AIBU to think these boys should have been incarcerated?

I've never started an AIBU before, but I'm genuinely really shocked. I'm just not sure how this sentence is justifiable. Their actions were premeditated and deliberate, they were carrying a knife and they filmed themselves. They're obviously a danger to women/girls, and probably to other boys too.

If anyone knows how and why this sentence might have come about, I'd be interested to hear it.

Utterly, utterly disgusting. Only in Soft-Touch Britain could men commit gang-rape, twice, and not go to prison.

And yeah, if you're man enough to commit rape then you're man enough to be tried as an adult. They have that option in the US - to try teens as adults if they commit adult crimes. 🤬🤬🤬

Justice has in NO WAY been done.

Those poor, poor girls.

Why do you think that? Because I’m not advocating being a vigilante? Because I understand rehabilitation isn’t about what sounds the most vengeful?

It’s not about being a vigilante which btw is a derogatory term for people wanting justice

The justice system in the U.K. is twofold
1/ rehabilitation and
2/ punishment

In this case and many rape cases the element of punishment is woefully lenient and in some cases non existent

They can’t be named but you can put a link to the cps article or today’s date and reference three un-named perpetrators. It will accept either.

He added that "peer pressure played a large part in what went on".

Is he joking? They shouldn't be criminalised? Rape due to peer pressure?

The victims were raped at knife point. The assaults were filmed and shared online. One victim was raped 3 times.

You want to challenge 'misogynistic attitudes'? You could start by punishing rapists appropriately. I don't care what age they are. They know right from wrong.

I think their risk to women/ the public and their progress in rehabilitation needs to be carefully assessed, and I would advocate on the side of caution with that- but not that they should be criminalised. It’s just not effective

One of them was convicted of 6 counts of rape for crying out loud. He’s criminalised himself. He’s 15 not 5. He’s a danger to women and girls now and will probably continue to be so for the rest of his life.

They have been sentenced to a youth rehabilitation order. They will just be living at home and visiting a youth rehabilitation worker once a month.
Will there be any consequences for what they did to those poor girls?

Criminalising isn’t about the technicality of being criminals, it’s about not giving them a chance of a rehabilitated adult life because they will a) come out of adult prison better criminals and b) suffer the impacts of “criminalisation” for the rest of their lives. That’s about labelling them as a criminal rather than looking at the link between behaviour at such a young age and the link to trauma and vulnerability.
it harms their chances of employment, education, the way the police treat them and how they view themselves.

and this isn’t about feeling sorry for them- its about the most effective way to rehabilitate them

criminalising also increases the risk of reoffending

This absolutely HAS TO harm their chances of SOME employment.

They categorically cannot ever work with children or vulnerable people, in health or social care.

They must be criminaoised to the extent that a DBS never ever erases this.

It would be interesting to know how this sentence compares to other violent crimes committed by under eighteens, eg knife crime, muggings, assault.

I really think we need to start categorising the rape and sexual assault of women and girls as a hate crime.

I feel it's worth pointing out that only one unduly lenient form needs to be submitted.

It's not like a petition - it doesn't get more attention if lots of people do it.

And what of the victims’ mothers? Where is the reporting on their reactions?

They'll be on the sexual offenders registry now but due to their age it will be wiped after a few years. I don't know the exact number

I don’t know if I’m just being dim, but how did they post the first attack on social media, as mentioned in some of the reporting, without attracting any attention or repercussion whatsoever (I assume, given that they were free to commit a second attack months later)?

The justice system does not solely exist for rehabilitation. Punishment for punishment’s sake is what justice systems all over the world were set up to do millennia ago.

I sincerely hope that this is rectified. I have filled in one of the forms as discussed upthread, and I hope others do the same. Does anyone know anyone else who it might be worthwhile to get in touch with? Would my local mp be of any use given I live on the other side of the country?

I came on here specifically to start a thread on this as just equally appalled they were not spending any time in custody.

I understand their ages, but even so, these attacks were extreme!

I’m completely sickened. Although I would never advocate vigilante justice, I wouldn’t be upset if these boys received some!

They are animals, not fit to be loose in any society. No young woman will be safe in three years time.
