John Bercow has stepped in. We've long made the point, that the position of Speaker was utterly crucial to the outcome of Brexit. However this ruling was long warned as a possibility. It was somewhat overlooked by all (including me).

We are now faced with the bizarre narrative that May was just about to be able to get her deal through, and it's now simply Bercow who has tried to sabotage Brexit.

The reality is that his ruling has the effect of making BOTH no deal And a lengthy extension (possibly with a PV) much more likely.

May now has to embrace one of these option (by accident or design) or find a way to substantially change the terms of her deal as put to the Commons, either through negotiation with the EU or bolting something significantly different to her deal like a variation of the Kyle Amendment (a PV based on her deal or remain). Or find a majority to overturn the standing order that Bercow has cited as the reason for his block.

This block also might apply to the Benn amendment (indicative votes) or other PV amendments. Which could equally be problematic going forward.

In reality Bercow has upped the stakes and forced May to do something meaningful rather than simply holding a gun to MPs heads to vote. Hurrah for parliamentary Sovereignty and limiting the abuse of power of the executive!?!

It's a completely neutral move in practice. The HoC has tied itself in knots with how it's voted for political reason rather than for the national interest. The British Constitution has just stood up for itself. Bercow is just a useful target to blame for the incompetence of the entire house for the last 3 years.

The billion pound question this morning is where does that now leave us?

The honest answer is I'm damned if I know.

Maybe the EU will come up with a magic bullet for May, maybe the Cabinet can come up with a magic bullet, maybe May will take the political magic bullet of a long extension or revocation or maybe we'll just all shoot ourselves in the head and foot with no deal.

I have no idea.

Ah so Trump has plans for NATO and I'm not sure we want to think about this...

Why are they still concentrating on Bercow's decision ?
We have far more serious problems

They must know by now that the Standing Order can be changed by a simple vote
and then the HoC can vote on the WA every day until Brexit, if they want.

Re: op yellowhammer-I was wondering why Monday but it makes sense that they need to be up and running by the 29th go when we sail over the cliff rather than start once we are splatted on the rocks.

I am sure I am going to cross post here, but if the EU will only grant an extension with a plan agreed by HoC if the deal doesnt pass, then how can May ask for one when HoC don't vote on it until the 25th or even the 28th!) and therefore haven't agreed on one yet nor will have time to do so?!?!?! So the letter she is supposedly writing will be turned down on Thursday as well, see prior sentences. And then they have run out of time to ask the EU again?

Or perhaps I am just losing the plot again and am confused Confused

I see some confusion in the press, even in the FT, about extension. Once the European Council has agreed to an extension, the 29 March date in the UK's Withdrawal Act no longer matters. Under EU law the UK remains a member state, and EU law is supreme.

Just looked on the Port of Dover website - nothing about Brexit. Well there’s a video that mentions the B-word but no information or advice otherwise.

The Statutory Instrument to change the Brexit date matters and this must be started by Monday
otherwise we end up in a legal no man's land

First of course, we must see if the EU will grant an extension and if so will it be until 30 June as May apparently wishes, or only 22 May

Also, what the EU may demand

  • in effect they can of course set conditions, by refusing to grant it if the UK doesn't do certain things

I was out most of the day, and 420 posts are already on the new thread, plus the 50 or so I had to catch up with the last thread.

A Leaver I know showed me that photo of the 50p piece with the Queen with her head in her hands - so perhaps things are beginning to change.
(I hadn't the heart to tell her that I had already seen it a few weeks ago.)
