NHS Mask Shamed/Discrimination, escalating action (thread 2)

First thread: Mask shamed (disability), complain? (Some TMI) http://www.mumsnet.com/Talk/amiibeingunreasonable/3978398-mask-shamed-disability-complain-some-tmi

It's been almost a year since I made my original post, and the after effects are deeply ingrained in my soul. I've had my piece published in Laura Dodsworth's book "A State of Fear" too.

I complained through PALS and my concerns were escalated to a senior nurse at the MIU, where my concerns were met with pure disdain, an attitude of "fuck you, wear a mask, protect everyone, I don't give two shits about the impact on your mental health". She also wrote that any questioning regarding lack of masks would be gentler and more private - things I know have not been implemented.

I've taken legal advice to determine my legal position and I'm told I have a strong case as the MIU stance contravened governmental coronavirus regulations and the impact to my mental health is shocking. Also that my mental health conditions, including PTSD and GAD from the sexual assault, and how they affect me are enshrined as a protected characteristic (Equality Act) and their actions were in contravention of this and direct disability discrimination.

I'm about to escalate up the chain to CCG, then CQC, then sue. Why sue? Why do I feel the consuming rage to take money from the cash strapped NHS? Because it's the only language they will understand - the only thing that will force accountability and responsibility on them. I can then directly pay privately for counselling.

I can't believe some of the replies you are getting on here and the clear lack of awareness of mental health.

They have a duty under the Equality Act to make reasonable adjustments based on your disability (and yes your mental illness does qualify as this). They have failed to do this.

DxHxSx · 23/06/2021 17:35

@SummerBreeze1980 c-PTSD is diagnostically similar to BPD. As is GAD. Its not my opinion of the OP per se but the diagnoses

DxHxSx · 23/06/2021 17:36

Sorry let me correct myself. GAD has areas which overlap with personality disorders. Not necessarily BPD.

@SummerBreeze1980

Here is a really good paper on the topic if its of interest to you Smile

It's not a lack of awareness around mental health, more than the OP started a thread a year ago, and has come back for more, none of which will add any value to their life or resolve any situation. I would bet a lot of money that now HCPs have been offered the jab, have actual PPE, we know more about covid and hospitals are slightly less ravaged by people dying in huge numbers; they have provisions in place and aren't overly arsed about someone wearing a mask or not. The OP is asking people to be empathetic towards them which is fair, no one has said ah yeah glad you were treated like that, sounds good; but extends none to the staff who at the time were following guidance from above that was impossible to manage. Rightly people have pointed out that seeking compensation is likely to be damaging to MH and unsuccessful, and the best thing to do would be to seek help for the underlying cause rather than pursuing someone on not much more than minimum wage who was risking their health without the proper equipment at the time. A far better thing to do would be to put a complaint up the relevant channels and confirm that they now have procedures in place to ensure it doesn't happen again.

@Longestfewdaysupcoming

Op. I hope you get your apology. I find it absolutely disgusting that an HCP said to you “fuck you, wear a mask, protect everyone, I don't give two shits about the impact on your mental health”
It would be disgusting if it actually happened

The paper you've linked actually states that CPTSD is diagnostically separate from BPD

Loads of mental health disorders overlap, e.g.:
Impulsivity: BPD, ADHD, bipolar (mania), ASPD.
Low mood: BPD, major depression, anxiety, grief reaction, PTSD, schizophrenia, schizoaffective disorder, eating disorders.
Anxiety: GAD, OCD, eating disorders, depression, bipolar, ADHD...

The point is each label has its own unique pattern that doesn't overlap with anything else.

SummerBreeze1980 · 23/06/2021 17:52

@dxhxsx - people with EUPD (BPD) don't have disordered personalities,though. They have almost always suffered trauma, though so I can believe the cross-over. I'll have a look at the paper, thanks.

SummerBreeze1980 · 23/06/2021 17:54

By the way @Maskwoes - I think most people don't really understand GAD and how debilitating it is. They just think it's a bit of anxiety.

SummerBreeze1980 · 23/06/2021 17:55

@Whattheactualfk - thank you for the info.

DxHxSx · 24/06/2021 07:54

@Whattheactualfk Yes I was just pointing out the over laps.

shetlandponies · 24/06/2021 14:15

Good for you op

I am with you wholeheartedly. Ignore the inevitable arseholes x Thanks

I read a state of fear recently, what an amazing book, well done for contributing

shetlandponies · 24/06/2021 14:34

@Thehop

Why come back here to tell us? You know how strongly people feel about it and that you’ll be told you’re wrong.

Just wear a visor if you can? Or carry in the path you’re on and do what’s right for you? I can’t see that stirring up this thread is doing you any good of your responses are as strong as you say?

Don't speak for us all

Many of us are completely on ops side

Bronson2 · 24/06/2021 17:00

You sound like you are expecting the NHS to pay for treatment for your original trauma rather than whatever you went through on that day. I think your expectations sound way too high. I say this as someone who has been through a legal dispute. It's deeply unpleasant.

ij96 · 24/06/2021 22:26

@Glowbuggy

People are DYING. Wear a mask.

sadperson16 · 25/06/2021 10:30

People are dying and there us virtually no data that shows masks make any difference whatsoever.

Show me the data that says they don't work at all because that's a bold claim.

There is plenty of evidence to show that they do work to some extent. Masks aren't 100% effective, but they do cut transmission of the virus. Vaccines aren't 100% effective either, but together these are tools to keep many people as healthy as possible.

sadperson16 · 25/06/2021 15:53

Ok wrap your head around this....Marks and Spencer's cafe today.Some in the queue with a mask,some not.Order coffee,made by non mask wearer.Sit at table,drink coffee,replace mask. Small plastic booths around tables.
Where is 'the virus ' when I drink my coffee?

MintyJulip · 25/06/2021 18:05

Just recently I've seen a rise in people in Tesco not wearing masks. Sometimes whole families or groups. You're not telling me that the whole family is immune to masks or shields?!🤔

😲😲did you ring the police ??!
MintyJulip · 25/06/2021 22:37

No I didn't ring the police! Are you trying to be sarcastic?
I was simply stating what I've noticed😏

That means a big fat zero scientifically. It's the government balancing public health, the economy and popularism. It does not mean that you aren't more at risk with fewer masks than you would be with masks.
sadperson16 · 26/06/2021 08:08

OK so please direct me to any large scale research which shows mask wearing has helped at all?
I think it is a ploy to keep people stupid.

Longestfewdaysupcoming · 26/06/2021 08:13

@sadperson16 how does wearing a mask affect your stupidity levels? I’m genuinely interested as I’ve not seen any evidence that wearing a mask affects cognitive ability in any way?

sadperson16 · 26/06/2021 08:38

I think it gives some people something to witter on about, to feel outraged about , to focus on. Whilst they are complaining about young people/the man in Sainsburys/the kids on the train or whoever not wearing them, they feel morally superior and safe.They are doing their bit, helping Britain beat the virus.

A feeling of safety is very appealing right now.
