Not sure about condition of eBay item

I bid on and win a brand new pram. It's arrived today and has quite a few scratches on. The box it came in was fairly damaged but I'm not sure the marks and scratches were caused in transit.

What are my rights if I don't want to keep it? I got it cheaper than retail but not cheap enough to be happy about the scratches.

I escalated my claim with ebay yesterday. They have come back and said that they are placing it 'on hold' for 3 days... is this normal?

Probably on hold because of the high value, so a real person will review rather than an automatic decision. Let us know the outcome.

I've had another email from ebay saying that they are giving the seller 5 days to provide me with a means of return, pre-paid label or funds to pay for the return.

So we shall see if she responds. Now how should I handle this? She charged me £30 for postage that cost her just over £10. But in order to get insurance at the correct level a courier would actually cost £60. Do I insist on being given enough to pay insurance for the full amount or do I allow her to send a label for only a partial insurance amount? I'm wary that she could say the returned item is damaged and drag this out for more weeks.

She won't get anywhere if she says the item is damaged upon return. As long as there is proof of a delivery or even an attempted delivery then you'll get your money back.

Wait and see what she does re the return label / funds. iF it is inadequate THEN contact eBay.

That's a relief to know.

I have a feeling she won't respond to ebays request. They have said if she doesn't that they will refund me without me having to return the item. I don't really want that as it's so expensive and I never set out to rip her off.

Call ebay and again demand a label from them, explaining the seller already charged 3x the postage and lied about delivery times so you have no faith in them arranging a courier.

They will send you one. They're just making you jump more hoops because it's heavy and therefore more expensive to return.

Well the seller has messaged me asking what days I am home for the buggy to be collected.
She has also said once she is " even able to accept" the delivery she will check it and if she is not happy will withhold money.

I'm so fed up now - can I refuse to deal with her and make eBay deal with her? My stomach drops when I see her name in my inbox. She clearly hasn't a clue how this process works and is still thinking she can drag it out longer.

Why!?

Well the danger with that is you won't have the tracking to prove delivery - so I would wait for ebay to contact you tbh

No. Don't agree to this, ever. As Summerwinton says if she collects it you won't be able to prove its been returned.

Did she send you this message through the resolution centre? I'm guessing not. Just ignore her. ebay are dealing with it now. She knows she has a limited number of days to issue you with a returns label, if she doesn't then any consequences are her own fault.

if you do get a full refund and she still wants to collect after that has been done you would be safe then, a refund cannot be reversed.

She isn't asking to collect it personally. She reckons she has to arrange the courier herself and the soonest it can be collected is next Thursday. I really want it picked up asap.
She is claiming she has to go into hospital for an emergency section for her premature baby and won't be able to accept the delivery any sooner.

Nope, don't let her collect with her courier until AFTER she has refunded, as again you won't be able to confirm delivery. Tell her ether she gives you funds to arrange courier, or she can refund then book herself. Don't listen to her emotional blackmail, seriously. She's taking the pee.

Honestly, if you're going to come up with a sob story, at least make it a faintly credible one.

Agree with everyone else - either say she pays you buggy cost + courier (and if that costs £60, then it costs £60) or she refunds you and then book and send her own courier.

Do not send it until you have had your money back

She seems to be under the impression that eBay expect her to arrange a courier. I did ask her to just send me a label and details so I can book the courier myself.

She has been trying to tug on my heart strings for the past week with her " complicated pregnancy" and how it's going to stop her from being able to sort things out quickly.

I'm not sure why she thinks I would even care if it was true. I'm pregnant myself and she has ripped me off and purposely caused more hassle and aggravation. Having had a previous genuine emergency section myself I am well aware that you don't get advance notice but can't be bothered telling her that.

I will ignore and wait until Sunday when the eBay deadline is up and see what they say.

If she arranges her own courier you will have no proof that the item has been returned and she will get to keep the money. You need a label then you arrange.

You are doing the right thing ignoring her. As I said eBay have given her instructions and she is choosing not to follow them.

if she doesn't send a label or funds for return and eBay refund you, THEN tell her you will hang on to the Pram for 30 days (if you have space) and she can send a courier to collect it. If not, you will dispose of it.

You arrange the courier so that you have all the paperwork and proof of delivery yourself. Do not let her arrange for anyone to take the buggy away.

I have messaged her to reiterate what eBays instructions actually were and to tell her to only contact me via the resolution centre.

I don't want her to kick off if they refund me automatically. At least this way she has been told and will only have herself to blame.

Obsidian - that is not strictly true. If eBay provide a label then that is fine - but OP needs to keep a record of the tracking
