Hi guys. Had a crap day. I won't go into the details but I'm on a FTC with an NHS organisation, who previously hosted my previous employer (arrangements like this are common where one organisation isn't a legal entity). The ftc is for a year as I am covering a secondment - person has resigned now. Originally the discussions were they would extend my contract to the end of my Mat leave and get cover. Today this changed to 'we need to consider our options - and they may not be favourable to you'.
Can someone please check my maths to see what I'm entitled to?
Policy says:
2.3 Occupational Maternity Pay (OMP)
2.3.1 If you have at least 1 year’s continuous service with the NHS by the 11th week before your Expected Week of Childbirth (EWC) and you intend to return to work at the Xx or the NHS for a minimum of 3 months, you will receive:
? 8 weeks on full pay less SMP or Maternity Allowance receivable
? 18 weeks on half pay
? 26 weeks unpaid leave
Continuous NHS service is working in the NHS with a break of less then 3 months between appointments. Breaks of less then 3 months will be disregarded though not count as service. See section 2.7 below for further information.
2.4 OMP plus SMP
2.4.1 If you have at least 26 weeks continuous service with the Trust by the beginning of the 15th week before your Expected Week of Childbirth (EWC), at least 1 years continuous service with the NHS by the 11th week before your EWC and you intend to return to work at the xx or the NHS for a minimum of 3 months, you will receive:
? 8 weeks on full pay
? 18 weeks on half pay plus the flat rate Statutory Maternity Pay (or average
weekly earnings, whichever is lower)
? 13 weeks on SMP flat rate
? 13 weeks unpaid leave
My contract started on the 12th April. My due date is 25th jan. I've worked out I just meet the requirements but can someone else count for me?
I'm so stressed and upset now. They're basically saying they think it will be too expensive to cover and that they will need to advertise externally anyway. I'd then need to prove discrimination if they didn't appoint me.
At the present time though, I just want to check I am right in my interpretation of dates. They're now also saying that my contract has to end more than 11 weeks after my edd to qualify for omp. But that's not in the policy?
I wouldn't mind but I work bloody hard, I know it's crap that I'm pregnant so soon after starting but I can't help it. And what's the point of a contract if it means nothing?!?
My mum works in employment law and is reviewing everything but any further advice would be great.
