The legals as I understand them are; that Mothercare accepted the offer by their confirmation email - not when the consideration (£9) changes hands.

No, but the consideration only has to be agreed as part of the contract - which it was. You can create a contract without money being the consideration for example, using a peppercorn.

Yes, I know consideratin can be anything - just wondered what it was in this case. Wasn;t sure if just the promise of money changing hands would count.

As I say though - I am in no way legal and just curious.

There must be a legal way out of it for retailers anyway. It has happened before and the retailers have't had to fulfill orders. I am sure if they legally had to it would have been made known many times over.

Yes there is a way out for them - they can use mistake saying it was so obvious that consumers should have realised. That's covered in the T & C's anyway.

It's happened with Kodak and Argos and these have been well publicised. Sometimes they capitulate, and sometimes, not.

No, I think the complaints are at the way that MC have handled the error, and the fact that as someone pointed out earlier, they are very quick to hide behind their T&C's when it suits them (as most big retailers tend to be)

Mine's been cancelled too. Hey ho. Am resigned to it, although what a ridiculous t&c statement that is: the agreement between us will be binding once we send the confirmation email, unless we decide that it isn't binding.

No-one really thought that they would get one did they? When you order goods you sign up to the terms and conditions. The terms and conditions are clear that MC don't have to honour contracts where there is a misprice. It was worth a shot, but hey-ho "If it looks to good to be true.." and all that.

I have actually just emailed matt back saying how he has really upset my little people and i hope he can sleep at night knowing he has ruined the hopes of the future generation. I also pointed out false advertising etc... but he will probably just circulate my email and snigger. Never mind worse things happen ..........Grin
