AuldAlliance I didn't pick that up as an accusation of bias. More an appreciation that where a decision is finely balanced the underlying influences on the judgement may be different in different jurisdictions. But then we are back to discussing whether or not courts should be interfering in politics.

I can see why you might read it differently though. Much the same as my beef with jasjas re terminology such as "bowing".

It makes me uncomfortable that the courts are being used to interfere in parliamentary democracy. Because if this becomes the norm, those with the deepest pockets will always be able to overrule the govt.

Proroguing wasn't a democratic parliamentary decision, BJ decided it.

Perhaps in future, it needs to be a vote? much like conference recess.

I think i feel uncomfortable about it because it means our Govt is not acting with integrity and honour but instead is governing fro self interest.

Take the YH report, why on earth should the report itself be published in full? it affects us (leavers and remainers) but not those rich enough to leave the country!
i do understand you might not want to id individual civil servants.

A court can only overrule the Govt IF it has acted unlawfully.

One of the first things that happen in a dictatorship is the courts are neutered, to stop this happening.

An independent judiciary is our only safeguard from those that would take away our basic freedoms.

I'd rather leave the EU with no-deal than lose that safeguard.

And so far the judiciary in England has remained independent and not sided with a very wealthy pressure group against our govt. That's good and I'm very grateful to them and impressed by their rigorous impartiality. I'm just uncomfortable that if enough money is used for enough time that the wealthy pressure groups will win in the end and then they will be above parliament.
I don't agree with the proroguing by the way, but it is obviously not illegal and I would prefer that Johnson got him come-uppance in parliament or in an election.

I did not like the first intervention by Gina Miller and co against Theresa May. I think it set a bad precedent and it had unintended consequences.

So Boris has broken no laws but because Scottish Judges dont like what he was thinking when he prorogued parliament they have tried to stop him.

I hope Boris makes them eat cake.

Interesting interview with Lord Hope on The Nine - BBC Scotland

Clarifying 2 points:

  1. It is unlikely that any advice on prorogation was given to the Queen by Govt. Therefore judgement hinges on motivation of politician and whether that is subject to litigation.

  2. There is no difference between UK public law and public law in any other constituent part of the UK. Therefore the Supreme Court will indeed sit as the UK Supreme Court rather than potentially ruling differently under Scottish and English Law.

Not sure how definitive his expertise is as differing opinions have been aired throughout the day.
