Not sure about condition of eBay item

I bid on and win a brand new pram. It's arrived today and has quite a few scratches on. The box it came in was fairly damaged but I'm not sure the marks and scratches were caused in transit.

What are my rights if I don't want to keep it? I got it cheaper than retail but not cheap enough to be happy about the scratches.

Summerwinterton I think you may be right. And as I mentioned earlier if it's over 120cm long then it's too big for Hermes full stop!

TiredMummy2015 · 28/10/2015 09:52

I have no idea of the parcels dimensions but I know it took weeks to arrive with me and she said she had problems and had to pay extra.

She has now contacted me and said it won't be collected until the 4th November! I have building work beginning on Monday and need this buggy to be gone... I have had it almost a month now! Can I insist that it goes?

She is just being a real d*ck now and making it as hard as possible. She is moaning that her baby is now in intensive care and this is the last thing she has time for. But if she had not tried to rip me off in the first place we wouldn't be in this situation, plus she could have sorted it out weeks ago!

I would phone eBay and stop communicating with her. She is useless. Did yo pay by credit card btw?

Parcelshops don't have storage space for large items, plus the health and safety issue of heavy items and them needing lifting gear or 2 men to move something.

TiredMummy2015 · 28/10/2015 10:00

I'm on the phone with them now... keep being passed from person to person.

I paid by paypal.

summerwinterton · 28/10/2015 10:05

Yes I know, but did you use a credit or debit card Verified by Visa?

TiredMummy2015 · 28/10/2015 10:27

I presume it was my debit card linked to my bank account.

Ebay are having "technical problems" and say they will call me back.

Ignore her emotional blackmail. Keep on at eBay until they connect you with someone who can help you.

A little trick is if you follow the help options so it gives you a "call us" option..... Keep trying random problems until it gives you a "we will call you" option. Just click it so they call you and then explain your problem, they'll connect you to the right department!

TheWrathofNaan · 28/10/2015 12:39

Don't you have to do an eBay return within a certain amount of time? It concerns me you have had the item a month.

19lottie82 · 28/10/2015 12:43

As advised you need to confirm the dimensions of the buggy to see if myhermes will actually collect it! You don't want them turning up and refusing!

Have you got an actual returns label? A tracking number on its own is no use. Hermes won't collect if there is no label attached to the item.

I'm a bit confused as to why she says they won't collect until 4/11. As long as you purchase the label before 3pm you usually get a next day collection offered.
What does the tracking number show when you enter it into my Hermes?

TBH, if the item is small enough to be sent by myhermes I'd just purchase a label myself. For the sake of less than £10 (not sure how much they charge for items of a larger size / weight, but it's not a lot), and you can get your refund and put he whole thing to bed.

19lottie82 · 28/10/2015 12:44

thewrathofnann you have to Open a return request within 30 days of delivery, which the OP has done, so she's fine in that respect.

TiredMummy2015 · 28/10/2015 14:09

The tracking number just shows that they are awaiting collection.

No other details - frankly the number could be for anything!

I don't want to pay myself as the parcel is too heavy for Hermes. She paid £10 last time for the slowest delivery they do and had to pay more when they realised the actual weight and dimensions... To send this back with the correct insurance would cost me £60. I won't risk sending it myself with a lesser insurance amount in case she tries any more tricks.

As long as delivery is attempted, you will get your refund, no matter if she moans it is damaged or whatever .

It's up to you but TBH it's a small price to get this all tied up and your refund.

19lottie82 · 28/10/2015 14:41

PS Hermes will take parcels up to 25kg?

TiredMummy2015 · 28/10/2015 14:47

I don't see why I should be out of pocket by £60 though.

Called ebay again and spoke to them. I was told that she has 5 days for the parcel to be collected - so until Sunday. If it's not collected then they will refund automatically.

I asked them to guarantee it won't be extended yet again and they said it won't be.

So hopefully they will actually end this soon.

summerwinterton · 28/10/2015 14:49

good - I hoped there would be a limit as to how long you should wait for collection. You can then get your refund and take the blooming thing to a charity shop.

summerwinterton · 28/10/2015 14:50

(and please tell me you have negged her)

TiredMummy2015 · 28/10/2015 14:59

I was going to ask if any of you wanted to buy it Wink

I haven't given any feedback yet as I didn't want to aggravate her more. I will do so once I have my money safely back in my account.

OP posts:
19lottie82 · 28/10/2015 15:08

Hi OP sorry I was meaning that unless the buggy is over 25kg then it will be accepted by myhermes and cost under £10 to return, so you won't have to splash out anywhere near £60 to put an end to this.

But if eBay are saying it will be wrapped by Sunday then I'd hang tight!

When leaving feedback remember to keep it factual and not include any insults ect as then there is a possibility it might be removed.

TiredMummy2015 · 28/10/2015 15:22

Oh trust me I have sat on my hands to stop from insulting her quite a lot over the past month!

This is the only thing she has ever sold so she has no seller feedback yet. I doubt she will be able to sell anything again after this.

OP posts:
ThedementedPenguin · 28/10/2015 16:39

Wow have been following from the start and shocked it's still ongoing. I hope you get your refund on Sunday and never have to deal with her again.

She sounds absolutely bonkers.

TiredMummy2015 · 28/10/2015 17:23

The cheeky bitch has just messaged to tell me to stop messaging her ( the woman who sent me 20 messages in one day!) as she has more important things going on.

She claims eBay have told her she can have more time as her baby is in intensive care. This is the baby born via an emergency section that she was booked in for weeks in advance!

OP posts:
SeveredPixieBits · 28/10/2015 18:20

I can't believe this still hasn't been resolved. I am screaming on your behalf. I thought EBay were supposed to be customer focused!

TiredMummy2015 · 28/10/2015 19:20

Obviously not!

I'm now getting messages from her telling me I have no heart... I dont know why she thinks I care about her personal circumstances if her stories are even true. She has tried to rip me off and has then gone on to cause more stress and hassle.

OP posts:
TiredMummy2015 · 28/10/2015 19:32

Is it possible to block an eBay member? I think she will go crazy if eBay do end up refunding me. She is clearly not going to speed up the collection.

OP posts:
ThedementedPenguin · 28/10/2015 19:35

No idea about the blocking but I could do with the same advice as a seller won't leave me alone..

She is definitely bonkers.
