Husband wants me to move out while he stays in marital home

Husband has just suggested that I move out of the marital home and in with one of my friends while he stays in the 4 bed property just him and our teen son until he decides to sell.
I am entitled to 50% of the equity which should be approx £80,000 which I need to be able to buy my own place.
he thinks his suggestion is perfectly reasonable and that he will infact be doing me a favour as he will continue paying the mortgage by himself till he decides to sell (c ok kid be 6 months time or so)
i am flabbergasted quite honestly, it seems crazy to me and he sure wouldn’t want it the other way round. He said ‘well I can afford to keep it on my wages but you can’t on yours’
and I was like ‘I think this is unfair and stopping me being to move on’ I really
am a bit livid. He hasn’t told his mum of his grand plans so I’m hoping she will tell him to wise up 😖

Oh love, I'd be livid too. He gets to stay in the house with your son, decide when it's sold, and you're meant to sleep on a mate's sofa and be grateful? No chance.

Please don't move out until you've got something agreed in writing. Moving out doesn't mean you lose your share of the house, but once you've gone it's very easy for "6 months or so" to turn into a year or two, and he's the one calling the shots.

If the house is only in his name, look up registering "home rights" with the Land Registry. It's free and means he can't sell or remortgage behind your back. And whatever you two agree, get it made into a consent order. Otherwise it's not really binding, even after the divorce goes through.

Also 50/50 isn't a given. They look at what you both actually need to rehouse yourselves, so if £80k won't get you somewhere, that counts.

I actually work on a site called divorcd.com that goes through all this step by step, the house stuff especially. Might be worth a look before you speak to him again. But honestly, a free first call with a family solicitor would be money well spent too.

Thanks xx this thread is a few months old now and basically it ended up where we co habits for two months while he bought me out my share and I bought and moved into my own place so it all got sorted amicably in the end 😀
