Not sure about condition of eBay item

I bid on and win a brand new pram. It's arrived today and has quite a few scratches on. The box it came in was fairly damaged but I'm not sure the marks and scratches were caused in transit.

What are my rights if I don't want to keep it? I got it cheaper than retail but not cheap enough to be happy about the scratches.

Great news - I wonder if it is a no fault refund from eBay coffers, or do you actually have the seller's money.

I've still got the buggy all boxed up ready to go. I've not heard from the seller in over a week but am expecting to once she realises I've got a refund as I imagine they've taken the money from her account.

I'm not sure what to do with the buggy. I will probably allow her to pick it up if she does contact me but it will have to be gone by next weekend. Otherwise I may sell it on with an honest description and donate the proceeds to the hospice that looked after my late dad.

Oh what a relief! Morally you need to give her every opportunity to collect it (yes, I know, she was an arse, but you do have the money back), but you should set a strict time limit, then do what you propose.

If you do list it on eBay I would definitely mention the whole story and the charity donation so you can't be accused of profitting from the whole situation.

And best of luck with the impending arrival. Maybe just buy a sling for the time being, eh? Wink

Finally! The money will have been taken (well, frozen) from her account as soon as you opened the case, so she will get an email saying she won't be getting it back.

Yes, send her a message saying as a GOODWILL GESTURE you will give her X number of days to collect it, otherwise you will sell it and give the proceeds to said charity. If she gives you any grief whatsoever, then report her to eBay.

Thanks for all of your help everyone has taken the time to reply and give advice.

I've not heard from her yet and am not going to contact her if she will be receiving an email to let her know the situation. I will wait a week and see if she contacts me.

Do give her a reasonable amount of time to collect. Maybe 30 days. (Personally I'd give it longer but then I have the space to stash it.) The reason is that although you should now be in the clear as far as ebay and Paypal are concerned, if you chucked it in a hurry and she really wanted to cause trouble she could cause mischief in the small claims court. They would be likely to take the view that you have to make the item available for collection by the seller for a reasonable amount of time (assuming the refund has come from her).

But she has already had a month to collect it and hadn't bothered. I don't see how she can take me to the small claims court over it? She booked a courier then cancelled it!

Nauticant..... That's not true in the slightest.
IF the seller even wanted to attempt to take anyone to the small claims court, it would be eBay, not the OP.

I just need the buggy gone now so I can order one for myself! Plus I just want this saga over with. ! I could go into labour at any moment and do not want to be still dealing with this horrible cow.

I thought an extra week was very generous considering I did warn her that this would happen if she didn't have it collected by ebays deadline. They even gave her an extra 5 days and she just ignored them.

She says she got this buggy for free as the company she bought it from sent her two and let her keep them both.... So she isn't actually losing out any money that she actually spent. Though she has lied so much I doubt that was true!

I think you need to draw a line under this asap and start looking after yourself now with the impending birth. The stress and worry of this is the last thing you need atm.

I agree with summer here relax now and look forward to the birth of your little one,if you weren't pregnant I would suggest you indulge in a large glass of bubbly and celebrate the fact that this scammer didn't get over on you in the end,because I am still convinced she never went into this deal honestly.
