But surely the items were available when you bought them and got your order confirmed? They couldn't have confirmed order if items weren't available??

This reeks of someone trying to cover up their mistake...

Re Mothercare order *

I have just received an email stating that the order I placed yesterday has been cancelled due to the items not currently being available.

My unsdertanding is that this is a long-term product that is also stocked in your stores. I am curious that this product is not avaiable, and wonder instead if you have just decided that a pricing error means you will cancel your agreement to sale.

Your website is very good an indicating when items are no longer in stock and this was clearly not the case when I ordered yesterday.

I am happy to wait until this product comes back into stock, or collect from my local branch - at the price you agreed when sending me my order confirmation.

I look forward to hearing from you as a matter of urgency.

From the Mothercare T & Cs - the relevant bit is the last para ;

Acceptance of order: We will notify you of our acceptance of your offer to purchase by email shortly after we receive it and at that point a binding agreement between us will be in place on these terms and conditions*. If we do not accept your order for any reason or the price of the product has increased between the time of the order and our acceptance of it (or if a supplementary delivery charge applies), we will email you to advise you of the change. You will then need to resubmit your order. Only credit and debit cards are acceptable as payment for orders via this site. Gift vouchers are not accepted.

*but subject to our right to withdraw such acceptance where your offer relates to goods that have been priced below that which we intended.

But they have not said that they are withdrawing their accetpance due to a pricing error, only that the item is no longer available...

I have my email here too. insertexpletive is right, as far as I can see they can't cancel under the T&C if the item is unavailable - although they can cancel if it is advertised at the incorrect price - but that IS NOT what they have said in the email. I have emailed them a complaint pointing this out and telling them I expect the order to be fufilled with the item ordered or a comparable product.

You have to go to the website and send the complaint through "Contact Us" at the bottom right of the screen.

Another cancelled order here :(

I have emailed them through the website quoting their own terms and conditions and stating that I wish to see our agreement honoured. They have emailed to say a response should be sent within 48hrs.

Will update here with any response I get. My sister who I alerted to the deal yesterday is also emailing the same complaint Grin

Also, the order has vanished from my account when I log in. Is this normal when they cancel orders or are they hoping I will forget I ever placed the order??!

Imarriedafrog you are probably right, but think I will chance my arm as feel they are a company which should honour their contract.

The reason that they have given for cancelling is not covered by their own T&C's.

Advice from Consumer Direct is to write to Mothercare and send by recorded delivery stating that you believe they have breeched their contract.

I have emailed them already, so will wait for their response. To be honest, knowing me, the 'fire' will have dulled in 48 hours and I will not follow up anyway.

I'm on the phone to them right now - a very nice, but obviously harrassed woman has informed me that they'd made an error with the price on the website, and on that basis they've cancelled all orders. It appears that they would have lost too much money to go ahead with fulfilling orders.

As a "goodwill gesture" we won't be charged for p&p on our next order. Whoop de doo.

Wouldn't like to be in the shoes of whoever made that website error!

Och well.

They've taken it off the website altogether. The thing is if they're using the not available excuse, then they're shooting themselves in the foot because they now can't sell any stock they do have can they?

Perhaps they genuinely have none.

Looks like they have now made two errors then as the email to cancel talked of no stock, not pricing error...
