ITS OFFICIAL
The Highest Court in the Land has ruled that Boris Johnson has broken the law.

Parliament is Sovereign.

Despite the calls for his resignation it is highly unlikely he will under the current political climate.

It must be stressed that the judgement was UNAMINOUS and went further than most expected, and took the hardest possible line again the government

The power now lies with the Speakers of the Lords and Commons to decide when Parliament reopens.

It also means that all the bills which were ended by proroguation are now back in play.

Expect a full backlash from the hard right attacking the courts are going full on 'enemies of the people'. This will be NASTY

The strength of this ruling does pretty much rule out another proroguation as the courts are liable to throw it out immediately if they try it on again.

Johnson is in New York. He needs to get on a plane very quickly.

I’ve deliberately not posted much on here today as I seem to have the ability to turn things into a bun fight but this thread is more like the Brexit Arms today.

Why can’t people see that all this gloating / patronising / arguing only polarises people’s views even more?

This could very well hand Boris his no deal on plate.

If you read my post, I answered about NI at the end of my post

  • they had to have a referendum because there was no devolved govt capable of handling international treaties

That also meant there was no conflict between a referendum result and the limited NI local govt
There was no conflict with Westminster, because almost all MPs accepted it as a decision for Ni and Ireand.

The GFA specified referendums for future NI independence - wisely because NI politics hasn't evolved enough to make it feasible to hand over much power to a devolved govt

I also answered about Ireland and referenced the problems that even Switzerland has had with referendums

I would prefer Wales & Scotland to have fully devolved govts with the power to make decisions without referendums

My ideal would be a federal UK with only defence, trade treaties, foreign affairs handled at Westminster,
with an upper chamber of 25 senators for each of the 4 countries replacing the HoL and voting on those issues only.
Any 2 countries acting together should have a veto to e.g. block declarations of war, leaving / joining the EU ...

I'm not sure that some of the posters on here today could have been polarized much further even if we had tried bear.
Boris may or may not get his no deal perhaps helped by this decision but that doesn't mean it was the wrong decision.
Overall those of a remain persuasion are I think more amenable to compromise but this decision really wasn't about Brexit.

In a way I wish the decision hadn’t arisen in the context of Brexit at all. It is an important constitutional principle and it is being dragged into the Brexit morass. It was never about Brexit, it was about the power of the Executive

but your "arguing" is how our debating often goes, even between Remainers
Maybe especially between Remainers Grin

At least one Leaver, Louise broadly agrees with the decision,
because it was about upholding the rule of law and the rights of parliament, NOT about stopping Brexit
Moderate Remainers & moderate Leavers can agree on fundamentals like that

Those who are fantasising about elite conspiracies won't become less angry & susicious if Westministenders go quiet

I think people complaining about the decision itself are either misinformed or being disingenuous.

Johnson lost not because prorogation is illegal in itself, but because his lawyers failed to give a reasonable explanation of why a prorogation of this length was necessary at this time.

Leaving Brexit aside, are people really pretending that they want the government of the day to be able to shut down parliament at will for any length of time?

I am not, it was obvious that it was going to be a remain stitch up! It was never going to be anything else.

The Supreme court is packed full of EU remainers. Take Lord Kerr for example he works in the EU courts until recently when he joined the Supreme Court. Lord Reed, he is another face in the Euro courts.
You are getting my drift right?

This is an out and out brazen assault on our democracy, but most of us saw it coming. I would have been more surprised if the result had been anything else.

It is going to take more than this to stop brexit.
