The Pro Rogues plan to prorogue again this week.

The Queen might be challenged to sack Johnson. Or he might be forced to extend.

It depends on which newspaper you read. Either way it strikes you that no one really knows what's going to happen...

There is still another Scottish court case due to pronounce later this week (thank goodness for Scots law Wink) on whether the court could, in effect, "pp" a letter requesting the extension if BJ refuses to obey the law won't send it, using nobile officium .

Anti-Brexit campaigners have failed in an attempt to force Boris Johnson to ask for an extension to article 50 if he is unable to get a Brexit deal through parliament.

Lord Pentland, sitting in the court of session in Edinburgh, rejected their request for a court order instructing the prime minister to seek an extension if he cannot get a deal passed by the Commons this month.

I bet Boris is praying on his hands and knees for that case to succeed - he doesn’t have to resign, there’s no excuse left not to have an election, he can campaign without the chaos of No Deal, and the fact that Scottish judges blocked Brexit will turbocharge his vote in England.

If he’s not secretly funding that case, he should be!

Care to make an argument against my point about the nobile officium? I’ll make this prediction right now: if it succeeds, and the Scottish court sends the extension request in Boris’ name, then a Conservative victory is nailed on in the GE.

Worrying report from Peston:

The government was supposed to confirm tomorrow that EU rules on state aid (ie prohibition on supposedly unfair subsidies) would remain in force after 31 October. Downing Street has cancelled the announcement. Which is a clear sign Johnson, Cummings, Lister all now assume...

UK is leaving EU on 31 October without a deal, that EU is poised to reject Johnson’s offer. Without the EU state aid constraints, Treasury could pump money into any businesses affected by no deal that need temporary support

No - it's the opposite Dusty -it means that the government has promised faithfully given assurances to the court that it will comply with the Benn Act.

So unless they have worked out a cunning way to avoid its obligations - or to meet its obligations so that it can avoid sending an extension letter (only way to avoid doing this is to get a deal agreed Confused - in theory at least Wink) - then an extension letter will have to be sent.

Presumably because they're not reading beyond the headlines. That or they're happy for Johnson to break the law so that we can get tougher on law breakers or some other twisted reason they've tied themselves into
