AIBU to think these boys should have been incarcerated?

I've never started an AIBU before, but I'm genuinely really shocked. I'm just not sure how this sentence is justifiable. Their actions were premeditated and deliberate, they were carrying a knife and they filmed themselves. They're obviously a danger to women/girls, and probably to other boys too.

If anyone knows how and why this sentence might have come about, I'd be interested to hear it.

Honestly I’m half way to suggesting girls should be armed in this country. Not boys. Just the girls. And if there are girls who do abuse that privilege go in fro t of the judge, will there be concerns about criminalising them and the effects on their future lives??

Of course not.

I’m not particularly religious but I’m starting to lean towards “an eye for an eye “ type of punishment at this point! 😡

That judge should be sacked. He is not fit to sit on these kinds of trial. He is obviously a woman hater. This an unduly lenient sentence if ever I saw one! I hope the CPS refer it to the attorney general (who it seems may be another woman hater) 😡

Speaking as a civil servant you can bet your life @FinchiePinkthat receipt of 30k forms in relation to one offence will absolutely be flagged up to the AG and the Justice Minister. As politicians they absolutely want to be informed when vast numbers of the public are unhappy.

Were you one of the ones who used to set up fights and bet on the winner? Or one of the ones who’d go down to reception and have a nose through the files to find a boy who’d been sexually abused in the past, and therefore an easier target? Or were you one of those who banged up a boy with his shoe laces after he told you he wanted to see his dead mum?

Don’t think because you wore a uniform you or any of your mates were any better than the people you locked up.

I've filled in the form too. This wasn't blurred lines around consent... it was pre-meditated gang rapes with multiple victims and a weapon. Those poor girls. Boys that can do that at 13 / 14 do not turn into 'nice young men' growing up. I hope this follows them for the rest of their lives and any future girlfriends / contacts are warned of the risks

Is getting your conviction handed down different to being sentenced? Sorry I actually don't know the answer so could be making wrong assumptions.

I'm pretty shocked by this sentencing I hope the victims are able to appeal it and I would like to see the judges previous sentencing record.

Obviously they can't go to an adult prison but it makes no sense why they don't go to a juvenile detention facility. It is the complete wrong message to send it's disgusting. Two fingers up to the victim and she has to go about the area knowing they are walking around free and emboldened. No wonder so few victims go through the judicial process for rape.

I’m not really following you. Are you saying you think manslaughter is the same as murder? The outcome is obviously the same but legally they’re very different and attract different sentences. The sentences in this case are a little below average I think, but not as surprising as the rape case in the OP.

Agree that a community sentence often seems as though it’s not much of a punishment. However there’s no evidence that longer prison sentences are a deterrent to others than shorter ones, or that prison is more of a deterrent than a non-custodial sentence. In countries where children really are not criminalised, there’s less youth violence and less reoffending.

If there’s no evidence re your later comments, that they are beneficial or otherwise
then there’s not reason not to use custodial sentencing as a means to punish

For that alone
Punishment is part of sentencing

This is absolutely horrendous and is no justice for those poor girls. Will they be placed on the sex offender register?

I can not imagine going through that, having the videos shared across social media, retelling it in court only for them to basically be let off! This is not punishment for their actions!

Yes

You are found guilty first then
sentencing happens at a later date
This is so the judge can have time to consider and write up the sentence.

It's disgusting. The focus should be on the safety of victims and the protection of wider community,. I do not see how this sentencing protects other women & girls from being subjected to this violence in future.

I have filed an objection.

I am almost speechless that this has been the outcome for these 'boys' thus far, when those brave girls will live with the devastation for so long.

Thinking of them and their families with a heavy heart, and wishing them all the strength in the world to hang on in there and hope that the weight of our objections aids their justice finally.

It’s dated today and says they were sentenced today. They were convicted in March, there’s often a gap for sentencing reports to be prepared

I believe they were sentenced today. The article does say they were convicted on an earlier date.

I understand that from a process point of view it may only need one form to trigger an initial review. But notice will be taken of all the others if there are a large number. One form could be a lone objector - isn't there always someone willing to complain about any give issue? - but hundreds or even thousands can't be so easily dismissed. And really, what else can we do?

They have not named the judge.
