You're not fucked, or at least legally you arent. Stick to your guns, ask for a copy of the policy. If they try any disciplinary nonsense then ask for a copy of their capability/grievance policy as well.

MRex · 07/01/2021 14:12

Call ACAS 03301075370 for advice on how to handle the meeting. Sorry you're dealing with these idiots, it must be very stressful. Call your local authority public health to report the company too, anonymous if you prefer.

Wankerchief · 07/01/2021 17:37

I've just realised how many errors are in my OP
I'm just in my way in, turns out two others expressed concern and they have private appointments with the manager and shift supervisor too. Gin

Whatever you do, stand your ground.

It sounds really hard, but you and your two colleagues all did the right thing. Don't let these bosses try to say any different. 👏

FOJN · 07/01/2021 18:05

Good luck OP, don't let them bully you.

LacyEdge · 07/01/2021 18:25

You are in the right here OP. Stay strong. So sorry you’re having to deal with this crap, like there isn’t enough on your plate (and everyone’s) already Flowers

Trackandtrace · 08/01/2021 18:13

Any updates?

fadingfast · 08/01/2021 18:22

If you refuse to work due to legitimate health and safety concerns (and it sounds as though yours are definitely legitimate!), and your employer dismisses you, you would have a very strong claim for unfair dismissal. Seek advice from Acas. Unfortunately tribunal claims are subject to an extremely lengthy delay in the system at the moment though.

MadameBlobby · 08/01/2021 18:35

Go home and put together a s44 letter similar to the teacher one the other day.

RandomMess · 08/01/2021 18:42

What selfish irresponsible employers Thanks

Mousemay · 08/01/2021 19:01

I would turn this around on them and say that you want a representative present and also as previously requested a full copy of covid guidelines for the workplace. If they try to insinuate or bully you into believing you could get sacked. Repeat calmly and firmly 'are you threatening or implying that you will terminate my contract because you have failed to adhere to the government and employment law guidelines in relation to covid 19?' Take written notes slowly and ask them to repeat what they are saying. Ask for head office etc. number and who they report to. Don't put up with this crap. They have broken the law by allowing the employee back into the workplace without a proof of a negative result. Remind them of this.

30not13 · 08/01/2021 19:08

Section 44 notice letter. Not just for teachers.

Wankerchief · 09/01/2021 19:04

Hello all
I went in,full staff meeting about the importance of teamwork and not gossiping about others. Somebody asked after the ill lady and was told that her medical concerns were not ours.

About an hour into my shift i was called to my meeting i asked sbout the policy but was told that the meeting was bot about that but about a few things they had noticed. Ive not had on my name badge on the shop floor on s few occasions(true it was on my work fleece that i took off), i had taken food to the shop floor(not true) and i had not been doing closing routine to a adequate standard (also not true)so as such i was going to be performance managed for a fortnight and we will see what happens then

Mouth should of stayed shut

Speak to your union OP. If they’re a major retailer you should whistleblow.

StacySoloman · 09/01/2021 19:08

Sounds like you need to join a union.

Wankerchief · 09/01/2021 20:04

I'm working tomorrow and Monday but have tuesday off so I will look at unions then I guess. I think I need to think hard, I need this job, alot. But I need to keeps safe.
The other two ladies had similar style meetings, they basically told one she's due to retire soon ( in 9 months) so stay steady and Don't rock the boat.
The other hasnt worked here long, about 8 weeks and she was warned off to.

CremeEggThief · 09/01/2021 20:09

Thanks for updating us and I'm so cross on your behalf over your treatment by your bosses. Keep detailed records of everything they say and do, ideally with dates and times, in case you need them for a tribunal at some point.

Porcupineintherough · 09/01/2021 20:15

Furious on your behalf OP They sound totally dodgy and are clearly bullying you all into putting up and shutting up. Please do think about joining a union and discussing your situation with them. I'd also suggest you start looking for another job.

ChoccyJules · 09/01/2021 20:18

I think ACAS will give you phone advice, they did me once, very helpful and thorough.

FOJN · 09/01/2021 20:19

So they're basically bullying you for wanting a safe work environment.

Whatever happens I would keep a record of everything. I might be inclined to follow up the meeting with an email documenting the meeting and your understanding of what was said to you. I hope they were able to give specific details of you "under performance" so that you have a clear idea of how to "improve", anything less is poor management. If you can get a copy of the performance management policy it would be helpful in making sure they follow it to the letter.

When things are better in the job market I would leave, they are not good employers. Utter bastards.

SunKeepsShining · 09/01/2021 20:22

Sorry your employers are such shits.

Don’t forget apart from unions your local council will have covid enforcement departments and there’s always the press who will want to knew about big companies forcing covid sick staff to work.

Beautifulbonnie · 09/01/2021 20:27

Aren’t you allowed to take people into meetings with you if requested?

Can someone advise on that?

PurpleMustang · 09/01/2021 20:35

For your original post I was going to suggest ringing 111 and ask if she could of been tested that way.
With what has happened i would keep a diary of everything regarding her, yourself and what has been said to others incase it is needed. And you need to report it to HR. You are all being bullied into keeping quiet

ktp100 · 09/01/2021 21:07

She's out and out lying and is a massive twat, as is your boss.

I'd walk out. They can't choose to go against government guidelines because it's convenient for them.

ktp100 · 09/01/2021 21:10

You shouldn't feel like you need to keep quiet about this, OP.

They're now setting you up for a written warning to keep you in check!!

You need to report them, honestly. This is just disgraceful.
