DH has had to mix with other people.

(Sadly, insurance are always looking for a way to wiggle out).

Food poisoning wouldn’t usually last days.

Erm heard of salmonella?
can take 24 hours to get symptoms and last days!
i was ill (had it twice) for 5-6 days with this and it took 21, and 24 hours before i had symptoms!

Well went to hospital here and have infection of some kind showing in blood tests , ironically could not do stool sample as seemed to of cleared up ion that side and prob with meds they have gave me
they suspect bacterial so have given me antibiotics to take just incase, which i an taking along with some other bits but plan to see dr in uk as soon as i am back.
agent confirmed have been other cases but not high enough for them to be worried ??? Not sure what cut off is
first time i have been on holiday and can’t wait to go home , counting down the days
but learnt a lot about stomach bugs / food poisoning etc

So sorry you and your DS have been poorly, sample will prove if it’s due to a bug in the food you consumed at the hotel. I hope you’re much better soon and can enjoy the last few days of your holiday. It could help a potential claim if other guests in the AI have had similar symptoms flowers]

Get that stool sample and doctors visit ASAP. Insurance companies will do anything to avoid paying out - they initially declined my brother’s claim for having his appendix removed due to acute appendicitis and subsequent septicaemia while he was in Croatia due to the doctor’s report being in Croatian 🙄. He eventually got it sorted but had to involve lawyers to get them to pay up.
