To wonder if DH should appeal parking fine - photo included

Dh went to carpark last week. He parked slightly over the hatching instead of within white lines as he had a passenger and car next to him was quite close to white line. Obviously his parking isn’t great but worth an appeal for £100 fine?

Plus those hatched lines are so feint they need repainting. I’d appeal as long as there wasn’t a sign referring to being fined for not being within a bay that was visible on my journey from parking the car, walking to the store and back to the car.

Looking at the gap on the passenger side it’s hard to see why he parked so far over. He’s unlikely to win an appeal as he has technically parked in a banned spot, but it’s always worth a shot.

If it’s a private parking enforcement company they are chancers. We once got a ticket when DH was clearly sitting in the car. We appealed that although the car wasn’t moving the engine was running so it wasn’t actually parked. Didn’t hear any more from them.

So this happened in a Tesco car park? In which case it’s not a fine, it’s a speculative invoice. Only councils can issue fines.

If it was a council fine you’d have no chance of fighting it. If it’s. If it’s a private enforcement company speculative invoice, then the internet is full of info on how to deal with them.

The wardens at the council car parks in my town issue tickets to people who park over the lines.

I think the fine is a bit harsh to be honest. It's not blocking anyone's way, or stopping anyone else from parking. I could understand if he was taking two spaces, or parked somewhere that wasn't a space at all, but I really don't see the problem here.

I mean, technically yes, he wasn't in a marked bay - so you probably won't have much luck appealing..

But he's neither harming anyone nor costing anyone (the car park) money with the way he's parked, so yeah it is shit parking, but a fine is mean.

Oh if it’s Tesco different story - when it happened to me I was advised to approach it like an invoice..

were their signs etc? Very much depends on how clear parking rules are

it must have been in a big city as most supermarkets dont like to penalise customers for parking to my knowledge

Indeed. With supermarkets you can often get it cancelled by speaking nicely to the store manager.

It Is standard for car park terms to require parking within the lines, a couple of example Tesco car park signs below ….

Thankfully, there are no Tesco supermarkets where I live, they’re only in the city. 😂

There’s tons of mad parking locally though. Usually it’s an older person parked slightly diagonally across two spaces or a tractor taking up several spaces. We also get tourists in huge camper vans parking sideways across 3 spaces. They do annoy me as they’re the sort that won’t pay to park in a proper campsite and so park up in the local woods or at a beach and then leave their rubbish or even worse, empty their toilet container anywhere they feel like. 😡

It’s rubbish parking yes. However the question is whether the OPs husband should challenge paying it. If it’s a speculative invoice by a private parking company, then absolutely yes. Lots of advice on the internet about not how to avoid paying these charges.

If it was an actual fine from a council, then no chance, just pay it.

I'd be interested to see that grounds you'd appeal on.

I'm not sure 'he wasn't over two spaces' and 'he was only buying the most expensive Tesco meal deal' would really hold up 🙄

It’s not an appeal as such, it’s basically getting out of paying it. There are ways to do this with private parking company invoices. Speaking to the store manager being one, telling them you’re a regular customer and won’t be coming back etc etc. Store
managers often have the power to cancel them. After all these are meant to be a deterrent to stop other people parking there and keeping the car park free for customers, not to piss off genuine customers.

There is also a lot of info on the internet telling you how to get out of paying them.

No, he shouldn’t. Presumably that hatching is there for good reason, even if it’s not immediately obviously, eg giving cars a sight line when turning.

The next car is within its own space so no one is taking up two spaces. If the passenger had mobility difficulties he could have let them out before parking, or he could have parked the other way around and squeezed out himself (if the passenger had difficulty with this).

Look at the lock on the wheel... he's just swung it into the space, he's not "parked" at all. Love to know what you're thinking of appealing. Life's not fair? The rules shoudn't apply to me?

Agreed it is rubbish parking but i get more frustrated when people take up 2 spaces. He was only gone 5 minutes to buy a sandwich.., the most expensive Tesco’s meal deal!

”Only 5 mins” is the weakest excuse going. People who park in disabled spots say things like that. The hatchings are there for a reason and I can’t see a sign saying “ If you are only going to be 5 mins its OK to park here”

It’s not a fine. Only councils can issue fines. Private companies can only issue speculative invoices, which don’t carry the same
legal weight as a fine. Many ways to avoid paying them.
