Westminstenders: The Rule of Law

We enter week 2 of what might be considered 'the end game'.

The Conservative Party has made it clear that liberals are not welcome in their ranks. It has become the Brexit Party.

Farage is talking of a pact, though Javid has said no. What would Javid know though, he's only in the Cabinet.

Amber Rudd has resigned. She will run as an independent in an unnamed constituency at the next election. The assumption must therefore be she has been talking to a few people this week about this, though whether that means she is a 'One Nation Tory' independent candidate or simply an independent isn't clear.

Some think that her departure will deal Johnson yet another blow at the polls. Others think as the cabinet members with the worst satisfaction rating amongst tory party members this will be viewed positively by leavers and give Johnson a bounce in the polls.

It been reported that Cummings has overruled Johnson on at least key decisions this week which raises the question of who is in charge and running the show.

Cummings has promised to make us all melt in the coming weeks as he takes a sledge hammer to constitutional convention. He's advised no 10 staff to be 'cool like Fonzies'. A reference to pulp fiction and to happy days. As some have commented if you think about Cummings as some one who has watched too much Tarantino it does make him make a lot more sense.

There are suggestions that Johnson will break the rule of law in refusing to ask for an extension and the No10 have a trick up their sleeve over loopholes. The most obvious thing here being to offer the EU a deal they can't possibly refuse agree too to smear them and to then make it impossible for the EU to agree to an extension which noises out of France seem to suggest anyway.

Tomorrow is going to be interesting...

The CCA requires a prorogued Parliament to be recalled

Violetparis · 08/09/2019 17:24

I'm seeing comments on Twitter from Remainers that the Lib Dems and Greens shouldn't step aside for Rory Stewart because he doesn't want a second referendum. I don't think this is helpful at all, makes some of the FBPE Remain crowd look as bad as Momentum.

NoWordForFluffy · 08/09/2019 17:24

fluffy The court case would be MPs forcing BJ to obey the law and apply for an extension,
or possibly BJ applying to have the Kinnock Bill set aside as unconstituinal or whatever.

Ah, that's not what I read up thread. It was referred to as Cummings challenging the extension. Hence me saying not compatible.

I don't think the latter is likely, to be honest.

It’s rumoured that Amber Rudd will stand in NIcholas Soames’ seat.

Siddiq is as much a 'foreign agent' as Patel. Her vow of silence on human rights abuses in Bangladesh under her Aunt's rule includes telling a pregnant journo who asked her about it, "Hope you have a great birth because child labour is hard.”

I am prepared to be shot down in flames, and expelled from the Tufty club over this, but it might be worth thinking out loud that in a global world, it's not impossible to use pressure outside the UK to coerce inside the UK ? That's asked as a question, not stated as fact, but given Salisbury, and (going back) Georgi Markov, there are definitely points of interest ? (Again ended as a question, not a statement).

...I'm sure there are pregnant women in Bangladesh who've had their babies kicked out of them by Hasina's goons, and much worse. Hard to think that TS was not aware of this.

Jagger in 'Performance' is what proper cool looks like.

Classic film ... happy memories of watching it on imported VHS along with "A Clockwork Orange", and some herbal relaxation Grin.

JeSuisPoulet · 08/09/2019 17:36

The CCA requires a prorogued Parliament to be recalled @Chaz but if this is done in the latter days of Oct, with at least 7 to spare, are they able to talk about anything else or is it just about the CCA? I can see it as either a way to distract Parliament or to make them seem like they are at least part the reason...

MockersthefeMANist · 08/09/2019 17:40

As a badge-carrying member of the Tufty Club of old, I am disturbed by reports of Momentum taking over the club and beginning a purge of all those of us who have not yet been run over.

I hope that story about Starmer/Siddiq is either fake news, misinterpreted, presumed or plain wrong.

It's easy to get really worried about reports you read, isn't it? Social media can make you really anxious!

I'm wondering what the Privy Council could do during the prorogation?
Some form of delegated legislation? JRM heads it up after all.
There must be summat planned for during that period.Confused

lonelyplanetmum · 08/09/2019 17:44

Indi reporting that the plan is refuse to appoint an EU commissioner, putting the EU in breach of its own duty for all 28 member states to be represented on the executive.

No 10 thinks this would disrupt Brussels so that all other member states refuse to grant an Article 50 extension thereby avoiding any need to seek an extension.

OMG- political games over something this huge. Normal rational principled politicians do not behave like this.

If it's this hard to get consensus then the timing just isn't right. There was no urgency or immediacy other than that created by us. Just revoke then if you must - take time ,get consensus, get agreement.

BigChocFrenzy · 08/09/2019 17:44

"The CCA requires a prorogued Parliament to be recalled"

They have to be recalled within 5 days

  • if BJ/cum actually obey that bit of the law Hmm

(iirc the CCA can be used to pass, modify or repeal laws without Parliament,
so BJ/cum might try to modify this part of the CCA by executive order and let MPs waste more time in the courts)

https://www.legislation.gov.uk/ukpga/2004/36/section/28

However, MPs still can't vote it down for 30 days - so I'm not sure if it matters whether they are sitting

All that might be possible is a VoNC to replace BJ with JC,
but Swinson & co might ride down to No Deal still refusing this.

PestyMachtubernahme · 08/09/2019 17:45

The Northern Ireland (Executive Formation) Act requires Parliament to be recalled from prorogation in order to debate reports on progress made to restore the Northern Ireland executive.

So in theory Sinn Féin could cause parliament to be recalled.

DGRossetti · 08/09/2019 17:45

I hope that story about Starmer/Siddiq is either fake news, misinterpreted, presumed or plain wrong.

In the round, it makes no difference. The first cut is the deepest could just as well have been written "The First Headline is the Story" with very little changed about the melody, metre or meaning.

DGRossetti · 08/09/2019 17:49

I wonder how the rest of the world would react to the UKs petulance, when the UK then has to go grubbing for deals ? Obviously they'll ensure that any scope for future shitstirring is offset with extremely onerous terms, and a pisspoor return for the UK.

As anyone who's tried getting credit with a CCJ will know.

Quite aside from any cultural damage it might do to the image of Brits abroad. Who might be quite happy to dish it out, but maybe less able to take it.

DGRossetti · 08/09/2019 17:51

How can you not weep for what we have become ? I'm going to take a break and bawl my eyes out.

Quoted in full

It's 1984 and my mother arrives in the UK with 89 other Vietnamese refugees known as the "boat people". With just the cloths on her back and her four children, she's confronted with the local people of a council estate. Unable to speak English, she expects hostility and racism.
And then this happens.

A young scruffy looking man steps up, takes off his coat and handed it to the freezing cold refugees. A gesture so touching, that everybody later followed.
People then went home to fetch clothes they didn't need and handed it to the refugees and ensured they were all fed and watered.

My mother has never forgot that moment, when she was able to use a coat to wrap her boys so they could stop shivering. My brother can still remember the warmth that coat gave him and it stays in his heart to this day.

It's these things that British people do, that make make them truly British.

My family has never forgotten what England has done for them.
And because you allowed us in, we were able to give so much back to your country.

You gave us free healthcare. My family gave you 3 doctors. One has recently started working at Southmead hospital.

We never stole your jobs, we created our own and gave some to you.
In my family, there are 10 nails shops, 3 restaurants and 14 Chinese takeaways. We did this to give you amazing food and so we could support ourselves.

Please take a moment to think about all the Syrian refugees and think to yourself,
